Agency Workers

The Agency WorkersRegulationscome into force on 1 October 2011.An agency worker is someone who works for the University, under university supervision and direction, but who has a contract with, and is paid by, the temporary work agency or other provider who supplied them.

Information that departments may be asked to share with agencies and agency workers:

Rights from day one of an assignment

From the first day of the assignment in the University, agency workers are entitled to equal access to collective facilities provided be the department

Collective facilities:Canteen or staff common room,

Child care facilities,

Car parking,

Inter-site transport services,

Toilets and showers,

andany other similar facilitiesavailable to direct employees.

(Excludes: Off-site gym, season ticket loans, discount at shops)

The agency worker may need their employee number from core to access some of these facilities.

Internal and external vacancies:

Agency workersare entitled to be notified of anyjobvacancies in the University and to apply for posts that are advertised internally and externally.

After 12 weeks service

Agency workers who have accrued 12 weeks’ qualifying service are entitled to thesame basic terms and conditions as would apply to a staff member employed directly by the University to do the same or an equivalent job.

Pay

After 12 weeks' service an agency worker’s pay rate should be the same as that of a comparable university employee, taking account of the individual's experience and qualifications.

Salary scales:

This may be the pay for the grade of the substantive post for which they are providing temporary cover, or if the agency worker is not fulfilling the full duties of the substantive post, then the appropriate grade can be determined by reference to the generic grade and category descriptions.

The agency worker’s pay should include any relevant university allowances:

Annual leave

38 days leave per annum (pro rata), including public holidays and locally-agreed fixed closure days. (39 days pro rata in 2012)

In general the university leave year runs from October to September (for some departments it runs from January to December)

Agency workers are entitled to the same rest and lunch breaks as direct employees. This may vary according to the department.
