Rental Agreement/Lease
STUCKEY PROPERTIES LLC, LESSORS, IN CONSIDERATION OF THE AGREEMENTS OF LESSEES______SET FORTH BELOW, HEREBY LEASE TO LESSEES APARTMENT______AT 1238/1240 EDGEWOOD DRIVE FOR THE MONTH COMMENCING ON THE______DAY OF______AND MONTHLY THEREAFTER UNTIL THIS CONTRACT IS TERMINATED AS HEREINAFTER PROVIDED FOR:
1. TO PAY AS RENTAL FOR SAID APARTMENT THE SUM OF______PER MONTH, PAYABLE IN ADVANCE COMMENCING WITH THE DATE MENTIONED.
2. ALL RENTAL PAYMENTS MUST BE RECEIVED ON OR BEFORE THE FIRST DAY OF EACH MONTH. A $25.00 CHARGE WILL BE ASSESSED IF RENT IS NOT RECEIVED BY THE 3RD DAY OF EACH MONTH, A $50.00 CHARGE IF RECEIVED AFTER THE 10TH OF THE MONTH, $75.00 IF RECEIVED AFTER THE 15TH OF THE MONTH, AND POSSIBLE EVICTION ACTION AFTER THE 20TH OF THE MONTH.
3. A DEPOSIT OF______SHALL BE PAID BEFORE OCCUPANY. DEPOSIT WILL BE FORFEITED IF LESSEE FAILS TO ADVISE LESSOR OF VACATING THIRTY (30) DAYS IN ADVANCE, WITH NOTICE BEING GIVEN IN WRITING ON OR BEFORE THE FIRST DAY OF THE MONTH PRIOR TO THE MONTH VACATING THE APARTMENT. LESSEE MUST STAY A MINIMUM OF TWELVE MONTHS OR THE DEPOSIT SHALL BE FORFEITED.
4. THE LESSOR SHALL INSPECT THE PREMISES UPON BEING VACATED BY THE LESSEES. THE NECESSITY OF CLEANING OR REPAIRS SHALL BE DEDUCTED FROM SAID DEPOSIT DESCRIBED IN (#3) ABOVE. IT IS UNDERSTOOD THAT THERE WILL BE A NORMAL AMOUNT OF WEAR AND TEAR FROM TENANT OCCUPANCY.
5. LESSOR SHALL RETURN TO THE LESSEES THE DEPOSIT, PLUS INTEREST, LESS ANY AMOUNTS DEDUCTED FOR CLEANING, DAMAGES, OR LEASE VIOLATIONS WITHIN TWENTY-ONE DAYS OF VACANCY.
6. THE LESSEE WILL PAY A $100 TURNOVER FEE WHICH IS DUE WHEN THE LEASE IS TERMINATED. IF THIS FEE IS NOT RECEIVED, IT WILL BE DEDUCTED FROM THE DEPOSIT.
7. THE LESSORS FURNISH HEAT AND WATER. THE LESSEES PAY FOR THEIR OWN ELECTRICITY, GARBAGE, CABLE, AND TELEPHONE.
8. LESSOR SHALL HAVE THE PREMISES IN CLEAN AND TENANTABLE CONDITION BEFORE LESSEE OCCUPIES THE LIVING QUARTERS. ANY UNCLEANLINESS SHALL BE CORRECTED AND DAMAGES REPAIRED OR NOTED.
9. TO USE SAID APARTMENT AS LIVING QUARTERS FOR THE RESIDENCE OF SAID NAMED LESSEES ONLY, BEING______ADULTS AND ______CHILDREN.
10. LESSEES SHALL NOT ASSIGN OR SUB-LET OR RE-RENT THE PREMISES UNLESS MUTUALLY UPON BY THE OWNER AND THE TENANT.
11. LESSOR MAY ENTER SAID APARTMENT TO INSPECT, REPAIR, AND MAINTAIN SAME, OR TO SHOW THE PROPERTY TO ANY PROSPECTIVE BUYER OR LOAN OR INSURANCE AGENT, AND IN CASE EITHER PARTY HAS GIVEN NOTICE OF TERMINATION OF THE TENANCY, TO SHOW THE PREMISES TO ANY PROSPECTIVE TENANT.
12. IT IS THE RESPONSIBILITY OF LESSEE TO PROVIDE INSURANCE COVERAGE FOR HIS
OWN PERSONAL PROPERTY, IF DESIRED.
13. NO RIGHT OF STORAGE IS GIVEN BY THIS LEASE. THE LESSOR SHALL NOT BE LIABLE FOR NON DELIVERY OF MESSAGES OR FOR ANY LOSS OF PROPERTY BY FIRES, THEFT, BURGLARY, OR OTHERWISE FROM SAID PREMISES OR BUILDING, NOR FOR ANY ACCIDENTAL DAMAGE TO PERSON OR PROPERTY IN OR ABOUT THE LEASED PREMISES OR APARTMENT BUILDING RESULTING FROM LESSOR’S EMPLOYEES OR ANY OTHER CAUSE WHATSOEVER, AND THE LOSS OF DAMAGE.
