HIGH COURT CHALLENGES

RR/2006/3470/PWylands International Angling Centre, Powdermill Lane, Catsfield/Battle – Mr Bull

Renewal of outline consent RR/98/2292/P for the erection of 15 fisherman's cabins, facilities building, workshop/store, new dwelling and conversion of two existing dwellings into one, also re-siting of access.

Mr M Parker (Rule 6.6 party) has been partially successful in his application for leave to appeal to the Court of Appeal against the High Court judgement against him. The decision of the Inspector dated 11 December 2008 was quashed. Directions from the Planning Inspectorate regarding a further Public Inquiry are awaited.

RR/2006/2226/PBowling Green, Knowle Road, Bexhill – Churchill Retirement Living

Redevelopment to form 41 sheltered apartments for the elderly, car parking, landscape and access and new outdoor bowls green, indoor rink, club facilities and car parking including alteration to existing and formation of new vehicular accesses.

Anne Marie Loader has applied for Judicial Review following the Secretary of State for Communities and Local Government’s direction that the proposal is not development under the Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999. She had appealed to the Court of Appeal against the refusal of leave to pursue a challenge to the determination of the Secretary of State under the Environmental Impact Regulations. This was refused because it is plain how the assessment would have been decided whichever way the concept of significant facts had been approached. The hearing date in the High Court on the grounds for which permission was granted is awaited.

Change of use of land from agriculture/forestry to a mixed use comprising agriculture/forestry and the storage of plant, vehicles, scaffolding, building materials and equipment (enforcement notice appeal).

The appeal against the enforcement notice was dismissed and the enforcement notice was upheld (with some amendments). Mrs Susan Everson is seeking permission to challenge that decision (reference CO/3053/2010). The outcome of her application is awaited. The application for permission to proceed with the High Court challenge has been listed for an oral hearing on 6 October 2010.

Mrs I Souliotis has applied for permission to seek Judicial Review of the Council’s decision granting planning permission (reference CO/6497/2010). Notification by the Court as to whether she has been given permission to proceed is expected.

RR/2008/1657/OPear Tree Cottage, Battenhurst Road, Ticehurst – Mr Matthew Bramall

Challenge lodged by Mr Matthew Bramall against the decision made on 27 July 2010 by the Inspector appointed by the Secretary of State for Communities and Local Government to dismiss the appeal (reference CO/9297/2010). A Hearing date is awaited.
