REQUIREMENTS OF CUSTOMER

  1. Subject of the procurement – services of expert, who provides statements on specific issues regarding construction objects financed by Latvia-Lithuania Cross Border Cooperation Programme under European Territorial Cooperation Objective 2007-2013 to evaluate the compliance of construction works of the projects with the legal acts of the Republic of Lithuania.
  2. Venue and deadline for submission of application.

2.1. Deadline for submission of application – until 22 March 2010 at 12:00.

4.Preparation of application.

4.1. The applications for the public procurement shall be submitted in closed envelope, which could be delivered personally or by registered mail with the identification: subject of the procurement – services of expert, who provides statements on specific issues regarding construction objects financed by Latvia-Lithuania Cross Border Cooperation Programme under European Territorial Cooperation Objective 2007-2013 to evaluate the compliance of construction works of the projects with the legal acts of the Republic of Lithuania.

4.2. Application shall be prepared by filling in the Applicant’s Formaccordingly (Annex 2).

4.4. Applicant is not allowed to change the application after the deadline for the submission of application.

  1. Applicant – natural or legal person or association of such persons, in any their combination, all submit the following documents and comply with the following requirements:
  2. copy of the registration certificate, if application submits legal person;
  3. CV of external experts, if application submits legal person, or CV for expert, if application submits natural person;
  4. copies of education documents for the expert(s);
  5. copy of registration certificate of construction merchant and copies of certificates for supervision the construction works of external experts, if application submits legal person or copy of certificate for supervision the construction works of expert, if application submits natural person;if applicant is a legal person and its experts or natural person as expert is registered in other country then applicant submits the copies of documents mentioned in this point, which are registered in the institution authorised to register the construction praxis or legal person authorised for carrying out such kind of functions;

  7. Requirements for expert:
  8. higher academic or second level professional higher education in construction, engineering sciences or architecture;
  9. valid certificate of building praxis in the field of supervision of construction works;
  10. at least 2 (two) years experience in planning of construction works, performance or supervision in the field of public infrastructure;
  11. at least 2 (two) years experience in supervision and assessment of construction works financed by EU Structural Funds or Cross Border Cooperation Programmes;
  12. good knowledge about legal acts of the Republic of Lithuania and their requirements in the field of construction;
  13. good knowledge of English;
  14. to avoid the conflict of interests and to provide the objectivity in the assessment process, the experts cannot be involved in the elaboration or coordination of project to be assessed, as well as cannot take part in preparation of project. Expert signs the Declaration of Confidentiality and Impartiality;

5.7. authorisation, if application is signed by authorised person.

6. Price and currency:

6.1. In Applicant’s Form the priceshall be indicated:

6.1.1. for caring out the expertise and elaboration of statement for one construction object according to the work task in the stage of the assessment of project. The price includes all costs related to performance of expertise and elaboration of statement for one construction object; / LVL (excluding VAT)
6.1.2. for caring out the expertise and elaboration of statement for one construction object according to the work task in the stage of the monitoring of project. The price includes all costs related to performance of expertise and elaboration of statement for one construction object (including transport and accommodation costs in the venue of construction object) / LVL (excluding VAT)
TOTAL / LVL (excluding VAT)

6.2. The total price constitutes from the sum of prices indicated in sections 6.1.1. un 6.1.2..

6.3. Prices shall be indicated in Latvian lats.

  1. Expiry of the application.

The application shall be valid at least 40 days from the deadline of submission the application.

  1. Providing of information.

All questions regarding the subject of procurement and procedure for submission of application shall be addressed to the contact person indicated in the section 3.2.until the deadline for the submission of applications.

  1. The assessment of application and decision taking.

9.1. Applications, which will be submitted after the deadline determined in point 2 of this document, will not be assessed.

9.2. Procurement commission:

9.2.1. will check the compatibility of application to the requirements indicated in the point 5 for each part of the subject of procurement. Only those applications which comply with all requirements for each part of the subject of the procurement will be considered as valid;

9.2.2. applications which do not comply with the requirements, will not be assessed;

9.2.3. from the applications complying with all requirements, the applications with lower total sum (excluding VAT) for each part of the subject of the procurementwill be chosen.

9.3. The customer informs all applicants on decision of commission within the 3 working days after the date when decision is made.

Terms of Reference

Services of expert, who provides statements on specific issues regarding construction objects financed by Latvia-Lithuania Cross Border Cooperation Programme under European Territorial Cooperation Objective 2007-2013 to evaluate the compliance of construction works of the projects with the legal acts of the Republic of Lithuania.

1.General information

1.1.Latvia-Lithuania Cross Border Cooperation Programme 2007-2013 (hereafter referred to as the “Programme”) is implemented under the European Territorial Cooperation Objective. The Programme aims at contributing to sustainable and cohesive socio-economic development of the border region in order to make it competitive for economic and business development and attractive for people living and visiting. Programme territory consists from regions of Kurzeme, Zemgale, Latgale in Latvia and regions of Klaipeda, Telsiai, Siauliai, Panevezys, Utena and Kaunas in Lithuania.

1.2.Specific objectives of the Programme are:

1.2.1.To strengthen border area economic and social base and to increase competitiveness by establishing currently missing primary structures and capacities for development at regional level;

1.2.2.To create favourable living conditions and to strengthen border region communities by improving quality and access of public services/supplies, effective management of environmental resources and raising the human capacity for further development.