14. CHILDREN WILL NOT BE PERMITTED TO RUN OR PLAY IN HALLS LAUNDRY AREAS, FURNACE AREAS, ENTRANCES, STAIRWAYS, SIDEWALKS, OR STEPS.
15. LESSEE SHALL NOT KEEP IN OR ABOUT SAID PREMISES ANY LIVE ANIMALS OR REPTILES. THIS MEANS NO PETS, INCLUDING PETS OF VISITORS. VIOLATIONS WILL RESULT IN LOSS OF DEPOSIT AND POSSIBLE EVICTION ACTION.
16. LESSEE AND LESSOR SHALL OBEY ALL LAWFUL ORDERS, RULES AND REGULATIONS OF ALL GOVERNMENTAL AUTHORITIES.
17. LESSEE SHALL NOT ALTER OR REDECORATE SAID PREMISES WITHOUT PRIOR CONSENT OF LESSOR. ALL ALTERATIONS TO SAID PREMISES SHALL REMAIN FOR THE BENEFIT OF LESSOR.
18. LESSEE SHALL KEEP SAID PREMISES IN A CLEAN AND TENANTABLE CONDITION.
19. IF LESSEE SHALL LEAVE ANY PROPERTY ON SAID PREMISES, LESSOR SHALL HAVE THE RIGHT TO DISPOSE OF SAID PROPERTY WITHOUT LIABILITY THIRTY (30) DAYS AFTER VACANCY.
20. LESSEES SHALL USE REASONABLE JUDGEMENT IN PARKING HIS OR HER AUTOMOBILES SO AS NOT TO INTERFERE WITH PARKING BY OTHER TENANTS AND ALLOWING PARKING AREAS TO BE PROPERLY CLEARED OF SNOW. CAMPERS, BUSES, BOATS, SNOWMOBILES, OR OTHER VEHICLES SHALL NOT BE PARKED IN OR STORED ON PREMISES WITHOUT WRITTEN PERMISSION OF LESSOR. VEHICLES NOT IN USE ARE NOT ALLOWED TO REMAIN ON THE PREMISES. YOUR GARAGE IS CONSIDERED TO BE YOUR PRIMARY PARKING SPACE. STUCKEY PROPERTIES IS NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR VEHICLES OR PERSONAL PROPERTY IN THE GARAGE CAUSED BY RODENTS OR ANY OTHER ANIMALS.
21. AT NO TIME ARE TENANTS ALLOWED TO DRIVE OR PARK VEHICLES ON THE LAWN. WHEN MOVING IN OR VACATING, THE VEHICLES USED MUST BE PARKED IN THE PARKING AREAS, OR IN THE GARAGES.
22. LESSEE AGREES TO PAY ALL REASONABLE COSTS, ATTORNEY’S FEES, AND EXPENSES THAT SHALL BE PAID OR INCURRED BY LESSOR IN ENFORCING THIS LEASE.
23. THE TERMS “LESSOR AND LESSEE” WHEN USED HEREIN SHALL BE TAKEN TO MEAN EITHER SINGULAR OR PLURAL, MASCULINE OR FEMININE, AS THE CASE MAY BE, AND THE PROVISION OF THE INSTRUMENT SHALL BIND THE PARTIES AND THEIR HEIRS, PERSONAL REPRESENTATIVES, SUCCESSORS, AND ASSIGNS.
24. NO SMOKING IS ALLOWED INSIDE THE BUILDING UNDER ANY CIRCUMSTANCES. DOING SO WILL RESULT IN THE LOSS OF SECURITY DEPOSIT AND POSSIBLE EVICTION ACTION.
25. NEITHER THE APARTMENT NOR THE GARAGE SHALL BE USED FOR BUSINESS VENTURES THAT WOULD CAUSE PUBLIC TRAFFIC.
26. ANY NSF CHECK WILL INCURR A $40.00 FEE AND FROM THAT POINT FORWARD STUCKEY PROPERTIES WILL NO LONGER ACCEPT PERSONAL CHECKS FROM LESSEE. PAYMENT MUST BE MADE WITH MONEY ORDER, CASHIERS CHECK, OR CASH.
27. THIS UNIT IS EQUIPPED WITH A TAMPER-PROOF THERMOSTAT (SUNSET APARTMENTS EXCLUDED) AND A WATER SAVING SHOWERHEAD. TAMPERING WITH OR REMOVING EITHER OR BOTH OF THESE WILL RESULT IN A LOSS OF DEPOSIT.
28. MINN. STATUTE § 504B.181, SUBD. 2(b) REQUIRES LANDLORDS TO NOTIFY RESIDENTIAL TENANTS THAT A TENANT/LANDLORD HANDBOOK IS AVAILABLE TO THEM.
