AFFIDAVIT: BONA FIDE NONPROFIT ORGANIZATION STATUS

BEFORE ME, the undersigned Notary, , on this 24th day of March 2014, personally appeared Shannon M. Vilhauer, known to me to be a credible person and lawful age, who being by me first duly sworn, on her oath, deposes and says:

1.  Habitat for Humanity of Oregon maintains tax exempt status under § 501(c)(3) of the Internal Revenue Code of 1986 and charitable organization status under the laws of Oregon; (Attachments 1a and 1b)

2.  As stated in Habitat for Humanity of Oregon’s bylaws, its mission is “Seeking to put God’s love into action, Habitat for Humanity brings people together to build homes, communities and hope”; (Attachment 2a and 2b)

3.  Habitat for Humanity of Oregon is registered as a charitable organization with the Oregon Secretary of State. Our most recent Certificate of Existence signed by the Secretary of State is attached, as well as our most recently filed CT-12 form, documenting Charitable Activities Section of the Oregon Department of Justice; (Attachment 3a and 3b)

4.  Habitat for Humanity of Oregon files annual tax returns with the Internal Revenue Service, as indicated by our most recent IRS 990 Form; (Attachment 4)

5.  Habitat for Humanity of Oregon does not receive funding or charge fees in a manner that would incentivize its employees to act other than in the best interests of its homeowner-partners.

6.  Habitat for Humanity of Oregon does not compensate its employees in a manner that would incentivize its employees to act other than in the best interests of its homeowner-partners. No employee of Habitat for Humanity of Oregon receives compensation based on the volume or type of mortgages originated or serviced.

7.  In accordance with this mission and pursuant to the covenant signed between Habitat for Humanity International and Habitat for Humanity of Oregon, housing units are sold to homeowner-partners with no profit added and payments for the housing unit are financed with no interest charged. All home sales and mortgage financing transactions are conducted in such a way as to assure that the initial monthly payment of a purchaser of a Habitat home does not exceed 30 percent of the household’s gross income. Included in this initial monthly payment calculation are loan principal, local real estate/property taxes and homeowner’s hazard insurance, and where applicable, mortgage insurance and loan servicing fees. These required terms are favorable to the borrower and comparable to housing assistance provided under government housing programs; (Attachments 5).

8.  Habitat for Humanity of Oregon requires loan originators to obtain training and complete continuing education in FHA, ECOA, TILA, FCRA, HOEPA, HMDA, RESPA, FDCPA, GLB and SAFE.

9.  Habitat for Humanity of Oregon obtains criminal records checks on loan originators.

10.  Habitat for Humanity of Oregon implements a process for receiving and documenting complaints.

I have read and had an opportunity to correct this Affidavit consisting of 3 typed and handwritten pages, and declare under penalty of perjury under the laws of the United States of America that the foregoing is true and correct, to the best of my personal information, knowledge, and belief.
