1. Scope of warranty
1.1. This Statement of Warranty certifies that the pipes and fittings made by PipelifeAustriaare manufactured from high-quality raw materials and the manufacturing process complies with all the requirements of applicable standards. Subject to properly performed installation works, their trouble-free function throughout the warranty periodis guaranteed.
2. Warranty terms and conditions
2.1. The products covered bytheseWarranty terms and conditions are integral parts of the supplied completeMaster 3 System (the “System”).
2.2. The warranty shall cover only such damage claims that occur not later than 10 years after the System delivery.
2.3. The warranty shall not apply to pipes and fittings that were not manufactured by PIPELIFEor if another product, which was not supplied by PIPELIFEor is not part of the System (Master 3), was added or integrated into the System as it was supplied initially,
2.4. The warranty shall be granted and shall be enforceable onlysubject to the compliance with following conditions:
а) the products and all components should be properly stored, installed, operated and maintained in normal conditions and in accordance with PIPELIFE’s instructions;
b) only combinations of products (pipes, fittings, accessories) that fall within the scope of Pipelife’s warranty for the System should be used;
c) product components should not have been used or operated under overload or handled improperly.
2.5. PIPELIFE’s warranty shall not be enforceable unless there is sufficient evidence that design, installation and operation manual instructions have beencomplied with.
2.6. The System should be installed by a licensed and competent technicianin accordance with the requirements of БДС EN 12056.
Damages caused by external factors (such as holes drilled into the pipeline by an act of negligence, damages due to freezing, etc.) and damages resulting from improper or wrongful installation, shall not be covered by this Warranty.
2.7. Upon submission of a damage claim, PIPELIFE must be notifiedimmediately and given the opportunity to inspect the damage within an additionally agreed period in writing after the damage occurred but before any remedial measures were taken. Non-compliance with this condition shall result in the loss of warranty coverage to the extent that, according to these Warranty terms, it is greater than the statutory warranty.
2.8. All measures to be taken by PIPELIFE with the purpose to mitigate the damages shall not constitute and shall not be deemed an act of acceptance of any liability under the warranty. Under no circumstances any possible negotiations for damage recovery may be regarded as waiver of the right to claim that the obligation to givenotificationaboutthe occurrence of damageas stipulated inclause 2.7. of theseWarranty terms and conditions was not complied with promptly or that it was groundless or otherwise regarded as insufficient.
3. Exceptions
The warranty exclude and Pipelife shall not provide any warranty service for the following:
а) consumables or items, which require repair or replacement due to normal wear and tear.
b) consumables or items, which require repair or replacement due to negligence (not a negligence on the part of PIPELIFE though), accident, abuse, vandalism, damages of the Products caused during transportation, or damages resulting from improper installation (deficient maintenance, unusual operating conditions or temperature, pollution, or another reason not attributable to PIPELIFE).
c) cases wherethe repair or modifications were performed or commenced by the Buyer or by a third party without PIPELIFE’s prior consent thereto.
4. Scope and settlement of damage claims
4.1. PIPELIFE’s liability shall cover the free replacement of damaged Products. This includes also the repair works needed for their recovery to the same condition they were prior to the damage.
4.2. PIPELIFE’s liability under clause 4.1. shall amount to maximum EUR 500000 per damage claim and maximumEUR 1000000 for all damage claims per year.
4.3. For the raising of awarranty claim, the party claiming warranty coverage shall be required to submit aproperly completed warranty certificate.
4.4. PIPELIFE reserves the right to employ the services of qualified firms of its choice for the performance of necessaryrepair works.
4.5. All warranty claims that may be raised in the course of the warranty term cannot exceed the total period of warranty coverage.
4.6. Any additionalverbal understandings or undertakings are hereby precluded.
5. Limitation of liability
To the extent permitted by the law, PIPELIFE shall not be held liable by the Buyer or by any user of the Products forspecial, accidental or resulting damages, either personal or property, for opportunity cost or for any other indirect damages (closure of production lines, property depreciation, etc.). PIPELIFE’s liability for damages under this warranty cannot exceed the cost of repairing the defects of sold Products or the cost of replacing them with non-defective ones in accordance withclause 4.1. of these Warranty terms and conditions.
THIS WARRANTY EXCLUSIVELY SUPERSEDES ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED.
6. No deductions
No deductions can be made from the amounts owed by the Buyer or by any user of the Products to PIPELIFE. All due sums must be paid to their full amount, andPIPELIFE may decide to credit the Buyer separately.
7. Applicable law. Jurisdiction.
This warranty shall be governed by Bulgarian law.

We confirm that PIPELIFE pipes and fittings in the above-described building site were installed and commissioned in compliance with PIPELIFE’s instructions on the design, installation, supervision and operation of said pipes and fittings. The installation was tested under pressure,which is certified by a writtenreport* integrated herein.
PIPELIFE givesthe above warranty with regard toclaims raised by the Contractor against PIPELIFE. The warranty shall be valid only when completed and signed, then returned to PIPELIFE for counter signaturewith the relevant pressure test report enclosed.
As confirmation by PIPELIFE, this Statement of Warranty should be signed by a PIPELIFE representative and returned to PIPELIFE within six months as of the System date of delivery.
