CIRCULAR

Regulations on list of products and goods liable to cause unsafenessunder the management responsibilities of the Ministry of Information and Communications

Pursuant to Law on products and goods quality dated November 21st 2007;

Pursuant to Law on Telecommunications dated November 23rd, 2009;

Pursuant to Decree No 132/2008/NĐ-CP dated December 31st 2008 of the Government, defining details for implementation of a number of articles of Law on products and goods quality;

Pursuant to Decree No. 25/2011/NĐ-CP dated April 06 2011 of the Government, detailing and guiding the implementation of a number of articles of Law on Telecommunications;

Pursuant to Decree No.132/2008/ND-CP dated December 31st, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Information and Communications;

At the proposal of Director General of Department of Science and Technology;

Minister of Information and Communications issues the Circular prescribing Regulation on list of products and goods with ability of causing unsafe in management responsibilities of Ministry of Information and Communications.

Article 1. Scope of adjustment

This circular stipulates a list of products and goods with liability of causing unsafenessunder the management responsibilities of the Ministry of Information and Communications (hereafter called as List of products and goods in group 2).

Article 2. Subject of application

This circular is applied to national organizations and individuals and foreign organizations and individuals attending the production and business of products and goods in List of products and goods in group 2 in Vietnam and organizations and individuals attending activities related to products and goods quality in group 2 in Vietnam.

Article 3. List of products and goods in group 2

1. List of products and goods in group 2 and the management procedures are defined in the following Appendix:

a)“List of products and goods in information technology and telecommunication industries certified and announce the conformity” is defined in Appendix I of this Circular.

b)““List of products and goods in information technology and telecommunication industries certified and announced the conformity” is defined in Appendix II of this Circular.

1. In each period, Ministry of Information and Communications considers, amends and supplies List of products and goods in accordance with State management policies.

Article 4. Management Principles

1. The management of products and goods quality in List of products and goods in group 2 defined in this Circular is implemented in accordance with national technical regulations and standards.

The management of products and goods quality in List of products and goods in group 2 mentioned in Appendix I and II of this Circular is implemented in accordance with Circular No 30/2011/TT-BTTTT dated October 31st 2011 bythe Minister of Information and Communications on Regulations on certifying and announcing conformity for products and goods in information technology and telecommunication industries.

Article 5. Provisions of implementation

1. This circular takes effect from May 05th 2014 and replaces Circular No 20/2011/TT-BTTTT dated July 01st 2011 of Minister of Information and Communications on Regulation of List of products and goods with liability of causing unsafeness in management responsibilities of Ministry of Information and Communications; Circular No 31/2011/TT-BTTTT dated October 31st 2011 of Minister of Information and Communications, issuing List of products and goods in information technology and telecommunication industries announced conformity and Circular No 32/2011/TT-BTTTT dated October 31st 2011 of Minister of Information and Communications, issuing List of products and goods in information technology and telecommunication industries certified and announced the conformity.

1. Chief of Office, Director General of Department of Science and Technology, Directors of Departments of Telecommunications, Head of agencies and units ofthe Ministry of Information and Communications , relevant organizations and individuals shall be responsible for the implementation of this Circular./.

1. During the process of implementation, if there are any problems and difficulties, agencies, organizations and individuals notify promptly Ministry of Information and Communications for considering and resolving.
