We reserve the right to cancel this rental agreement and retain your security deposit if you do not adhere to the payment schedule below:

Cancellation Policy: All cancellations must be in writing! Cancellations are considered received on the date we physically receive your notice in our office. * 61 calendar days or more before your check-in date=Full Refund * 30-60 calendar days before your check-in date=50% refund of all monies received * 0-29 calendar days before your check-in date=No Refund

In consideration of the monies received and mutual promises, contained herein, the Owner/Landlord of the subject property, through , Agent, West USA Realty, hereinafter “Broker”, does hereby lease and rent to Tenant the certain property described herein and under the following terms and conditions. Unit information, rental rate and other financial data is set forth on this lease.

I (We) hereby agree to vacate rented property no later than the hour and date shown above and to return the keys immediately to Broker. Before vacating, I (we) will clean the premises including:

Clean refrigerator. Leave no food or drink in it.

Empty all garbage into outside cans.

I (We) acknowledge there is a standard non-refundable cleaning fee on the property. There is no daily maid service.

In the event that a pet, house party or grilling on porches, patios, decks is found on the property during your stay and if they are not allowed per agreement, Landlord/Owner, through Broker, shall have the right to ask you to leave the property immediately with no refund of any monies paid.

Appliance malfunction or service requests for air conditioning, televisions, hot tubs, pools, appliances, etc…will be responded to as quickly as possible. There are no rebates or refunds issued to Tenant for any reason as every good faith effort is made to ensure the property is maintained to the highest standards.

I (We) agree to adhere to all HOA rules while staying at this property. I (We) agree to pay all fines that are incurred as a direct result of breaking any rules. Condos: Parking passes are inside unit and must be displayed in front window of auto during stay.

I (We) agree to maintain the property in the same condition in which it was found. I (We) agree to replace or pay for losses, breakage or damage should any occur.

This is a non-smoking property or condo. I (We) hereby agree all deposits will become non-refundable if any smoking occurs on property.

Locked Areas, for which Tenant is not provided a key, such as Landlord/Owner’s personal storage areas, are exempt from this rental agreement and are off limits to the Tenant. Forced entry into these areas is cause for immediate termination and Tenant will be charged for damage and/or missing items.

In the event the property I (we) are renting has access to a swimming pool, hot tub, pond, lake community pool, or any body of water, I (we) agree to supervise all children under 18 at all times.

The Tenant agrees to release and indemnify the Landlord/Owner and Broker from and against all liability, should anyone be injured on the property during the term of this rental agreement, resulting from any cause whatsoever.

Broker and Landlord/Owner shall not be responsible for damage or loss of Tenant’s personal property. There will be a $25.00 service charge plus shipping for any returned items.

The postal address of the property/condo is not to be used to receive mail of any nature. Tenant will not be given a mailbox key or access to any mailbox. Broker and Landlord/Owner are not liable for any mail and/or packages intended for Tenant.

Security Deposits will be refunded via check within 14 business days of check-out

Tenant acknowledges they have reviewed and understand the terms of this rental agreement and agree to be bound thereby.

We recognize that violation of the terms of this rental agreement shall constitute the right of termination pursuant to West USA Realty’ Vacation Rental Agreement. We further agree to be responsible for all COSTS and EXPENSES due to any damage caused by or on account of our pet(s). We recognize that pet hair on furnishings will be considered damage.
