AGREEMENT BETWEEN

St. Michael’s Centre [Bishops Cleeve](TheCentre) of School Road, Bishops Cleeve, Cheltenham GL52 8BA

and

The person or organisation described in the hire booking form (The Hirer)

In consideration of the hire fee the Centre agrees to permit the Hirer to use the premises described above for the purpose shown in the hire booking form.The Agreement includes the terms and conditions of hire set out below.

  1. Licences

The Hirer shall comply with all conditions and regulations made in respect of the premises by the Fire Authority, Local Authority, Licencing Authority or otherwise, particularly in connection with any event which constitutes regulated entertainment or which is attended by children.

  1. Means of escape

All means of exit from the premises must be kept free from obstruction and immediately available for instant free public exit.

  1. Outbreaks of fire

The person responsible for each group hiring the Centre shall inform other group members of potential risks in the event of fire, and ensure that in an emergencythere is an effective and efficient means of evacuating the group from the building. The fire emergency procedure must be communicated to and understood by the group. The fire assembly point is at the back of the car park. The person responsible must notify the Treasurer (01242691639/07711222109) or the Secretary (01242676265) that an emergency procedure is taking place.

The Fire Brigade shall be called to any outbreak of fire and details of the incident provided to the Centre.

  1. Health and hygiene

No smoking is permitted in theCentre.

If the Hirer is preparing, serving or selling food, they must observe all relevant food, health andhygiene regulations.Dairy products, vegetables and meat on the premises must be refrigerated and stored in compliance with the Food Temperature Regulations.

The Hirer must provide tea towels and table cloths.

The Hirer must enter relevant information in the Food Hygiene Diary which is located in the kitchen.

If using the kitchen, the Hirer must complete appropriate entries in the Food Hygiene Register.

No-one under the age of sixteen is permitted to enter the kitchen.

The Hirer is not permitted to use kitchen equipment of an electrical nature other than kettles, refrigerators and microwaves unless agreed with the Centre and with the payment of an additional hire fee and an agreed damage deposit having beenpaid.

  1. End of hire/Waste disposal

If hiring the Centreon a one-off basis,the Hirer must remove waste goods and all refuse from thepremises at the end of the hire period and dispose of these away from the site. Failure to do so may result in the Centre making a charge for such disposal. The Hirer must provide theirown refuse disposal bags.

The Hirer must replace any plastic waste bags which the Centre have provided.

The Hirer shall be responsible for leaving the premises and surrounding area in a clean and tidy condition, properly locked and secured.

Any contents which have been temporarily removed from their usual positions must beproperly replaced. Should this not be the case, the Centre is at liberty to make an additional charge.

All kitchen equipment which has been used must be thoroughly washed. Stainless steel surfaces, ovens and hobs must be cleaned using only diluted washing up liquid. No other cleaning products or abrasive scouring materials must be used.

  1. Electrical Appliance Safety

The Hirer shall ensure that any electrical appliances brought by them to the premises and used there shall be safe, in good working order, and used in a safe manner in accordance with the relevant Electricity at Work Regulations.

  1. Supervision

During the period of the hiring, the Hirer shall be responsible for

  • the supervision of the premises, the fabric and contents
  • the behaviour of all persons using the premises
  • proper supervision of car parking arrangements so as to avoid obstruction of the highway.

The Hall will not be hired to any person under twenty one years of age.

  1. Loss of or damage to the premises

The Hirer shall make good or pay for all damage (including accidental damage) to the premises or to the fixtures, fittings or contents and for loss of contents. The Hirer must not attach pins, nails, screws or adhesive tape to doors, windows, curtains,furnitureor walls.

  1. Use of the premises

The Hirer shall not use the premises for any purpose other than that described in the hire bookingform and shall not sub-hire or use the premises or allow the premises to be used for any unlawful purpose or in any unlawful way, nor do anything or bring onto the premises anything which may endanger people or property.

  1. Gaming, Betting and Lotteries

The Hirer shall ensure that nothing is done on or in relation to the premises in contravention of laws relating to gaming, betting and lotteries.

  1. Indemnity

The Hirer shall indemnify and keep indemnified each member of the Centre’s trustees and the Centre’s employees, volunteers, agents and invitees against (a) the cost of repair of any damage done to any part of the premises including the curtilage or the contents of the premises (b) all claims, losses damages and costs in respect of damage or loss of property or injury to persons arising as a result of the use of the premises (including storage of equipment) by the hirer, and (c) all claims, losses, damages and costs suffered or incurred as a result of any nuisance caused to a third party as a result of the use of the premises by the Hirer.

