INTRODUCTION

National Highway Authority (NHA) with the intent of successful execution of its large contracts requires that works are awarded only to firms that are suitably experienced in the road/bridge works, that are financially and managerially sound, and that can provide all the equipment required in a timely manner. For this purpose, NHA carries out the annual assessment of the capacity of firms prior to being invited to participate in open bidding for NHA Projects. Annual Enlistment is usually followed by a closed competitive bidding on NHA Projects in which only enlisted firms are invited to submit bids and Post qualification/Pre-qualification may also apply in such cases. For Large Works falling in limit beyond upper limit of Category RC/BC-1 and Complex Works falling in any Category, Pre-qualification among interested firms (whether or not enlisted) shall be carried out, where the applicants will be encouraged to form joint venture to pool their resources for smooth and efficient execution of Works in a professional manner.


SECTION-I

INSTRUCTIONS TO APPLICANTS (ITA)

1.0 Applications for NHA Enlistment:

1.1 All the Applicants intending for enlistment in NHA for Road and/or Bridge Constructor categories as defined herein below shall be required to submit application for NHA Enlistment on the format attached hereto.

2.0 Road Constructor’s Categories:

4.0 Eligible Applicants:

4.1 The firms meeting criteria for specific category as detailed herein below shall be eligible for enlistment as Road and/or Bridge Constructors, as the case may be.

5.0 Sections of Pre-qualification Document:

5.1 The Pre-qualification Document consists of four Sections stated herein below;

Section-I Instructions to Applicants (ITA)

Section-II Qualification Criteria (QLC)

Section-III Letter of Application (LOA)

Section-IV Information Forms (IF)

6.0 Documents comprising the Application:

6.1 The Application shall comprise the following:

(a) Letter of Application in accordance with Instructions to Applicants

(ITA) Clause 7.0;

(b) Evidence establishing the Applicant’s qualification, in accordance

with Clause 8.0.

(c) Any other documents required as Specified in the Pre-qualification Document.

(d) Affidavit as specified in Pre-qualifications Documents.

7.0 Letter of Application:

7.1 The Applicant shall submit a Letter of Application in the form furnished in Section-II.

8.0 Documents Establishing the Qualifications of the Applicant:

8.1 To establish its qualifications in accordance with Section-II (Qualification Criteria), the Applicants shall provide the information requested in the corresponding information forms included in Section-IV.

9.1  Responsiveness of Applicants:

10.1 NHA may reject any application which is not responsive to the requirements of the PQ Documents prior to detailed evaluation.

10.2 NHA reserves the right to accept or reject any applications and the annul the process altogether or to accept any application with minor deviations, at its sole discretion with no recourse to any applicant.

11.0 Evaluation of Applications:

11.1 NHA shall use the Criteria defined in Section-III, Qualification Criteria, to evaluate the qualification of the applicant.

11.2 The Employer reserves the right to accept or reject any application and annul the process altogether or to accept any application with minor deviations, to its sole discretion wit no recourse to any applicant.

12.0 Foreign Constructors:

The foreign constructors may also apply for enlistment and their applications shall also be evaluated as specified in Section-III, Qualification Criteria. However, they shall be required to enter into Joint Venture conforming to the terms and conditions laid down in PEC Byelaws before participating in tendering process.

13.0 Joint Ventures:

The Joint Ventures shall not be permitted to apply for enlistment, however, the enlisted firms may be allowed to form Joint Ventures for participation in tendering process for specific Projects.

14.0 Firms owned by Engineers:

The applicant with minimum 51% ownership rights of Professional Engineers registered with Pakistan Engineering Council (PEC) may be exempted from complying with the requirements of General and Particular Construction Experience and Financial Soundness for enlistment in Category RC-5/BC-5 subject to the satisfaction of NHA as to the availability of necessary resources with the Applicant to execute such Works.

15.0 Incomplete Information:

Applications containing incomplete information in respect of any requirements of this Pre-qualification Document shall not be considered for evaluation.

16.0 Irrelevant Information

Only asked for information shall have any weightage as given in Criteria. All other information shall be deemed irrelevant and shall have no connection whatsoever on Evaluation Criteria.

