Minutes of the Rights of Way Committee held on Tuesday,

24th January 2012 at 7.30 p.m. at Warwick Mill

ROW21/12 Apologies – None

ROW22/12 Declarations of Interest – Ms J Holland declared an interest in item 6(i) Jubilee Path, Warwick on Eden.

ROW23/12 Minutes of the Rights of Way Working Group of 11th November 2011

Resolved minutes of the above meeting confirmed as a true and accurate record and be signed by the Chairman.

ROW24/12 Allotments

Clerk gave a verbal update on the current status of allotment provisions in the parish.

(i) Methodist Chapel Site – Site is working well, a grant application has been received to include a wildlife pond within the site.

(ii) Cotehill – Legal Agreement now complete, awaiting land owner to sign and return to the councils Solicitor.

iii) Garden Buddies – A new “Buddy” had been identified at Warwick Bridge, information had been passed to a local applicant who would approach owner direct. The Heads Nook land owner was still to be approached.

ROW 25/12 Interpretation Panels (Jubilee Project) – Members of the group recommended that each village should have an interpretation panel to celebrate the Queens Diamond Jubilee, if necessary over a phased period of time.

Residents of Wetheral gave their full support to this project. Clerk advised that funding would available for 3 panels to be installed at Wetheral, Scotby, Great Corby, using the proposed specifications shown to members. Members requested a separate meeting for further discussion.

Clerk to supply a further specifications and another tender for the work – Resolved -the working group formed, (consisting of members M Murray, M Higginbotham, N Holmes, D Hughes, J. Holland ) agreed to meet to discuss further at 7.00 on 8th February prior to the Full Council Meeting.

ROW 26/12 Village Issues –

General – Clerk advised of the following work completed

i) Bulb Planting – Bulbs planted in Cotehill, Cumwhinton, Aglionby, Scotby, and Wetheral

ii) Notice boards – W. Bridge board awaiting the outcome of the planning application at the George site.

iii) Squirrel Group - additional signs erected on river road Wetheral.

Scotby

i) Washbeck – Following severe flooding the grille was removed; it is being inspected on a regular basis, with water flowing freely. Members discussed the necessity of the grille being in place further advice was needed from the Environment Agency as to whether the grille should be replaced. – Resolved - Members felt that further advice must be taken on this issue. Clerk to contact Environment Agency. Following the meeting Clerk advised that the removal of the grille was resolved at the Full Council Meeting on 14 December 2011(119/11c) and was to be monitored.

Contractor to tidy Washbeck area in the spring.

ii) Letter from Resident re Footpath Lambley Bank to Broomfallen Road, Scotby – Clerk has forwarded to Green spaces team.

iii) Path between Red Barn, Scotby over the motorway to the Garlands Estate was unusable, permanently wet and muddy - Clerk has been advised that the area to the east of the motorway has been tidied up; the lane has been upgraded to field with caravans. Additional work required to path still required to improve situation, Green spaces team are monitoring at the area. D. Hughes to liaise with residents

Aglionby/ Warwick on Eden

i) The Strand – Clerk advised of previous work schedule at the pond and village green area, tenders had been requested from S. Nicholson and Longthwaite Garden Services. The situation to be reviewed at next meeting, tenders discussed at the Full Council meeting.

Cumwhinton

i) Play area development – Sovereign Playgrounds & Proludic, Playdale

submitted quotations and designs. Grant funding has been applied for, plus 106 agreements due following the new developments proposed for the village. Members felt that a Playground Management Committee should be formed before any further discussion took place.

Wetheral

i) Riverbank footpath River path 138008 – Following the removal of the bridge which produced safety issues, grounds man marked area with safety /warning tape. Clerk advised that a contractor had been appointed to tidy and make safe the area. The Environment Agency has no objections to the proposal to create a path and create a viewing platform. Clerk still needed to approach the Church Commissioners and Natural England prior to work being carried out. It was agreed that this was a popular beauty spot and would benefit from some tidying up. Members discussed future proposals for area, to be taken to a further meeting.