The Hirer shall take out adequate insurance to insure the Hirer and members of the Hirer’s organisation and invitees against the Hirer’s liability described above, and all claims arising as a result of the hire and on demand shall produce the policy and current receipt or other evidence of cover to the Hall’s authorised representative. Failure to produce such policy and evidence of cover will render the hiring void and enable the Centre to re-hire the premises to another hirer.The Centre is insured against any claims arising out of its own negligence. The Centreshall not be liable for accidental bodily injury or loss or damage arising from the use of bouncy castles or other inflatables or any similar activity equipment.

  1. Accidents and Dangerous Occurrences

The Hirer must report all accidents involving injury to the public to a member of the Centre’s trustees as soon as possible, and enter a record of the incident in the Centre’s Accident Book, which is located in the kitchen. Any failure of equipment belonging to the Centreor brought in by the Hirer must be reported to the Centreas soon as possible.

  1. Explosives and Flammable Substances

The Hirer shall ensure that:

  • Highly flammable substances are not brought into, or used in any part of the premises and that
  • No internal decorations of a combustible nature shall be erected without the consent of the Centre. No decorations are to be put up near to light fittings or heaters.
  1. Heating

The Hirer shall ensure that no unauthorised heating appliances are used on the premises without the consent of the Centre’s trustees. Portable liquefied propane gas heating appliances must not be used.

  1. Drunk and Disorderly Behaviour and Supply of Illegal Drugs

The Hirer shall ensure that in order to avoid disturbance of neighbours to the Centre, and to avoid violent and criminal behaviour, care is taken to avoid excessive consumption of alcohol. Drunk and disorderly behaviour is not permitted on the premises or in its immediate vicinity. Alcohol shall not be provided to any person suspected of being drunk, or to any person suspected of being under the age of eighteen. Any person suspected of being drunk, under the influence of drugs, or who is behaving in a violent or disorderly way must be asked to leave the premises. No illegal drugs are to be brought onto the premises.

  1. Animals

The hirer shall ensure that no animals (except guide dogs) or birds are brought into the premises. No animals or birds are permitted to enter the kitchen area at any time.

  1. Compliance with the Children’s Act 1989

It is the responsibility of the person who has signed the hire booking form to ensure that any activities for children under eight years of age comply with the provisions of the Act and that only fit and proper persons who have passed the appropriate Disclosure and Barring Services checks have access to the children. Checks may also apply where children over eight and vulnerable adults are taking part in activities. The Hirer shall provide the Centre with a copy of their Child Protection Policy on request.

  1. Fly Posting

The Hirer shall not carry out or permit fly posting or any other form of unauthorised advertisements for any event taking place at the premises, and shall indemnify and keep indemnified each member of the Centre’s trustees accordingly against all actions claims and proceedings arising from any breach of this condition. Failure to observe this condition may lead to prosecution by the local authority.

  1. Sale of Goods

If the Hirer is selling goods on the premises, they must comply with Fair Trading laws and any code of practice used in connection with such sales.

  1. Cancellation

If the Hirer cancels the booking within forty eight hoursbefore the date of the event, any deposit paid will be retained by the Centre.

The Centre reserves the right to cancel a hiring by written notice to the Hirer if:

  • The premises are required for use as a Polling Station for a Parliamentary or Local Government election or by-election
  • The Centre reasonably considers that the hiring will lead to a breach of licencing conditions or other legal or statutory requirements, or that unlawful or unsuitable activities will take place at the premises as a result of this hiring.
  • The premises become unfit for the use intended by the Hirer
  • An emergency occurs requiring use of the premises as a shelter for victims of flooding, snowstorm, fire, explosion or similar disasters.

In any such case, the Hirer will be entitled to a refund of any deposit already paid, but theCentreshall not be liable to the Hirer for any resulting loss or damage.

  1. Noise

The Hirer shall ensure that the minimum of noise is made on arrival and departure, particularly late at night and early in the morning. If the Hirer is using sound amplification equipment, they must make use of any noise limitation device provided at the premises, and must comply with all licencing conditions for the premises.

  1. Stored Equipment

The Centre accepts no responsibility for loss of or damage to or liability for loss of or damage to any stored equipment or other property brought on to or left at the premises. All equipment and other property (other than stored equipment) must be removed at the end of each hiring.

  1. Alterations

No alterations or additions may be made to the premises nor may any fixtures be installed, or placards, decorations or other articles attached in any way to any part of the premises without the written approval of the Centre. Any alteration, fixture or fitting or attachment which has been approved by the Centre may remain in the premises at the discretion of the Centre at the end of the hiring. It will become the property of the Centre unless removed by the Hirer who must make good to the satisfaction of the Centre any damage caused to the premises by such removal.

  1. Rights

This Agreement constitutes permission only to use the premises and confers no tenancy or other right of occupation on the Hirer.
