TheMassachusettsBoardofRegistrationinDentistry("Board")andKathleenVowelsBrunkhardt,RDH("Licensee"),License1No.DH7893("License"),doherebystipulateandagreethatthefollowinginformationshallbeenteredintoandbecomeapermanent

partoftheLicensee's recordmaintainedbytheBoard.

1.TheLicenseeherebystatesthatshevoluntarilyentersintothisConsentAgreementforReprimand("ConsentAgreement") toresolvetheallegations setforthinDocketNo.DEN-2014-0022 ("Complaint").

2.TheLicenseeacknowledgestherearesufficientfactsintheComplaintfromwhichtheBoardcouldreasonablyfindgroundsfordisciplineunderM.G.L.c.112,§ 61andBoardregulations.

3.TheLicenseeandtheBoardstipulateandagreetoresolvetheComplaintwithoutmakinganyfindings andwithoutproceedingtoaformaladjudicatoryhearingontheComplaintbasedonthefollowingallegations:

(a)OnAugust2,1985,LicenseewasissuedalicensetopracticedentalhygieneintheCommonwealth.LicenseerenewedherLicensebienniallyfromAugust2,1985,untilonoraboutMarch31,2013,whenLicenseefailedtorenewherLicenseinviolationof M.G.L.c.112,§51and234CMR4.10(2)and(4).2Thus,her License expired onAprill,2013.

(b)LicenseepracticedintheCommonwealthwithoutalicensefromApril1,2013,untilonoraboutMarch3,2014whenshediscoveredherLicensehadexpired.Thus,Licenseepracticedwithouta dentalhygienelicensefromAprilI,2013untilonoraboutMarch1,2014inviolationof M.GL.c.112,

§52and234CMR9.05(6).

(d)Licenseeviolated234CMR8.03(a),byfailingtotakemandatory continuingeducationinInfectionControlinDentalHealthCareSettingbeforerenewingherLicense.

(e)Licenseeviolated234CMR8.02(3),byfailingtotake 12of20CEUsrequiredforthelicenserenewalperiodendingMarch31,2013.

4.Toresolvethismatterwithout furtherproceedingsbeforetheBoard,theLicenseeagreesandtheBoardherebyimposesaReprimandonherLicensepursuantto234CMR9.03(2)(a)tobecome effectivethedateonwhich thisConsentAgreementissignedbytheBoard("EffectiveDate").

5.TheLicenseeunderstandsheractioninenteringintotheConsentAgreementisafinalactandnotsubjecttoreconsideration,collateralattackorjudicialreviewinanyformorforum.

6.Withinthirty(30)daysoftheEffectiveDate,Licenseeshallprovideacopyofthe ConsentAgreement toalljurisdictionswheresheholdsorhasheldanyprofessionallicense.

(a)LicenseeshallprovidewrittendocumentationtotheBoarddemonstratinghercompliancewithparagraph6.

(b)IfLicenseeisnotlicensedtopracticedentalhygieneoranotherprofession inanyotherjurisdiction,sheshallsubmitasignedattestationtotheBoardstatingsuch.

7.Withinsix(6)monthsoftheEffectiveDate,theLicenseeshallprovidewritten proofsatisfactorytotheBoardshehastakenandsuccessfullypassedtwelve(12)CEUswhichshallincludethree(3)CEUsrelatedtoInfectionControlintheDental HealthCareSetting.

8.TheLicenseeacknowledgesandunderstandstheConsentAgreementisapublicrecordwithinthemeaningof M.G.L.c.4,§7(26)andassuchmaybedisseminatedtothepublic.

9.TheBoardagreesthatbyLicenseeenteringintotheConsentAgreement,theBoardwillforgofurtherprosecutionoftheComplaintunlesstheLicenseedoesnotfulfillthestipulationsasstatedinParagraphs6and7above.

10.TheLicenseestatesthatsheenterstheConsentAgreementofherownfreewill.

Agreementorwaivesherrighttohavecounsel.

11.AwaiverbytheBoardofanyprovisionsoftheConsentAgreementatanytime .shall notconstituteawaiverofanyotherprovisionoftheConsentAgreement,norshallitconstitutewaiver.bytheBoardofitsrightstoenforcesuch provisionatanyfuturetime.

12.TheLicenseehasreadConsentAgreement.TheLicenseeunderstandsshe hastherighttoaformaladjudicatoryhearingconcerningtheallegationssetforthintheComplaintandthatatahearingshewouldhavetherighttoconfrontandcross-.examinewitnesses,callwitnesses,presentevidence,testifyonherownbehalf,contesttheallegations,presentoralargument,seekjudicialreviewandtoallotherrightssetforthintheStateAdministrativeProcedureAct,M.GL.c.30Aand801CMR1.00etseq. ByexecutingtheConsentAgreement,Licenseeknowinglyandvoluntarilywaivesherrighttoa formaladjudicatoryhearingandtoalloftheabove-enumeratedrightssetforthintheStateAdministrativeProcedureAct,M.GL.c.30Aand801CMR1.00etseq.
