1)At what point am I entitled to obtain vacation time based on the wage agreement?

You are eligible to receive vacation time after a full month of employment (not necessarily acalendar month).Those who have worked only four weeks or less are not eligible to contractual vacation. The month of Februaryis an exception, unless we are having a leap year.

2)What is the difference between contractual vacation and the statutory vacation that is granted to a temporary employee?

3)Do I have to take the full vacation time allowed?

No, you don’t have to. You may receive part of your entire vacation time cashed out, as long as your employer does not insist that you take your vacation time. Also, you may insist yourself that your vacation is granted.

4)How much would I be paid, if I decided to have my vacation time cashed out?

For each day of vacation that you don’t take, you will receive a vacation pay of ca. 106 Euro. Hence, you will be cashed out 318 Euro for three days and 212 Euro for two days.

5)What is the difference between vacation pay and a vacation allowance?

Vacation pay is the payment you receive during your vacation time (see above). Meaning, you still get paid your regular pay, even though you are on vacation. A vacation allowance is an extra payment that you receive in addition to your regular pay. According to IG Metall wage agreements at Daimler your allowance is 50% of your vacation pay for each day of vacation. Thus, you receive 159 Euro (extra) vacation allowance for three days of vacation. For five days of vacation you will receive 265 Euro.

6)Who pays for my vacation allowance?

Like your vacation pay, your vacation allowance is paid by your employer, not by IG Metall. However, through your membership in IG Metall you are entitled to this payment. Wage agreements only apply to the members of the respective union. This means that only members have an (enforceable) right to the deals that are stipulated within a wage agreement.

7)When will my vacation allowance be paid out?

The compensation for the vacation you are entitled to take as well as the payment of your extra vacation allowance can only be settled after termination of your employment contract. Example: if you worked from June 1st to June 30th 2015, you will receive in July 2015 your first paycheckfrom Daimler. However, this paycheckwill only show your regular pay. Only in August 2015 will you receive another paycheck from Daimler where your vacation days and your extra vacation allowance are check paid. Daimler is not in the position to pay your vacation days out earlier, as the payroll accounting starts to prepare your paycheck in the middle of the month, and since in this very moment you are still working for Daimler, you could theoretically still take days off. This is why Daimler waits until your employment contract is terminated before transferring your vacation allowance and vacation pay.

8)Will I receive a vacation allowance as a temporary employee, even if I am not a member of IGMetall?

No, you won‘t. By law you are not entitled to receive an (extra) vacation allowance, no matter how long your contract is going to be.

9)At what point am I entitled to receive paid sick leave?

In case of sickness IG Metall members are entitled to paid sick leave starting from their first day of work. Statutorily you only obtain an entitlement to paid sick leave after four weeks; that is, after the 29th day of work. This means employees who are not members of IGMetall do not get paid sick leave in the first four weeks of employment, regardless of whether they hold a medical certificate or not.

10) Who can I consult if I don’t receive a vacation allowance?

First, you should ask your employer. The easiest way to do it is by writing an e-mail . If you send an e-mail, make sure you keep it for the purpose of proof. Or, you can search among your papers for the right contact person and then get in touch with your employer. If you encounter any problems while transmitting your membership information, please contact us

11) Until when can I make a claim for payment not received?

You must make a written claim within 3 months after receiving the paycheck from which payment is missing. This is in accordance with § 16 of the framework agreement on employment conditions.Please note that you have to sign your written claim. Make a copy of your claim and ask for a receipt when you drop off the original at the human resources department of your employer. You can also send your claim via ordinary mail or send a fax. If you send it via fax, you should print the transmission report. However, if you send your claim by e-mail, it will not be considered!!!If you don’t make your claim in time, according to the prevailing rules, you will lose your entitlement. If you don’t know how to make a proper claim and wish to obtain a sample letter, please e-mail .

12) Ihave been working for 9 weeks and only received three days of vacation – why?

To obtain 5 days of vacation as a temporary employee you need to work at least two full months at Daimler. You are only eligible to 5 days of vacation if you are a member of IG Metall; otherwise you are allowed to take only 3 days off.

13) What if I am already a member of IG Metall?

Even if you are already a member of IG Metall, you have to fill out the membership form again. Otherwise you will not be eligible to receive the extra payments! This is because IG Metallhas a duty to frequently report our members to the human resources department. If you are already a member, please make a note on the back of the form.

14) Do I have to fill out the membership form even if I have previously worked for Daimler as a temporary employee and am still a member of IG Metall?

Yes, because Daimler has to create a new file for each vacation job. If you are already a member you can contact us and we will make sure that the human resources department knows about you.

15) What if I am a member of a different DGB union?

There are two options:

1. Change union: fill out the membership form and indicate on the back which DGB union you are already hold a membership in. By doing so you will become a member of IG Metall. If you want to go back to your previous union after your vacation job is over, you need to reapply for membership by yourself.

2. Get a double membership: Simply fill out the IG Metall membership form. However, you will have to pay contributions forIG Metall and the other union.

16) When will my contribution for IG Metall be deducted for the first time?

Your first contribution will be deducted from your account at the beginning of the next month. From that time your contributions will be deducted on a monthly basis.

17) How much is the membership fee for temporary employees?

Temporary employees pay 1% of their income after taxes. In your case that would be 23 Euro per month. After your vacation job is over, you will have to pay only the student fee, which is 2,05 Euro per month. If you work less than a month at Daimler your contribution will remain 2,05 Euro.

18) When must I give notice if I intend to cancel my membership?

If you intend to cancel your membership, be aware that the notice period is six weeks at the end of each quarter. This means that your notice has to reach us 6 weeks before the end of the quarterin order to end your membership. The notice of termination has to be in written form and signed by hand.

19) What if a temporary employee works twice in one year for Daimler?

It has no effect on the basis of calculation. Both vacation jobs will be handledindependently from each other. Example: if you work twice for two weeks, you still not be eligible to receive vacation days.

20) What do I have to do if I get sick?

First, you must contact your employer on the first day of your sick leave and tell him/her approximately how long you will have to stay at home. You can call him/her or send an e-mail (make sure you receive a read receipt). It is important that your co-workers are informed too. You only have to submit a medical certificate if you are sick for more than three days. However, it is still recommended that you see a doctor and ask for a medical certificate. You can scan the certificate and send it by e-mail to your employer (make sure you receive a read receipt).But you can also bring the medical certificate in person or submit it by ordinary mail to the human resources department. Please note that the medical certificate has to be at your employer’s on the fourth day of your sick leave at the latest.Later, you should check your paycheck to see if you received less money due to your absence. If this is the case, you should inform your employer (see above). As a member of the IG Metall you are eligible to receive sick leave starting from the first day of your employment.
