On page 12, delete lines 20 through 26 in their entirety and insert the following in lieu thereof:
"(23) Parameters for County Flexibility: Notwithstanding KRS 42.4588(2), Local Government Economic Development Fund allocations, as specified in Part II, M., of this Act, may be used to support nonrecurring investments in public health and safety, economic development, public infrastructure, information technology development and access, and public water and wastewater development. Grants from funds provided for in KRS 42.4592(1) shall be used only for the purposes provided for in KRS 42.4588(2).";
On page 13, after line 2, insert the following:
"(25) Kentucky Appalachian College Completion Program: If House Bill 260 of the 2012 Regular Session of the General Assembly becomes law, then notwithstanding KRS 42.4588, $6,000,000 in each fiscal year shall be transferred from the Local Government Economic Development Fund, Multi-County Fund, to the Appalachian Coal County College Completion Grant Fund within the Kentucky Higher Education Assistance Authority and $500,000 in each fiscal year shall be transferred from the Local Government Economic Development Fund, Multi-County Fund, to the Appalachian Coal County College Completion Student Services Grant Fund within the Council on Postsecondary Education.";

"(1)Use of Student-Endorsed Fees: Revenue from a student-endorsed fee may be used for debt service to support bonds issued to fund academic buildings. A student-endorsed fee is a mandatory, flat-rate fee that has been broadly discussed, voted on, and requested by students, and adopted by an institution's governing board. This student-endorsed fee shall not count toward the mandatory tuition and fee ceiling established by the Council on Postsecondary Education for public universities.";
