H.B. No. 1586

AN ACT

relating to property, facilities, and equipment of the Culberson County Hospital District.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION1. Sections 5.06(b)(d), Chapter 515, Acts of the 69th Legislature, Regular Session, 1985, are amended to read as follows:

(b)The board may lease or acquire property, facilities, and equipment for the use of the district [for use in the hospital system] and may mortgage or pledge the property, facilities, or equipment [acquired] as security for the payment of the purchase price.

(c)The board may sell, lease, or otherwise dispose of property, [hospital] facilities, or equipment on behalf of the district. Sale or other disposal of the property, facilities, or equipment must be at a public sale and at a price and on the terms the board determines are most advantageous to the district.

(d)The board may donate to another governmental entity or to a charitable organization any surplus personal property or equipment if the donation serves a public purpose and is accompanied by adequate consideration [sell or otherwise dispose of property, facilities, or equipment on behalf of the district].

SECTION2. This Act takes effect immediately if it receives a vote of twothirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2001.
