By virtue of the power and authority contained in a Consent Order for Sale in Lieu of Partition dated August 21, 2014, the Circuit Court for Cecil County appointed Jay C. Emrey III and Robert Valliant Jones as Trustees, and the Trustees having elected to sell the property described therein, the undersigned Trustees will offer for sale at public auction ON SITE AT THE PREMISES at 1422 Carpenter’s Point Road, Perryville, Maryland 21903, on:

ALL THAT LOT known and designated as a waterfront parcel of land containing 9,100 square feet of land, more or less, on the Chesapeake Bay at Carpenter’s Point in the Fifth Election District of Cecil County, described as 1422 Carpenters Point Road, Perryville, Maryland 21903, also being Parcel 100 on Tax Map 40, and described in a deed recorded among the Land Records for Cecil County at Book 308, Page 347.

THE PROPERTY WHICH IS THE SUBJECT OF THIS TRUSTEES’ SALE, together with all of the improvements thereon, will be sold in its entirety. The property is in fee simple and is improved by a dwelling and is sold in “as is condition” and subject to all superior covenants, conditions, liens, restrictions, easements, rights-of-way, as may affect same, if any.

TERMS OF SALE: A deposit of $25,000.00 in cash or certified check will be required of the purchaser or purchasers at the time and place of sale; balance in cash at settlement to be held within thirty (30) days of ratification of sale by the Circuit Court for Cecil County. Taxes and other public charges to be adjusted to date of sale. All conveyancing costs, State transfer tax and documentary stamps, Cecil County transfer fee to be borne entirely by the purchaser. Time is of the essence for the purchaser; otherwise the deposit will be forfeited and the property may be resold at risk and costs of the defaulting purchaser. Purchaser is responsible for obtaining physical possession of the property, and assumes risk of loss or damage to the property from the date of sale. If purchaser defaults, deposit will be forfeited and the property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney fees of both sales. If the sale is not ratified in accord with these terms of sale, the purchaser’s only remedy is return of the deposit.
