Regulations on Ranges of Nominal Quantities of Pre-packaged Products and Nominal Capacities of Packages

Issued pursuant to Section 10, Paragraph three

of the Law On Uniformity of Measurements

1. These Regulations set out the ranges of nominal quantities of pre-packaged products and nominal capacities of packages.

2. These Regulations shall apply to the products referred to in Annexes 1, 2 and 3 that are put up in closed packages in fixed nominal quantities of not less than 5 grams or 5 millilitres and not more than 10 kilograms or 10 litres, as well as to knitting yarn referred to in Annex 1, Paragraph 12 of these Regulations that is not put up in closed packages. These Regulations shall not apply to pre-packaged products which are intended for professional use only.

3. The products referred to in Paragraph 2 of these Regulations shall be divided into products that are sold as follows:

3.1. by weight or volume of the product (except for pre-packages referred to in Sub-paragraphs 3.2 and 3.3 of these Regulations). The ranges of the nominal quantity of each pre-package are set out in Annex 1 to these Regulations;

3.2. by weight or volume of the product and put up in rigid containers (except for products set out in Annex 1 to these Regulations). The permissible ranges for the capacity of packages are set out in Annex 2 to these Regulations; and

3.3. in aerosol form. The volumes of the liquid phase of products and, if the products are put up in metal aerosol containers, the capacity of containers is set out in Annex 3 to these Regulations.

4. If the pre-packaged products are food products referred to in Annex 1, Sub-paragraphs 1.4.1, 3.1, 3.2 and 3.5, or knitting yarn referred to in Paragraph 12 of these Regulations, such products shall be distributed in Latvia only in such nominal quantities, the values of which are set out in Annex 1 to these Regulations. Other ranges of nominal quantities of pre-packaged products and nominal capacities of packages set out in the annexes are recommended ranges.

5. On the package of a pre-packaged product, the nominal weight of the product or the nominal volume of the product shall be indicated in accordance with procedures prescribed by regulatory enactments. In the cases referred to in Sub-paragraphs 3.2 and 3.3 of these Regulations, the nominal capacity of the container shall also be indicated in accordance with the requirements specified in Annex 2 and in Paragraph 1 of Annex 3 to these Regulations.

6. If a multipack is made up of two or more separate pre-packages, the range of values listed in Annexes 1, 2 and 3 to these Regulations shall apply to the separate pre-packages.

7. If a pre-package is made up of two or more separate packages that are not intended to be sold separately, the range of values listed in Annexes 1, 2 and 3 to these Regulations shall apply to the whole pre-package.

8. The State Metrological Inspection and other supervisory and control institutions whose competence includes the protection of consumer rights in relevant fields shall control compliance with the standards prescribed by these Regulations.

9. These Regulations shall come into force on 1 January 2002.

Ranges of Nominal Quantities of Pre-packages

1. Food products sold by weight (quantity in grams):

1.1. butter (commodities position 0405 of the Combined Nomenclature of Latvia (hereinafter – nomenclature), margarine, emulsified fats or non-animal fats and vegetable fats (low fat spreads):125; 250; 500; 1 000; 1 500; 2 000; 2 500; 5 000;

1.2. fresh cheese, except ‘petits suisses’ and other cheeses put up in the same way (nomenclature position 040610): 62,5; 125; 250; 500; 1 000; 2 000; 5 000;

1.3. table salt and cooking salt (nomenclature position 2501): 125; 250; 500; 750; 1 000; 1 500; 5 000;

1.4. sugar:

2.1. ice cream in quantities of more than 250 ml (excluding ice cream the volume of which is not determined by the shape of the container): 300; 500; 750; 1 000; 1 500; 2 000; 2 500; 3 000; 4 000; 5 000.

3. Liquid food products sold by volume (quantity in millilitres):

3.1. fresh grape wine; not wholly fermented grape-wine the fermentation of which is stopped by adding alcohol, also wines obtained from unfermented grape juice mixed with alcohol, excluding wines included in nomenclature positions 2205, 220410, 220421 and 220429, and dessert wines (nomenclature position 2204); grape-must the fermentation of which is stopped by means other than adding alcohol (nomenclature position 220430):

3.1.1. 0.10; 0.187; 0.25; 0.375; 0.50; 0.75; 1; 1,5; 2; 3; 4; 5; 6; 8; 9; 10; and

3.1.2. 0,45; 0,7 (ranges additionally permissible for distribution in Latvia);

3.12. milk, without added sugar and not concentrated (nomenclature position 0401), excluding yoghurt, kefir, curdled milk, whey and other milk beverages obtained through a process of fermentation or spontaneous fermentation. Beverages based on milk (nomenclature position 0403): 0.20; 0.25; 0.50; 0.75; 1; 2;

3.13. water, including mineral water and carbonated water (nomenclature position 2201): 0.125; 0.20; 0.25; 0.33; 0.50; 0.75; 1; 1,5; 2;

3.14. lemonade, aromatised mineral water, aromatised carbonated water and other non-alcoholic beverages which do not contain milk or milk fat (nomenclature position 2202), excluding fruit and vegetable juices included in nomenclature position 2209 and concentrates: 0.125; 0.20; 0.25; 0.33; 0.50; 0.75; 1; 1.5; 2;

3.15. beverages labelled as non-alcoholic aperitifs: 0.10; and

5. Ready-to-use paints and varnishes (with or without added solvents) in conformity with positions 3208, 3209 and 3210 of the nomenclature, excluding dispersed pigments and solutions (quantity in millilitres): 25; 50; 125; 250; 375; 500; 750; 1 000; 2 000; 2 500; 4 000; 5000; 10 000.

6. Solid or powdered glues and adhesives (quantity in grams): 25; 50; 125; 250; 500; 1 000; 2 500; 5 000; 8 000; 10 000.

7. Cleaning and care products (quantity of solids and powders expressed in grams; quantity of liquids and pastes in millilitres):

7.1. cleaning and care products for leather and footwear, for wood and floor coverings, for ovens and metals including cars, for windows and mirrors including windows and mirrors of cars (nomenclature position 3405); stain removers, starches and dyes for household use (nomenclature positions 3809 and 3212), household insecticides (nomenclature position 3808), descalers (nomenclature position 3402), household deodorisers (nomenclature position 3307) and non-pharmaceutical disinfectants: 25; 50; 75; 100; 150; 200; 250; 375; 500; 750; 1 000; 1 500; 2 000; 5 000; 10 000.

8. Cosmetics: beauty and toilet preparations (nomenclature positions 3304-3307) (quantity of solids and powders expressed in grams; quantity of liquids and pastes in millilitres):

8.1. skin-care and hygiene products, shaving creams, all-purpose creams and lotions, hand creams and lotions, sun protection products, oral hygiene products (excluding toothpaste): 15; 30; 40; 50; 75; 100; 125; 150; 200; 250; 300; 400; 500; 1 000;

8.2. toothpaste: 25; 50; 75; 100; 125; 150; 200; 250; 300;

8.3. hair-care products (except dyes) and bath and shower products:
