On page 5, line 21, before the word "A" insert the subsection number "(1)" and after the word "bus" delete the word "company"; and
On page 5, between lines 22 and 23, insert the following:
"(2) A charter bus, as defined in subsection (4) of Section 1 of this Act, operating in the Commonwealth shall be required to undergo an annual safety inspection conducted by the Kentucky Transportation Cabinet. The cabinet shall issue a window sticker for each charter bus that successfully passes the safety inspection. The sticker shall be dated and shall be placed in the lower right hand corner of the front window of the charter bus. The cabinet may charge a fee not to exceed one hundred dollars ($100) per bus for each safety inspection conducted. The cabinet shall promulgate administrative regulations under KRS Chapter 13A to establish the fee authorized by this subsection. A charter bus that fails to successfully pass the safety inspection required by this subsection shall not operate within the Commonwealth until safety violations identified by the cabient have been corrected.
(3) Any person who operates a charter bus and who intentionally avoids having the charter bus undergo the safety inspection required by subsection (2) of this section shall be fined five hundred dollars ($500) for each bus that the person did not have inspected by the cabinet."