1.3.Programme consists of two priorities, each of these covering several directions of support.

1.4.First priority – encouragement of socio economic development and competitiveness of the region.

1.4.1.First direction of support: facilitating business, labour market, research and technology development;

1.4.2.Second direction of support: improvement of internal and external accessibility of the border region;

1.4.3.Second Priority – attractive living environment and development of sustainable communities

1.4.4.First direction of support: enhancing joint management of public services and natural resources;

1.4.5.Second direction of support: increasing attractiveness of the border region;

1.4.6.Third direction of support: development of active and sustainable communities (small project facility)

1.5.The Programme‘s Joint Technical Secretariat is hosted by the State Regional Development Agency of the Republic of Latvia and is primarily responsible for day-to-day management and monitoring of the Programme. It acts as a contact point for project applicants and implementers. Further information about the Programme and supported activities can be found on the Programme’s website

2.Subject of the procurement

2.1. To evaluate the compliance of construction works of the projects with the legal acts of the Republic of Lithuania.

2.1.1.To carry out the expertise and to elaborate the statement in the stage of the assessment of the project application:

2.1.1.1. regarding the compliance of building designs (technical projects) or volume of construction works, equipment, structures and buildings included in the cost estimations as well as the calculations of costs with the activities planned in the project applications;

2.1.1.2.to inspect ifthe costs included (planned) in the cost estimations of the construction objects are economically justified.

2.1.2.In the stage of the monitoring the implementation of the project:

2.1.2.1.to carry out the expertise and to elaborate the statement regarding compliance of volume of construction works, equipment, structures and buildings and cost estimations provided in the reports of project implementers with approved building designs (technical projects), concluded construction contracts, acceptance and submission acts and requirements of legal acts, technical regulations applying to the construction area, as well as to assess their compliance with activities planned in the project applications and in the requests for changes.

2.1.2.2.to carry out the expertise and to provide the statement on compliance of volume of construction works, equipment, structures and buildings in project implementation venues with volume and quality specified in the reports of project implementers, construction contracts, building designs (technical projects) and acceptance and submission acts, as well as the compliance with requirements of legal acts, technical regulations applying to construction area, as well as to assess their compliance with activities planned in the project applications and in the requests for changes.

2.1.3.The planned venues of construction objects: regions of Klaipeda, Telsiai, Siauliai, Panevezys, Utena and Kaunas in Lithuania – depends on venues of project implementation specified in the project applications.

2.2. The statements signed and stamped shall be submitted to the Joint Technical Secretariat in Latvian or Lithuanian with translation in English.

2.3.For each project given for the expertise the Joint Technical Secretariat elaborates the specific work task, which does not exceed the subject of procurement.

3.Work amount and deadlines

3.1.For carrying out the expertise specified in points 2.1.1.andthe contractor reviews the project application and building design (technical projects) or estimation for construction works in accordance with the building task. The documents mentioned are reviewed in the premises of the Joint Technical secretariat in Ausekļa Street 14, Riga or in special cases the contractorreceivesthe copies of documents. The deadline for carrying out the expertise and elaboration of statement for one object is determined in each work task, but it cannot exceed 10 working days. If activities carried out in the framework of Latvia-Lithuania Cross Border Cooperation Programme 2007 – 2013 foresees to provide the statement for several projects or construction objects at the same time, then deadline for carrying out the expertise and elaboration of statement (in the stage of assessment of the project applications) is determined in the work task, but it cannot exceed 15 working days.

3.2.Carrying out the expertise determined in the points 2.1.2. andthe contractor reviews the project application and building design (technical projects), contraction contract, report of project implementer, the supporting documents of construction works, invoices and acts of submitted construction works in accordance with the building task.The documents mentioned are reviewed in the premises of the Joint Technical secretariat in Ausekļa Street 14, Riga or in special cases the contractorreceives the copies of documents. If according to the work task the visit to the construction object is needed, the contractor visits the venue of project implementation and inspects the volume and quality of construction works carried out, the compliance of used equipments, structures and buildings, as well as reviews the register of construction works, acts of covered works and with other documents related to the construction. The deadline for carrying out the expertise and elaboration of statement is determined in work task for each construction object, but it cannot exceed 10 working days. If activities carried out in the framework of Latvia-Lithuania Cross Border Cooperation Programme 2007 – 2013 foresees to provide the statement for several projects or construction objects at the same time, then deadline for carrying out the expertise and elaboration of statement (in the stage of assessment of the project applications) is determined in the work task, but it cannot exceed 15 working days.

3.3.In the statement the compliance of reviewed documents, construction works, equipment, structures and buildings with criteria specified in the work task shall be provided, as well as the discrepancies and indentions from building design (technical project), construction contract, estimations for calculations of costs, documents for construction works and requirements of legal acts and technical regulations in the field of the construction, as well as from the information provided in the reports of project implementer and project application shall be listed.

3.4. The work task is elaborated by the Joint Technical Secretariat of Programme and is provided to the contract at least 2 days before the commencing of the expertise.

3.5.During the work the expert shall fill in the expert’s evaluation sheet in Lithuanian with translation in English, providing the justified opinion and conclusions on inspected project application.

3.6.Within the activities it is foreseen to approve up to 100 projects.

3.7.The period of the agreement istime from the date of concluding the agreement until 31 December 2013.
