RSPCA v Hamilton – Local Court

In the case ‘RSPCA v Hamilton’, the Paul Hamilton was charged with unjust treatment to thousands of animals. The animals were kept contained and their blood was supposedly used in pharmaceutical products. When Hamilton’s facility was visited by officers from the RSPCA, they saw that the animals were living in very poor conditions and it was very crowded. The animals were all malnourished and were had little water to survive on.

After a long time of cruel treatment to the animals, Paul Hamilton was finally charged under the Prevention of Cruelty to Animals Act 1979 (NSW).

R v McKenna, R v Benischke – Intermediary Court

In Maroubra, August 2003, a man was attacked while his five week old baby was harnessed across his neck. The attackers claimed that they didn’t know the baby was present which resulted in a fractured skull. The attackers were charged for the assault on the man but not on the baby. When they were trialled at the District Court, they were found guilty for the assault on both the father and child.

R v Webster – Superior Court

A 14 year old girl, Leigh Leigh was the victim of a gang rape and murder. She was on her way to attend a party at the local surf club for a sixteenth birthday party. While she was still at the party, she was raped and murdered. Her body was found lying in the nearby sand dunes on the following morning of the party. Matthew Webster was charged for the rape and murder of Leigh however it was believed that more than one person was involved. He pleaded guilty and was sent to prison.
