Swimming Pool/Hot Tub/Spa Addendum

SWIMMING POOL/HOT TUB/SPA ADDENDUM

This addendum becomes part of the rental agreement for the property known as/located at: ______, between the owner/manager______and resident(s)______.

Resident___ Landlord/Manager ___ will arrange for pool opening and closing, including bearing the costs of any related service and all chemicals and supplies needed. If arranged by resident, service must be performed by a landlord approved vendor and proof of receipt is required upon completion of service.

Resident agrees not to open pool prior to the following date, ______and agrees to close the pool by or before ______.

Resident agrees to be responsible for normal maintenance on the pool/tub/spa, to include the purchase of chemicals, supplies and other equipment necessary for normal use. This includes obtaining, at the resident’s expense, testing and periodically checking water for proper balance and maintaining appropriate water quality and chemical balance/levels. The owner/management assumes no responsibility for improper concentrations or use of pool/tub/spa chemicals.

Resident is required to maintain renter’s liability insurance for the entire term of the lease with a minimum coverage of ______and agrees to name the landlord (and management company if applicable) as an additional insured party.

Resident agrees to use ordinary and reasonable care and caution in the use of the pool/tub/spa equipment and agrees to maintain all utilities and services necessary for normal maintenance of the pool.

Resident is responsible to immediately notify and report any problems or functional discrepancy with the pool/tub/spa to owner or management.

It is agreed that all minor repairs and upkeep to the pool/tub/spa shall be the responsibility of the resident. All major repairs shall be the responsibility of the landlord, except when such repairs are due to negligence, non-reporting of problems, misuse or any damage to the pool and/or hot tub caused by the resident or resident’s guests, including but not limited to: broken glass, sharp objects or other items introduced into the pool, contamination of the water, damage to the filter or other related equipment. In such cases, repairs will result in charges to the resident, who will bear any and all costs for correction

of any cosmetic or functional discrepancies.

If pool is equipped with a heating system of some kind, please note that this is not guaranteed to sustain any constant temperature due to uncontrollable circumstances of nature including but not limited to weather, fungus or algae caused by varying temperatures, or excessive use or contamination of the water by residents or guests and the owners or management are not responsible for compensation of lost use.

Resident agrees to be responsible for the security of the pool/tub/spa and the safety of their guests. Access to the pool/tub/spa is under the control of the resident and access shall be limited through the use of locks, covers, and other appropriate/necessary means as required by local jurisdictions whennot inuse. All access to pool/tub/spa area shall be secured when resident intends to be away for more than 24 hours.

Resident agrees to properly store, maintain and protect any pool cover or other equipment provided, and agrees to be responsible for upkeep and return in the same condition at end of the rental term.

The landlord/management (or a representative) reserves the right to have access to the property (with proper notice) to monitor the condition and upkeep of the pool/tub/spa.
