RESOLUTION NO. 1161

A RESOLUTION SETTING FORTH POLICIES AND PROCEDURES FOR THE REVIEW AND APPROVAL OF PROPOSED SEWER DISTRICTS.

WHEREAS, the City of Overland Park must consent to the creation of sewer districts formed within the City limits before the Johnson County Board of Commissioners will create said district;

WHEREAS, the creation of sewer districts is of importance in preceding new development in Overland Park;

WHEREAS, the Community Development Committee on April 24, 1976, recommended to the City Council a policy and procedure for referral of proposed sewer districts in Overland Park, Kansas;

WHEREAS, the Governing Body of the City of Overland Park, Kansas, did on May 3, 1976, find such policy and procedure to be acceptable.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS, that the following policy and procedure for consent to the creation of new sewer districts in the City of Overland Park shall apply to all proposed sewer districts.

POLICY:

The City of Overland Park shall review all proposed sewer districts to be formed within the City limits for their impact upon fiscal, economic, social and environmental concerns.

All proposed sewer districts shall be forwarded to the Community Development Committee for such review and assessment and report back with recommendation to the Council.

PROCEDURE:

The procedure for proposed sewer districts review shall be as follows:

A. The applicant shall file a written request to the City Clerk complete with three copies of the consent resolution, a legal description and a map of the proposed district at a scale of one inch equals 200 feet to one inch equals one thousand feet.

B. The City Clerk's office will forward a copy of the forms and maps to the staff coordinator for consideration at the next Community Development Committee. Applications received less than two weeks prior to the Community Development Committee will be considered at the second following meeting.

C. The Staff Plan Review Committee will submit a report to the Community Development Committee delineating the status of the following items and their relationship to the proposed sewer district:

The Master Development Plan including:

1. General Plan.

2. Parks and Recreation Plan including Greenbelt.

3. Thoroughfare Plan.

4. The status of roads.

5. The impact on the City's Capital Improvement Program.

6. Environmental concerns including flood plains, topographic consideration, soil and environmentally sensitive areas.

7. Zoning.

8. Impact and development on City services.

9. Other plans as appropriate.

D. The applicant shall be notified of the date when the Community Development Committee will consider the proposed sewer district.

E. The Community Development Committee upon receiving the report shall consider the proposed sewer district and make a recommendation to the City Council.

F. Upon receipt of the Community Development Committee report, the City Council shall take appropriate action upon the request for consent to the creation of the proposed sewer district.

G. Upon final action by the City Council, the City Clerk's office shall forward to the applicant the approved consent forms, or advise of such other Council action on the matter as is appropriate.

When appropriate, the City Clerk shall forward to the Johnson County Board of Commissioners and Sewer District pertinent Council comments regarding the proposed sewer district.
