The Owner reserves the right to remove any or all Separate Prices from the Scope of Work and to adjust the Contract Price accordingly.

The information called for in “Instruction to Bidders” is provided in the attached page 4 and forms an integral part of this Tender.
Declarations
I/we hereby declare that:
1. BID BOND AND AGREEMENT TO BOND ENCLOSED
Bid Bond in the sum of 10% of the Stipulated Sum amount and notice of intent to Bond issuedby the same Guaranty Company is enclosed and shall be in the name of the Owner: Mississippi Valley Textile Museum.
2. EXECUTE CONTRACT
.1The undersigned agrees that their Bid is valid and subject to acceptance by the Owner for a period of thirty (30) days from the date set for the receipt of Bids and that if notified of award of Contract they will:
.1Execute a Contract with the Owner in accordance with the terms and conditions noted in the Bid Documents.
.2Furnish to the Owner, within fifteen (15) days of the date of notification of award of Contract, a detailed schedule of work.
.3Schedule of values shall be jointly agreed with the Owner for billing purposes before the first progress claim.
.2The undersigned being a company duly incorporated under the laws of Canada do hereby declare as follows.
.1That the Shareholders or Partners of the Company submitting this Bid are the only persons interested in this Bid, and no other person has any interest in this Bid.
.2That the Bid is made without any connection, knowledge, comparison of figures or arrangements with any other person or persons or firms making a Bid for the same Work and is in all respects fair and without collusion or fraud.
3. COMPLETION DATE
.1If notified of the acceptance of this Bid, the undersigned will sign, seal and deliver the Contract Documents as specified, and will proceed with construction of the Work within one week of receiving instructions to commence work and will substantially complete all work as certified by the Consultant by June 20, 2014.
.2Time is agreed and acknowledged to be of the essence of the Contract.
4. COST OF BONDS
.1 The cost of 50% Performance and 50% Labour and Materials Bonds are included in the stipulated sum quoted.

.4We submit herewith a list of the Subcontractors we propose to use on this Contract, together with the Sections of the work to be done by each of them, reserving to us, however, the right to substitute other Subcontractors for any of them in the event of any Subcontractor withdrawing his Bid or becoming bankrupt after the date hereof or proving to be unsatisfactory to us. Any such substitution shall be subject to your approval and contingent upon evidence of withdrawal or bankruptcy or unsatisfactory performance.
