London Councils and POPLA
You may be aware that London Councils is in the process of asking your Council to approve a delegated authority to retrospectively agree to the provision of the Parking on Private Land Appeals service (POPLA) which is provided under contract to the BPA.
We understand that there is a campaign by a small number of individuals to persuade Councils to not agree the aforementioned minute and we are writing to you in order to help you respond to your Council members should you be asked following any communication you may receive on this subject.
The campaign also refers to the BPA not being able to meet its financial obligations to London Councils which of course is not true and I would draw your attention to our Annual Report which details our latest accounts, showing that the BPA is in a very healthy financial position and very much able to meet all financial obligations.
Whilst it is of course true that a reduction in BPA members could mean less parking operators would use the service in the future resulting in a fall in the number of appeals, costs would fall in turn, meaning no significant financial impact on the service or the BPA.
The background and history of POPLA, which you may not be aware of, is set out below:
• The BPA established POPLA in October 2012 alongside the Protection of Freedoms Act
• London Councils bid for and contracted with the BPA to deliver POPLA
• Under an agreement with the government, POPLA is to be fully funded by the private parking sector (ie those organisations who are members of the BPA’s Approved Operator Scheme) with no costs to local authorities in London
• POPLA provide a simple, free appeals service to motorists for parking tickets issued on private land
• POPLA is judicially independent when it comes to deciding the outcome of an appeal if a motorist wishes to contest an unfair Parking Charge Notice issued on private land (just like PATAS)
• The BPA is currently in the process of re-procuring the service as the current contract expires on1st October 2015
We would like to provide reassurance that there is no cause for concern and the relationship between the BPA, London Councils and POPLA and specifically, the legality of the contract is not in dispute.

Consultation on the future of the Approved Operator Scheme (AOS)
Since its inception in 2007, the BPA has managed the AOS on behalf of BPA members who manage parking on private land. In that time we have established a Code of Practice and a set of standards which are well understood by operators, consumer organisations and the government. We have also established POPLA which has seen the sector take its biggest ever step forwards in reputational terms - where it counts, the private parking industry is now viewed more positively than ever.
However, the BPA Board has been considering the future of the AOS and has asked me to consult you on a proposal to separate the AOS from the BPA with the AOS being owned by a body independent of the BPA. This will free up the BPA to act as the standard setting body for the private parking sector, allowing the AOS to be a body responsible for auditing and sanctioning private parking operators and to operate independently.
The BPA is the professional Association for the parking sector, with its primary aim being to drive standards higher across the sector. This proposal would allow us to focus on our core activity of supporting members and promoting professionalism in all sectors involved in traffic and parking management. Without its direct involvement with the AOS, the BPA can act more independently maintaining the Code of Practice on behalf of the DVLA and the sector while also supporting the DVLA from a technical perspective. The Board’s vision is to establish a consistent standard across the sector by maintaining a single Code of Practice which applies to all. We believe that one way of achieving this is to separate the AOS from the BPA.
Furthermore this proposal would free up the BPA to ensure that there is a level playing field for consumers, ensuring that standards are achieved consistently across all ATAs. There can be no doubt that the proposal is very much in tune with the BPA’s strategy to place the consumer at the heart of its thinking, and to make parking a recognised profession.
This is a significant proposal for the BPA, its members and its staff and the decision should not be taken lightly. The purpose of this letter is to seek your views. We will also be consulting with consumer organisations and other stakeholders. Due to the significance of this proposal we will ensure there is a full debate on it at the next Council of Representatives meeting on 4 December. Additionally, the topic will be on the Agendas of all Service Boards, Special Interest Groups and Regional Meetings during the next quarter so there will be plenty of opportunity for debate and comment. Following the consultation the BPA Board will decide on the best course of action at its meeting on 19th February 2015. At this stage we anticipate implementing any changes by October 2015.

The private parking landscape significantly improved for motorists who had received a PCN and felt that it had been issued inappropriately issued on 1st October 2012 when the BPA launched POPLA (Parking on Private Land Appeals) in England and Wales – a service that gave the motorist the chance to have their case independently heard by suitably qualified assessors after having their initial representations to the parking operator rejected. POPLA is free to the motorist, fully funded by the private parking sector and its decisions are binding on the operator but not on the motorist. Since the arrival of POPLA over 35,000 motorists have had their appeal independently assessed and at no cost to them.

POPLA annual report 2014

The BPA welcomes the publication of the new POPLA annual report, which can be found on their website here.
The BPA established the Parking on Private Land Appeals service in October 2012whenthe Protection of Freedoms Act came into force, providing motorists in England and Waleswith access to a free alternative dispute resolution service. Now overseen by an Independent Scrutiny Board (ISB), we recognise that POPLA should be more widely available, and the BPA continues to lobby for its introduction across the UK.

New Parking Appeals Service will Give Extra Protection to Motorists

In a major shake up of the private parking industry, the BPA has appointed London Councils to deliver a new, Independent Appeals Service (IAS) for motorists parking on private land.
The agreement, which has been reached following years of campaigning by the parking industry and months of planning, will provide an appeals service similar to that which is currently available to motorists who receive parking tickets on public land.

Protection of Freedoms Act and clamping ban FAQs

The Protection of Freedoms Act contains provision to ban vehicle clamping and removals on private land without lawful authority.
The BPA has prepared a number of Frequently Asked Questions (FAQs) on the website relating to the Act and the provision of Keeper Liability and launch of an Independent Appeals Services (IAS) to advise both the public and parking operators of the impending changes.

BPA Northern Ireland and IPA Event
Dear colleague
The next event for parking professionals across Ireland will take place on: -
Date: 30th May
Venue:Park Avenue Hotel, Belfast.
This is the second event in Northern Ireland since the collaboration between the British Parking Association Northern Ireland group and the Irish Parking Association was formed and is a must attend for anyone involved in parking from north or south. The final agenda is in preparation but we can confirm some of the outline topics will be as follows:
  • Parking on private land; reviewing the changes brought about by the Protection of Freedoms Act in England and Wales including introduction of the independent appeals service, discussing the legal position for enforcement on private land, review of consultation in Northern Ireland and regulation of clamping in the Republic of Ireland
  • Parking charters; taking a look at the two existing charters for healthcare and higher education parking and discussing opportunities for further charters in other sectors such as retail and airports, we will also discuss quality standards on a broader level
  • Break out group discussion; this session will enable all meeting attendees to participate and share their views on parking policy in Northern Ireland and the Republic of Ireland
  • BPA Master plan for parking; attendees will have opportunity to input into the 2013/14 plan
  • Technology updates and power pitches; we will highlight some of the latest technology in parking involving use of apps and intelligent data usage for customer profiling, we will also feature a number of power pitches where commercial representatives will give the audience a whistle stop tour of parking products and services, each speaker will be up against the clock to deliver their pitch in five minutes
In addition to this there will be ample opportunity for networking and there will be a number of exhibition stands showcasing parking products and services.
This event is free to attend and non-members are warmly invited to join us to find out more about the work of the association and the collaboration between the BPA and the IPA.
