MINUTES

Call to Order & Opening Statement: This Special Meeting is called pursuant to the provisions of the Open Public Meetings Law. Notice of this meeting was sent to the New Jersey Herald on Thursday, May 7, 2010 to be advertised in said newspaper on Monday, May 9, 2010, posted on the bulletin board in the MunicipalBuilding on Thursday, May7, 2010, and has remained continuously posted as required under the statute. In addition, a copy of this notice is and has been available to the public and is on file in the Office of the Municipal Clerk. This meeting was called to order at 6:00 pm.

Budget Discussions:2010-2011 Kittatinny Regional High School Defeated School Budget

The following meeting was held Kittatinny Regional High School Library, 77 Halsey

Road, Newton, NJ on Tuesday, May 11, 2010 at 6:00 pm.

Mr. Anthony Norod, President of the Board of Education, read the Open Public Meeting

Statement.

Each sending district for KittatinnyRegionalHigh School (Stillwater, Hampton, Fredon,

Sandyston) read their Open Public Meetings Law Statement.

There was no correspondence.

Each Township was given the opportunity for opening comments and questions.

Open Meeting to Floor: The public was invited to speak and our ask questions during public comment. Those who wished to comment were given a two minute time limit.

Executive Session:

Township of Sandyston

Resolution Authorizing Executive Session

WHEREAS, Section 8 of the Open Public Meetings Act, P.L. 1975 Chapter 231 permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist; and

NOW, THEREFORE, BET IT RESOLVED by the Township Committee of the Township of Sandyston, County of Sussex, State of New Jersey as follows:

  1. Pursuant to the Open Public Meetings Act N.J.S.A. 10:4012(b) the public shall be excluded from discussion of an action upon the hereinafter specified subject matter(s):

matters relating to litigation, negotiation, and the attorney/client privilege

AND BE IT FURTHER RESOLVED, it is anticipated that the deliberation conducted in closed session may be disclosed to the public upon the determination of the Sandyston Township Committee that the public interest will no longer be served by such confidentiality and if not then legally privileged. This Resolution shall take effect immediately.

Mayor Harper made a motion to enter into executive session to discuss contractual negotiations at 7:14 pm, seconded by Committeeman MacDonald. Mayor Harper made a motion to exit executive session at 8:45 pm, seconded by Committeeman MacDonald.

The Kittatinny Board of Education announced an agreement had been made with Hampton, Stillwater, Fredon and Sandyston for the amount of $275,000 to be reduced from the tax levy.

RESOLUTION 2010-38

KITTATINNYREGIONALHIGH SCHOOL BOARD BUDGET

RESOLUTION CERTIFYING THE GENERAL FUND TAX LEVY FOR THE KITTATINNY REGIONAL HIGH SCHOOL BOARD OF EDUCATION FOR THE SCHOOL YEARS 2010-2011, BY THE GOVERNING BODY OF THE TOWNSHIP OF SANDYSTON,COUNTY OF SUSSEX, STATE OF NEW JERSEY

WHEREAS, the voters of the Township of Sandyston, in a duly held election, did fail to approve the General Fund Tax Levy Budget of the Board of Education of the Kittatinny Regional High School for the school year 2010-2011; and

WHEREAS, the Education, Budgets and Appropriations Law,' N.J. S.A. 28a-22-37, requires the Governing Body of the Township of Sandyston, after consultation with the Kittatinny Regional High School Board of Education, to determine the amount which is necessary to be appropriated in such budget and to certify to the County Board of Taxation the total amount so determined; and

WHEREAS, the Governing Body of the Township of Sandyston has consulted with representatives of the Kittatinny Regional High School Board of Education, and has thereafter determined the amount necessary to be appropriated;

NOW, THEREFORE BE IT RESOLVED by the Governing Body of the Township of Sandyston, County of Sussex, State of New Jersey, that the following determination is hereby made:

  1. The original tax levy on the ballot for the base budget:$12,789,812
  2. The amount of reduction to the tax levy for the base budget:$ 275,000
  3. The amount of tax levy being certified for the base budget:$12,514,812

  1. Supporting reasons for reduction: Based upon a review of all data provided by the Board of Education, meetings with representatives of the Board of Education, numerous public hearings and consideration of the public need, it has been determined that the reductions set forth herein can be effectuated without a reduction in programs or negatively impacting upon the education of the students.
  1. The revised budget is sufficient to provide a thorough and efficient education.
  1. There was no additional general fund tax levy considered by the voters.

BE IT FURTHER RESOLVED that certified copies of this resolution be forwarded to the Kittatinny Regional High School Board of Education, Superintendent of the County of Sussex Department of Education, and the Administrator of the Sussex County Board of Taxation.

Mayor Harper made a motion to approve R-38-2010, seconded by Committeeman MacDonald and unanimously carried.
