SPRING GARDEN TOWNSHIP PLANNING COMMISSION

July 7, 2015


CALL TO ORDER: The monthly meeting of the Spring Garden Township Planning Commission was held on Tuesday, July 7, 3015 in the Township Municipal Building, 340 Tri Hill Road, York, PA.

Chairman George opened the meeting at 7:00 p.m.

PUBLIC COMMENT PERIOD: There were no public comments.

APPROVAL OF MINUTES: The minutes of the May 5, 2015 meeting were presented for approval. Motion Mr. Dorgan/ second Mr. DeHaas to approve the minutes. There were no public comments. Motion approved. Yes-4, No-0 .

ZONING APPLICATIONS:

a.  Application #125-07-15: Cellco Partnership, d/b/a Verizon Wireless is requesting a Variance to Sections 310-11(B) to permit a small cell communication facility in the OS zone; a Variance to Section 310.51.A(29) to permit the required off-street parking space to not be located in a fenced area; and the extension of the timeframe to secure the necessary building permit or use certificate (Section 310-41.C(5)). The property is located at 1400 Country Club Road, York PA and is owned by Country Club of York, located in the OS (Open Space Conservation) zoning district.

Atty. John Andrews from McNees, Wallace & Nurick, LLC was present along with several other representatives for this application and explained they are requesting a Use Variance for a communications facility, a Variance to permit the required parking in an existing parking lot, and a request for a time extension allowed in order to obtain all the necessary approvals and permits.

Atty. Andrews stated this proposed facility will be housed in a cupola to be constructed on the top of the golf course snack shack, which is located 1300+ feet to any property line. The building is currently 15’ high, and the proposed cupola will be an additional 4 ½’ high, for a total height of 19 ½ feet. The cupola will contain a cylinder antenna which will provide additional cellular coverage for the golf course, plus provide more data capacity for the area.

Mr. DeHaas questioned the notation that this is not financial in nature. Atty. Andrews stated it is inferred financial in nature, but not totally. Mr. DeHaas agreed.

Mr. Davidson asked about the range of coverage. Atty. Andrews stated the new antenna will work in conjunction with the existing tower on the York Water Company property to the east. The coverage will service the Country Club patrons, and the capacity will serve the area.

There were no further questions or comments. Motion Mr. DeHaas/ Mr. Dorgan to recommend approval of the two variance requests and the time extension as presented. Motion carried. Yes-4, No-0.

SUBDIVISION PLAN:

a.  John J. & Katherine V. Shorb – Final subdivision to create one new building lot to be located at 1300 Oakdale Drive in the R-1 (Residential-Suburban) and OS (Open Space Conservation) zoning districts.

Lee Faircloth from Gordon Brown Associates was present and explained they plan to subdivide one new building lot, containing 2 acres in size, utilizing public sewer and public water. The possible future extension of Oakdale Drive was discussed, and provisions are made to provide a right-of-way for any future development.

There were no further questions or comments. Motion Mr. DeHaas/ Mr. Dorgan to recommend approval of the subdivision plan with the following waivers and conditions:

Waivers:

a.  Waiver to requirement to extend Oakdale Drive and construct a cul-de-sac

b.  Waiver to installation of curb and sidewalk at this time

Conditions:

a.  Change notation on plan for Oakdale Drive Extended to be “Proposed Public Street of Oakdale Drive”

b.  Planning Module approval

c.  Payment of Recreation Fee in lieu of providing land

d.  Correct street address for Lot #4 to 1300 Oakdale Drive

OTHER BUSINESS:

a.  York Township is in the process of amending its Official Map, and has provided a copy to the County and surrounding municipalities in order for them to offer comments and recommendations during the 45-day review period. The Planning Commission reviewed the map and determined that there does not appear to be any conflict with Spring Garden Township’s area.
