An Act to make further provision with respect to the re-location of Sale Railway Station and the development of the land in and in the vicinity of the former Railway Station and for other purposes.

Preamble
WHEREAS by the Sale Station Relocation and Development Act 1981 provision was made for the re-location of the Sale Railway Station and the development of certain land in the City of Sale:
AND WHEREAS it is desirable to make further provision with respect to the exchange of land between the City of Sale and the State Transport Authority and to provide for the closing of certain roads:
BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):
1.Short title and commencement
(1)This Act may be cited as the Sale (Land Development) Act 1984.
(2)This Act shall come into operation on the day on which it receives the Royal Assent.
2.Definitions

In this Act unless inconsistent with the context or subject-matter—
"Authority" means the State Transport Authority;
"Council" means the Mayor, Councillors and Citizens of the City of Sale;
"land" includes all real estate messuages lands tenements and hereditaments of any tenure and easements rights and privileges over in or affecting land;
"lodged plan" means the plan a copy of which is lodged in the Central Plan Office and numbered S.241.F;
"stippled lands" means the lands delineated and shown stippled on the lodged plan.
3.Certain land to be exchanged between Council and Authority
(1)The Council is hereby authorized and required to transfer to the Authority the land shown hatched on the lodged plan freed and discharged from all encumbrances.
(2)The Authority is hereby authorized and required to transfer to the Council the land shown cross-hatched on the lodged plan freed and discharged from all encumbrances.
4.Roads on stippled lands to be closed
(1)So much of the stippled lands except that part of the stippled lands which form part of Raymond Street or Cunninghame Street as are roads shall cease to be roads and all rights, easements and privileges existing or claimed over the lands by the public or by any body or person whatsoever or whomsoever as incident to any past dedication or revocation thereof or by the user thereof shall cease and determine and all of the stippled lands shall be deemed to be unalienated lands of the Crown.
(2)The Governor in Council may in the name and on behalf of Her Majesty grant the stippled lands to the City of Sale.
(3)The stippled lands except that part of the stippled lands which form part of Raymond Street or Cunninghame Street and the land shown cross-hatched on the lodged plan shall be deemed to be land to which section 16 of the Sale Station Relocation and Development Act 1981 applies.

(4)The Council may do all things necessary or expedient for or with respect to the creation of a pedestrian mall or a square on those parts of the stippled lands which form part of Raymond Street or part of Cunninghame Street.
