WHEREASa portion of SW-26-53-25-4; located north of 137 Avenue NW and east of 156 Street NW, Mistatim Industrial, Edmonton, Alberta, is specified on the Zoning Map as(AGI) Industrial Reserve Zone; and

WHEREAS an application was made to rezone the above described property to(IB) Industrial Business Zone and (PU) Public Utility Zone;

NOW THEREFORE after due compliance with the relevant provisions of the Municipal Government Act RSA 2000, ch. M-26, as amended, the Municipal Council of the City of Edmonton duly assembled enacts as follows:

  1. The Zoning Map, being Part III to Bylaw 12800 The Edmonton Zoning Bylaw is hereby amended by rezoning the lands legally described as a portion of SW-26-53-25-4; located north of 137 Avenue NW and east of 156 Street NW, Mistatim Industrial, Edmonton, Alberta, which lands are shown on the sketch plan annexed hereto as Schedule “A”, from (AGI) Industrial Reserve Zone to (IB) Industrial Business Zone and (PU) Public Utility Zone.

DISCUSSION

1.The Application

This application will rezone a 45hectare site from (AGI) Industrial reserve Zone to (IB) Industrial Business Zone and (PU) Public Utility Zone. The proposed rezoning will allow for light and business industrial uses and a storm water management facility necessary to service the proposed development.

An associated subdivision application was submitted and is under review by the Administration to create a lot for the storm water management facility and a number of industrial parcels.

2.Site and Surrounding Area

The site is bordered byarterial roadways 137 Ave, 156 St and Mark Messier Trail to the south, west and east respectively. The south east corner of the site abuts an undeveloped parcel zoned (CHY) Highway Commercial and (IB) Business Industrial Zone. There is a site in the southwest corner of the site zoned (IB) Business Industrial Zone and it is occupied by a longstanding vehicle sales/rental use.

To the west across 156 Street is a golf course and vacant land zoned (AGI) Industrial Reserve. Abutting the site along the north property line properties zoned (IB) Business Industrial with two sites abutting the applicant’s site occupied by a vehicle sales/rental use.

ANALYSIS

1.Compliance with Approved Plans and Land Use Compatibility

The site lies within the boundary of the Mistatim Area Structure Plan (ASP). The proposed development is in compliance with the Mistatim ASP which identifies this area for Industrial Business. The Area Structure Plan also proposes that special design guidelines be considered for coordinating development, streetscape and site landscaping adjacent to the Mark MessierTrail, which can be addressed through subdivision and development permit requirements.

Given that the Mistatim ASP designates this quadrant of the plan area for business industrial uses, the IB zone is appropriate in that it provides for high quality development and minimal industrial nuisances along major arterial roads. The proposed IB zone has frontage on three arterial roadwayswhich also provides opportunities for businesses which desire higher visibility and require better access.

The area is also governed by the Major Commercial Corridors Overlay for sites abutting Mark Messier Trail. The application of the Overlay will ensure that development along these commercial corridors is visually attractive and that due consideration is given to pedestrian and traffic safety. It also contains specific landscape, architectural and design considerations for all development.

In all, the proposed rezoning is compatible with the surrounding areas that are planned and zoned for medium and business industrial uses. This application will permit the development of the property as a fully serviced area capable of accommodating a range of light and industrial business use opportunities.

  1. Smart Choices

The application of Smart Choice Principles is not applicable given the nature of this proposal.

3.Environmental Review

The applicant submitted a Phase 1 Environmental Site Assessment for the lot subject to the rezoning. The Planning and Development Department, the Transportation and Streets Department, Capital Health and Alberta Environment have accepted the information and deemed the site environmentally suitable for industrial business development.

4.Transportation and Utilities

The Transportation Department expressed no objection to the proposed rezoning and advised that Arterial Roadway Assessments are owing and that the owner will be required to dedicate and construct the collector roadway network and intersection improvements, and provide additional road right of way on 137 Ave, 156 St., and Mark Messier Trail. These requirements will be addressed through subdivision and development permit requirements.

No other City Departments or utility agencies have expressed concerns or objections regarding these bylaws.

5.Surrounding Property Owners’ Concerns

Advance notification letters were mailed to the surrounding 20 property owners and the President, Cumberland/Oxford Community League (COCL) on March 18, 2008. The Planning and Development Department did not receive any objections to this proposal.

JUSTIFICATION

The Planning and Development Department recommends that Bylaw14930 be APPROVED on the basis that the application complies with Mistatim Area Structure Plan and the proposed uses are appropriate for this area.
