Tender Form - VIPP STATEMENT

It is a requirement of VIPP that all short-listed tenderers will be required to submit a VIPP Statement in the following formwhen a tender is equal to or exceeds $3,000,000 in the Melbourne Metropolitan Area, and $1,000,000 in Regional Victoria.

Where advised, this form is to be submitted with the tender, but in a separate sealed envelope, clearly labelled VIPP Statement and containing both the Works Number and the Tenderers name, otherwise, the VIPP Statement will be requested by the Department after the short-listing process.

Declaration

The tendering Company or Organisation states that in submitting the Tender and the VIPP statement, the identified tenderer:

  • Agrees to take all reasonable steps to comply with the Victorian Industry Participation Policy principles
  • Agrees that compliance with VIPP commitments will be monitored as part of overall performance management and
  • Acknowledges that failure to comply with a VIPP Statement will be centrally recorded by the Victorian Government and may be taken into account when considering subsequent tenders for VIPP purposes.

Support Services Available

Tenderers are advised that the services of the Department of Innovation Industry and Regional Development (IIRD) and the Industry Capability Network Victoria Branch (ICN Vic) at are available to assist them implementing the Victorian Government’s Industry Participation Policy. This will involve:

  • The identification of local products and capabilities that meet contract requirements;
  • An assessment and comparison of local products and capabilities with overseas equivalents;
  • The selection of products and services that meet the contract requirements on a best value basis; and
  • Monitoring and reporting on the outcomes for local industry involvement.

Free ICN services are available to support tenderers in identifying and communicating the above information, including during the tender process. For tenders valued over $10m ($2.5m in regional areas), it is mandatory for the preferred bidder to consult with and obtain certification of their VIPP statement from the ICN.

“Australian value add”, in respect of products or services, means the supply price of those products or services less the amount spent on imported products and services (including, without limitation, all components, embedded software and design, manufacturing, assembly and supply services) used for or in the supply of those products or services. In determining the amount spent on imported products or services, all amounts paid (by the Contractor or its Approved Subcontractors) to foreign persons (which do not include New Zealand persons) must be taken into account, including without limitation:

(i)all fees or remuneration costs paid for staff employed or contractors engaged by foreign persons;

(ii)all licence fees paid for intellectual property rights if those intellectual property rights are owned by a person other than an Australian or New Zealand person;

(iii)the cost of all products (including components for other products) purchased from foreign persons; and

(iv)all amounts paid to foreign persons as transfer pricing or as distribution of profits derived as a result of the supply of the products or services.

For the purpose of this definition, "foreign person" means any person who is not a resident of Australia or New Zealand.
