I, ______, with identity number ______in my capacity as (designation) ______of (full legal name of company) ______being duly authorised to act on behalf of and bind the abovementioned company (hereinafter referred to as “the Company”) hereby agree as follows:-
LIABILITY
1.1 Sun International (South Africa) Limited trading as Sun City Resort (hereinafter referred to as “Sun City”) shall not be liable for any damages arising out of the death of or injury to an employee of the Company or any of its agents, representatives or sub-contractors whilst such person is at Sun City Resort or whilst using any equipment owned or operated by Sun City or any of its subsidiaries or affiliates. In addition, Sun City shall not be liable for any damage to or loss of any property belonging to any of the aforesaid persons.
1.2 The Company hereby indemnifies Sun City against any claim or liability contemplated in clause 1.1 above.
INDEMNITY
2.1 The Company shall be liable to Sun City for losses or damages (from whatsoever cause arising and whether delictual or other) which Sun City suffers as a direct result of the negligence, wilful act or wilful omission to act on the part of the Company and/or any of its Employees whilst they are acting in the course and scope of their employment.
2.2 Without derogating from the generality of the aforegoing, the Company hereby indemnifies Sun City and its directors, owners, employees, agents and contractors against losses, damages and expenses suffered by it in the circumstances set out in clause 2.1 above
