The Governor in Council makes the following Regulations:

Part 1—Preliminary
1Objectives
The objectives of these Regulations are to amend the Road Safety (General) Regulations 2009—
(a)as a consequence of the enactment of the provisions of the Road Legislation Further Amendment Act 2016 relating to miniaturised motor cycles; and
(b)to provide for a new definition of testing officer; and
(c)to provide that infringement notices may be served with respect to certain offences.
2Authorising provision
These Regulations are made under section 95 of the Road Safety Act 1986.
3Commencement
These Regulations come into operation on
21 July 2017.

4Definitions
In regulation 5 of the Road Safety (General) Regulations 2009[1], in the definition of testing officer—
(a)in paragraph (b), after "Justice" insert "and Regulation";
(b)for paragraph (c) substitute—
"(c) a testing officer of a facility accredited in the testing and calibration of speed detectors or road safety cameras by the National Association of Testing Authorities, Australia (NATA);".
5Notice to driver and registered operator
(1)For the heading to regulation 56 of the Road Safety (General) Regulations 2009 substitute—
"Content of notice of impoundment or immobilisation".
(2)For regulation 56(c) of the Road Safety (General) Regulations 2009 substitute—
"(c)if the driver is not the registered operator of the motor vehicle—
(i) the name, address and other details of the registered operator; or
(ii)if the motor vehicle is not registered and the Chief Commissioner of Police is able to establish the identity of the owner of the motor vehicle, the name, address and other details of the owner;".
(3)In regulation 56 of the Road Safety (General) Regulations 2009—
(a)in paragraph (g), for "practicable." substitute "practicable;";
(b)after paragraph (g) insert—
"(h)if the notice is given to an owner of the motor vehicle who is not the sole owner of the motor vehicle, advice that the owner must take reasonable steps to serve a copy of the notice on any other owner as soon as reasonably practicable.".
6Traffic infringements
(1)For item 24 of Schedule 7 to the Road Safety (General) Regulations 2009 substitute—
"24 / 2014 / Fail to keep clear or give way to police vehicle, emergency vehicle etc. / RR 78(1) and (2) and 79(1) / 175 penalty units24A / 3129 / Unlawfully approach or pass stationary or slow-moving police vehicle, emergency vehicle etc.; Fail to give way to police officer, emergency worker etc. in immediate vicinity of stationary or slow-moving police vehicle, emergency vehicle etc. / RR 79A(1), (2), (3) and (4) / 175 penalty units
".
(2)After item 135A of Schedule 7 to the Road Safety (General) Regulations 2009 insert—
"135B / 3130 / Ride a miniaturised motor cycle on a road or road related area / RSA 65C(1) / 5 penalty units".
