APPROVAL OF A SMALL COMMUNITIES GRANT (SCG) FOR CITY OF LIVE OAK (CITY), COLLECTION SYSTEM AND WASTEWATER TREATMENT PLANT IMPROVEMENT PROJECT (PROJECT), PROJECT NO. SCG- 809

DISCUSSION

In accordance with the State Water Resources Control Board's (SWRCB) Implementation Policy for the Small Communities Grant Program (Policy), adopted on January 23, 1997, and amended and reauthorized on June 15, 2000, projects on the adopted priority list need SWRCB approval to receive a SCG construction grant. The SWRCB can authorize construction grants after the Division of Clean Water Programs (Division) approves the final plans and specifications (P&S). The Division approved the final P&S for the City’s Project on March 28, 2001.

The City is located in the northeastern portion of Sutter County and is approximately 40 miles north of Sacramento. The population of the community is approximately 5,600 and the 1996 median household income was $18,886. Based on the Policy’s funding formula, the City qualifies for a 97.5 percent SCG.

The City operates and maintains wastewater conveyance and treatment facilities for 1,634 connections. The City’s existing collection system consists of three pump stations and approximately 17 miles of gravity sewer pipeline. The wastewater treatment facility is comprised of a pond treatment system with disinfection and dechlorination facility. The Central Valley Regional Water Quality Control Board (CVRWQCB) issued Cease and Desist Order (CDO) No. 99-009 for violating their waste discharge requirements. The violations are a are primarily due to inflow and infiltration, andresult of deficient collection and treatment system capacities. The City’s project includes replacing sections of the sewer collection and pumping system, and upgrading the wastewater treatment facility. The proposed project will enable the City to comply with CDO No. 99-009.

The City prepared an Draft Environmental Impact Report (EIR) for the proposed project in December 1999, which was distributed to the public and circulated through the State Clearinghouse (SCH# 1999122071) for review from December 20, 1999, through January 18, 2000. The City held a public meeting on December 20, 2000. During the review period the District received comment letters from the State Water Resources ControlSWRCB Board’s Division of Clean Water Programs, California Department of Transportation, Central Valley Regional Water Quality Control BoardCVRWQCB and Pacific Gas and Electric. Environmental issues identified included water quality, impacts to agricultural lands, energy requirements and traffic. The City provided responses to all comments and made appropriate changes to the Draft EIR. The City approved the project, certified the EIR, and adopted a Mitigation Monitoring Plan on October 18, 2000. The City filed a Notice of Determination with the Sutter County Clerk’s Office and the Governor’s Office of Planning and Research on December 11, 2000.

RWQCB IMPACT

The CVRWQCB issued Cease and Desist Order No. 99-009 for violating their waste discharge requirements. The City’s project will enable compliance with this order.

CITY OF LIVE OAK (CITY), COLLECTION SYSTEM AND WASTEWATER TREATMENT PLANT IMPROVEMENT PROJECT (PROJECT)

PROJECT NO. SCG-809

WHEREAS:

  1. The Implementation Policy for the Small Communities Grant Program was adopted by the State Water Resources Control Board (SWRCB)on January 23, 1997, and amended and reauthorized on June 15, 2000;
  1. The State Water Resources Control BoardSWRCB, on August 17, 2000, adopted the SCG Program Priority List which included the City’s Project in Priority Class B;
  1. The Division of Clean Water Programs (Division) approved the Facilities Plan, which includes the project report, environmental documents, and draft revenue program, by issuing Concept Approval on March 9, 2001, for the City’s Project;
  2. The Division approved the plans and specifications, on March 28, 2001, for the City’s Project; and
  3. The City adopted an Environmental Impact Report (State Clearinghouse No. 1999122071) prepared for the Collection System and Wastewater Treatment Plant Improvement Project, which has been reviewed and considered, and it has been determined that the adopted mitigation measures avoid or substantially reduce potential significant environmental impacts.

THEREFORE BE IT RESOLVED THAT:

The State Water Resources Control Board approves a $2,557,580 Small Communities Grantto construction grantthe for the City of Live Oak’s Project.
