The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Road Safety (Vehicles) Regulations 2009to provide a 50% discount on the fee to be paid for registration or renewal of registration of a vehicle that needs to be used in the course of employment under a declared apprenticeship.

2Authorising provision

These Regulations are made under section 95 of the Road Safety Act 1986.

3Principal Regulations

In these Regulations, the Road Safety (Vehicles) Regulations 2009[1] are called the Principal Regulations.

4Commencement

These Regulationscome into operation on 16November 2015.

5Definitions

In regulation 5 of the Principal Regulations insert the following definitions—

"approved training scheme has the same meaning as it has in the Education and Training Reform Act 2006;

declared apprenticeship means an approved training scheme declared under regulation6(l);".

6Corporation may declare matters for the purposes of Regulations

In regulation 6 of the Principal Regulations—

(a)in paragraph (k), for "Regulations."substitute"Regulations;";

(b)after paragraph (k) insert—

"(l) an approved training scheme to be a declared apprenticeship for the purposesof these Regulations.".

7Grounds for internal review

In regulation 120 of the Principal Regulations—

(a)in paragraph (l), for "(3)."substitute "(3);";

(b)after paragraph (l) insert—

"(m) a decision that item 19(a) or (b) in theTable to Schedule 3 does not applyin relation to an application for registration or renewal of registration ofa vehicle.".

8Schedule 3 amended

(1)In Schedule 3 to the Principal Regulations, in clause (2), for "For"substitute"Subject to clause(3), for".

(2)In Schedule 3 to the Principal Regulations, after clause (2) insert—

"(3) Item 19 of the Table does not apply in relation to—

(a)an application for registration that is made before 1 January 2016; or

(b)an application for renewal of a registration that expired before 1January 2016.".

(3)In Schedule 3 to the Principal Regulations, in the Table, after item 18 insert—

"19Vehicle necessary for declared apprenticeship
A light motor vehicle (other than a motor cycle) that is registered or to be registered in the name of a person who—
(a)is employed under a declared apprenticeship; and
(b) needs to drive the vehicle in the course of that employment (for example, in order to transport tools that are necessary for that employment); and
(c) is not the registered operator of another vehicle the registration fee for which was determined under this item. /
50% base fee".
