Shared Jurisdiction Agreement

This Cooperative Agreement is entered into this _____ day of _____ 2004, by and between the Public Housing Authority of the County/City of PHA #1 insert name, hereinafter “PHA insert name” and the Housing Authority of the County/City of PHA #1 insert name hereinafter “PHA insert name” pursuant to the Inter-local Cooperation Act, and Section 392.017, 392.019, and 392.059 of the State of Texas Local Government Code.
WHEREAS, the “PHA #1 insert name” is a duly constituted housing authority created under the laws of the State of Texas, which has as its jurisdiction the area of limits of the County/City of PHA #1 insert name, Texas, excluding those part of County/City PHA #1 insert name that are within the territorial boundaries of a municipality and five miles outside the county limits of County/City PHA #1 insert name, Texas (“ETJ)’ and
WHEREAS, the Housing Authority of the City of PHA #2 insert name is a duly constituted housing authority created under the laws of the State of Texas, operating within the corporate limits of the City of Austin, and five miles outside the corporate limits of the City of PHA #2 insert name, Texas (“ETJ”); and
WHEREAS, the PHA #1 insert name Board of Commissioners is the governing body of the PHA #1 insert name Housing Authority political subdivision; and
WHEREAS, the Housing Authority of the County/City of PHA #2 insert name Board of Commissioners is the governing body of the Housing Authority of the County/City of PHA #2 insert name political subdivision; and
WHEREAS, PHA #1 insert name and PHA #2 insert name have determined a need for the PHA #1 insert name to exercise its powers in the jurisdiction of the PHA #2 insert name and for PHA #2 insert name to exercise its powers in the jurisdiction of the PHA #1 insert name; and
WHEREAS, PHA #2 insert name has agreed to allow PHA #1 insert name to undertake certain housing projects as herein provided.
Now, therefore, the parties agree to the following:
PURPOSE
The purpose of this agreement is for the PHA #1 insert name to administer PHA #1 insert name (HA’s) Section 8 Housing choice Voucher Program within the jurisdiction limits of PHA #2 insert name and to allow the PHA #2 insert name to administer PHA #2 insert name (HA’s) Section 8 Housing Choice Voucher Program within the jurisdiction limits of PHA #1 insert name.
PRIOR AGREEMENTS SUPERSEDED
This agreement between the PARTIES hereto and supersedes all prior understandings or written or oral agreements between the parties respecting written or oral agreement pertaining to this cooperative agreement between PHA #1 insert name and PHA #2 insert name. This cooperative agreement should be r eviewed and approved on an annual basis.

Approval of a Cooperative Agreement with the PHA #1 Insert Name
For Shared Jurisdiction in Administering the
Section 8 Housing Choice Voucher Program
WHEREAS, the Housing Authority of the City of PHA #2 insert name and PHA #1 insert name both administer the Section 8 Housing Choice Voucher Programs within ______County;
WHEREAS, it is required by the State of Texas Local Government Code for PHA #2 insert name and PHA #1 insert name to enter into a Cooperative Agreement to exercise their powers within in both common jurisdictions;
WHEREAS, PHA #2 insert name and PHA #1 insert name mutually agree to exercise their powers of joint jurisdiction within the City of ______and ______County to administer the Section 8 Housing Choice Voucher Programs;
NOW, THEREFOREW BE IT RESOLVED that the Housing Authority of the County/City of ______Board of Commissioners authorize the Executive Director to enter into a Cooperative Agreement with PHA #1 insert name.