17.0 Fee Structure

The Application fee for enlistment, change of category of enlistment or renewal of enlistment is as follows:

This fee shall be deposited after notification of Enlistment.

18.0 Submission of Applications:

18.1 The applications shall be submitted by the applicants in sealed envelops through courier to the office of General Manager (P&CA), 27, Mauve Area, G-9/I, Islamabad upto 10th January 2004.

18.2 This PQ Document can be down loaded from NHA Web site www.nha.gov.pk

18.3 The Employer reserves the right to reject late applications.

18.4 The applications must be accompanied by demand Draft/Pay order not less than Rs.2,000/-, 3,000/-, 4,000/-, 5,000/- & 6,000/- for Categories C-5, C-4, C-3, C-2 & C-1 respectively separately for Road and Bridge Works.

18.5 The Applications shall not be received in person.

19.0 Notification of Enlistment:

Once the Employer has completed the evaluation of applications, it shall notify all applicants in writing of their status of enlistment.

20.0 Pre-qualification/Post Qualification:

Notwithstanding annual enlistment of firms, NHA shall have the right to carryout the process of post qualification or Pre-qualification for works among enlisted firms. Whereas Works falling in limit beyond RC/BC-1 shall require pre-qualification among all interested firms (whether or not enlisted), where they will be encouraged to form joint venture to pool their resources.

21.0  Validity of Enlistment

This Annual Enlistment shall be valid upto to 31st December 2004 and shall be renewable within first quarter for each subsequent year on payment of annual fee upto a maximum of five (05) years, when NHA may carry out fresh enlistment unless required otherwise. However, the Applicant shall be obliged to report any variation(s) in Information Forms that could materially affect the Qualification status of the Applicant. Any change(s) in qualification status may affect the Enlistment Category of the applicant.


SECTION II

Letter of Application

Subject: APPLICATION FOR NHA ENLISTMENT

1. Being duly authorized to represent and act on behalf of ______(hereinafter referred to as “the Applicant).

2. Attached to this letter are copies of original documents defining:

a. the Applicant’s legal status;

b. the principal place of business; and

e. the place of incorporation (for Applicants that are corporations), or the place of registration and the nationality of the owners (for Applicants that are partnerships or individually owned firms).

3. The NHA and its authorized representatives are hereby authorized to conduct any inquiries or investigations to verify the statements, documents, and information submitted in connection with this application, and to seek clarification from our bankers and clients regarding any financial and technical aspects. This Letter of Application will also serve as authorization to any individual or authorized representative of any institution referred to in the supporting information to provide in this application, such as the resources, experience, and competence of the Applicants.

SECTION III

QUALIFICATION CRITERIA

1. NHA shall issue NHA Enlistment Certificate to Applicant in any one of the categories stated above on Applicant meeting all the following criteria regarding their general and particular construction experience, financial position, personnel and equipment capabilities, and other relevant information as demonstrated by the Applicant’s responses in the NHA Information forms attached to the Letter of Application.

2. PEC License

The valid License of Pakistan Engineering Council (PEC) in respective Category of application shall be required alongwith the Application, failing which shall lead to disqualification.

5. Litigation

A consistent history of litigation and arbitrations from contracts completed or ongoing over the last ten (10) years may lead to disqualification of the Applicant.

6. Fraud and corruption

The proven charges of fraud and corruption may lead to disqualification. For ongoing trials cases, the decision of NHA shall be final in this regard.

7. Poor Performance

Poor performance on previous works may lead to disqualification of the Applicant.

8. Right to Waive

NHA reserves the right to waive minor deviations in the qualification criteria in view of overall capabilities of an Applicant. In particular, the criteria for Particular Construction Experience may be relaxed in view of Applicant’s experience in civil Works and fulfillment of rest of specified criteria. However, in such case(s), the decision of NHA shall be final and binding with no recourse.

9. Wrong Information

Any information included in this submission of the constructor, if found incorrect consequent to verification, shall lead to disqualification of the firm with 8 year ban on Participation in bids of NHA (Head Office as well as Regional)


SECTION IV
