APPLICATION FORM FOR THE PURCHASING PORTAL OF TRENITALIA

I, the undersigned - , as Select officer and legal representative of the Company , I declare that I have read, understood and unconditionally accepted all the contents of the Regulations of the on-line tender, as amended.

I also declare that I have provided a valid certified e-mail address (PEC) inside the appropriate field in the on-line registration form, as required by Article 2 of the Regulation for on-line tender calls, as amended.

Finally, regarding the processing of personal data covered by ex Legislative Decree no. 196/2003:

I give my consent to the Processing of the selfsame data by Trenitalia SpA for the purposes and using the methods which the Privacy policy mentioned above

I do not agree to the Privacy policy mentioned above

NOTE: this form, duly completed and digitally signed with a valid digital signature certificate, must be loaded in the system, along with a scanned copy of the subscriber’s identity document, as outlined in the Portal “Instructions” (). After the page has been saved, the Portal will return the verification of the digital signatures to the user (red or green icon).

Operators who do not have a valid digital signature certificate can insert a scanned copy of this form into the system, duly completed with a handwritten signature by the legal representative, along with a scanned copy of the subscriber’s identity document. INFORMATION PURCHASING PORTAL

INFORMATION PURSUANT TO ART. 13 OF Legislative Decree 196 of 30 June 2003

Under Legislative Decree n. 196 dated 30 June 2003 “Code concerning the protection of personal data”. We inform you that the personal information provided by Economic Operators/Suppliers during the Purchasing Portal registration process (hereinafter known as the “Portal”) are processed by Trenitalia S.p.A. for purposes related to the use of the selfsame, such as, but not limited to:

  • purposes related to the participation and accomplishment of the Tender Calls via Internet;
  • purposes related to the fulfilment of legal obligations (resulting from accounting rules, tax laws, etc.);
  • purposes related to the conclusion and execution of a Contract and its annexes;
  • purposes related to the arbitration of any disputes (judicial or extrajudicial);
  • purposes related to the operation and management of Trenitalia’s own activities.

Regarding the provision of personal data for the purposes mentioned above, acceptance is absolutely necessary. Otherwise, any refusal by the Economic Operator will impede entry to said Portal, and thereby rendering the subscriber ineligible to participate in Tender Calls via Internet

Processing methods

Your data will be processed in absolute compliance with the principles of fairness, legality, relevance and not excessively under Article 11 of the aforementioned legislative decree, by computer utilizing methods that guarantee security and the appropriate level of confidentiality.

Your personal information will not be disseminated in any way, and may only be processed for the purposes stipulated above; only fulfilling the obligations required by laws, regulations or laws and provisions of the industry Regulatory Authorities and will be transmitted by other parties only in cases that are expressly provided by the law.

The following Trenitalia structures are responsible for processing data: the Purchasing and the Industrial Logistics Departments. According to the Company’s organizational chart they have been tasked with safeguarding privacy, and may be called upon, from time to time, to indicate this in the tender documents, as well as the Company Bravo Solution S.p.A, located in Bergamo Piazza Repubblica n. 1, appointed by Trenitalia as the outside corporation responsible for the performance of management services and the technical management of the system and computer applications needed to run the selfsame System (“System Operator”).

The system operator is, in particular, in charge of information security, logic and physics of the selfsame System and acts as system administrator. However, this person is responsible for taking all measures established by Legislative Decree n. 196/2003 regarding the protection of personal data.

Owner and data processing manager

Trenitalia is the owner of the data, with its headquarters in Piazza della Croce Rossa n 1, 00161 Rome.

The role of data processing manager is performed by Trenitalia’s Purchasing Manager, with its headquarters in Piazza della Croce Rossa n 1, 00161 Rome, which other persons who may consult aforementioned list could become aware of the existence of such data in the performance of their duties as internal or external managers.

Rights of the data subject

To exercise your rights under Article 7 of Legislative Decree no. 196/2003 as amended (access, rectification, integration, data deletion, opposition to data processing, etc.) the concerned party can contact the aforesaid Data Processing Manager. In particular, interested parties may request the deletion of their personal data through the feature available on the Portal or the various regulations that may be indicated.