The Wetheral riverside path 138008 was badly eroded through Wetheral Woods towards the Cotehill Tower. Clerk advised National Trust who own this land had agreed to investigate and look into any problems on their land.

ii) Disabled access to Wetheral station – It is unlikely that any upgrades will be done owing to the lack of co-operation from Cumbria CC, or Carlisle CC. It will be maintained at the same level as budgets do not allow for any further work. Chairman reported that a lot of complaints were still being received re the path, lower down from where the previous remedial work had been carried out by the parish council. – Resolved Clerk to contact Cumbria CC to ask if they had any plans for this work to be carried out. Members recommended to full council for consideration that in the short term £500 should be spent to improve access to the station at this point, for the benefit of residents of the area.

iii) Ashgate Lane Cemetery Finger post – Clerk advised that new post had been ordered and would be fitted shortly.

iv) Wetheral Riverbank Litter Bin – New bin has been ordered the difference in the cost from a standard bin shall be paid by the parish council.

Great Corby/Heads Nook

i) Glen Willie Cottages – Flood damage – Contract awarded to McKnight & Son, permit required from Env. Agency. Work to commence when permit issued and river levels drop in spring.

Cotehill

i) Playing Field Fence – Clerk spoken with M Kennedy, advised that Com. Assoc will remove fence, they have been notified but unable to remove it at present as the ground is to wet.

ii) Playing Fields – Noted that additional grass cutting, weed clearance and hedge cutting on the playing field has been completed.

Warwick on Eden

i) Kissing Gate Jubilee Path – Clerk advised that the broken gate has been reported to Green spaces team, who have scheduled the work.

ii) Footpath 138002 (Proposed Permissive path across Golf Course) Chairman reported that after discussion with management of the golf course they felt unable to grant permission owing to the safety issues involved.

iii) Bus shelter at Warwick on Eden – requires cleaning.

ROW 27/12 Footpath Reports - update on the parish footpaths.

Wetheral - i) The footpath from the B road down to the station is in a really bad state on the stretch beyond where the repairs were made last year. Loads of complaints recently, high volume of bike traffic, it would be better if cyclists dismount when they are using the footpath. (see previous discussion)

ii) Footpath outside no. 64 Greenacres. There had been a large amount of debris and moss on the pavement causing a slip hazard. Clerk had reported to Carlisle CC and this had been resolved

iii) Parking on the grass verge on Plains Rd where it borders Faustin Hill. A joiners van has been parked completely covering the verge during the day. Members advised that if this continued to be a problem the local PCSO could be called to deal with this.

Cumwhinton – i) 138034 Member queried if this path was a footpath or bridleway. Horses have been reported using this path causing problems. Clerk to investigate

Warwick on Eden – Jubilee Path i) Gate -scheduled to be repaired by Green spaces team, Clerk to chase.

Leaning tree to be dealt with by landowner, right of way still passable. Clerk/land owner to speak with A. Nicholson re re-routing path to permissive path, to avoid wet patches, and problems with cattle on existing path.

ROW 28/12 Finger posts - Update from each village on the parish fingerposts.

Warwick on Eden – Jubilee Path, Warwick Farm entrance - A new post is needed, old post rotten and lying on ground.

Great Corby – Signpost at Coach House, Broadwath/Burnrigg crossing, Top Green is rusty, need cleaning & repainting.

Cotehill/Cumwhinton – Albion Cottages –

Scotby – Scotby Road, Park Road, Wetheral Road signs need cleaning

Broomfallen Rd to Scotby Shield footpath sign in hedge needs clearing around to make visible.

Scotby Rd / Newcastle – require cleaning

Wetheral – Road signs - Car Sign to Ferry Landing Road – require cleaning

Plains Road – Give Way Sign “ “
