Regulations Governing Management of Metrological Technical Personnel

Article 1

These Regulations are enacted pursuant to Paragraph Three, Article 8 of the Weights and Measures Act.

Article 2

The qualifications of metrological technical personnel shall be determined by way of examination and practical training, and are divided into two grades, namely metrological specialist and metrological technician.

Article 3

A person who meets any of the following qualification requirements may attend the examination for metrological specialist:

  1. Graduate from a public or registered private college, or a foreign college acknowledged by the Ministry of Education, or a school of higher grade; or
  2. Hold a certificate of metrological technician, have been engaged in the related jobs for three years, and have certification documents proving such working experiences.

Article 4

A person who meets any of the following qualification requirements may attend the examination for metrological technician:

  1. Graduate from a public or registered private senior high school, senior vocational school, or a school of higher grade; or
  2. Hold a certificate produced by the administrative department in charge of education to prove the certificate holder has the educational level equivalent to the graduates of senior high school or senior vocational school.

Article 5

Under any of the following circumstances, a person may not act as metrological technical personnel:

  1. Where the person is convicted, per a final judgment, to have committed the offense of falsifying weights and measures as defined in The Criminal Code, and execution of the punishment is pending or has not been completed, or the time elapsed after execution or remission of the punishment is less than one year;
  2. Where the person is under prohibition from property management, and the prohibition has not been cancelled yet;
  3. Where the person is proved, by a public hospital, mentally disabled; or
  4. Where the person has once assumed public official and is dismissed from his post, and the period of prohibition from reappointment has not expired yet.

Article 6

Upon signing up to attend the examination, a candidate shall fill in a sign-up sheet, pay the sign-up fee, and submit the following documents to the department in charge of examination affairs by way of correspondence:

  1. Photocopy of qualification certificate;
  2. Photocopy of ID card; and
  3. Four two-inch front half-body photos taken within the latest three months.

Where an application for sign-up referred to in the preceding Paragraph is deemed as unqualified, a time limit shall be set for correction; in case correction is not finished within the specified time limit, the application shall be rejected.

Matters regarding the examination for metrological technical personnel shall be handled by the dedicated weights and measures authority; when necessary, the authority may commission any other government agencies (institutions) or organizations to deal with such matters.

Article 7

Examinations for metrological technical personnel shall be held once every year or every two years; when necessary, temporary examinations may be held.

The examination referred to in the preceding Paragraph shall adopt the form of written examination, and the examination courses or the types of questions are as shown in the annexed Table 1. A candidate will pass the written examination if he achieves a total average score of 60 or above of all the examination courses; in case zero is scored in any examined course, the candidate will fail the examination.

The candidates may apply to the department in charge of examination affairs to check up the scores he got.

Article 8

A person who has passed the examination for metrological technical personnel shall complete the practical training within six months after the scores are publicized. In case the person cannot complete the practical training due to serious illness or accidents, he may submit the evidential papers to the dedicated weights and measures authority to apply for extension. Where application for extension is not filed, or application is rejected, or the candidate doesn’t pass the practical training, the qualification as having passed examination will be cancelled.

Items, hours and trainer of the practical training referred to in the preceding Paragraph shall be designated by the dedicated weights and measures authority.

A candidate, who has passed the examination for metrological technical personnel and has once worked in the practices related to the verification and inspection of measuring instrument for three years, may submit the certificates proving the related working experiences, within one month after the scores of examination are publicized, to the dedicated weights and measures authority to apply for exemption from the practical training in respect of the items related to the work in which he has once been engaged.

Article 9

Where a candidate cheats or uses any other undue measure and thus causing incorrect result in examination or practical training, the dedicated weights and measures authority shall cancel the qualification of the candidate as having passed the examination or practical training.

Article 10

A person who has passed the practical training in accordance with Article 8 or is exempted from practical training may prepare an application form, and submit it together with the certificate fee to the dedicated weights and measures authority to apply for a certificate. Where the application is deemed unqualified, a time limit may be set for correction; in case correction is not accomplished within the specified time limit, the applicate shall be rejected and the certificate fee handed back.

After the application referred to the preceding Paragraph is deemed as qualified in examination by the dedicated weights and measures authority and a certificate for metrological technical personnel is issued, the metrological technical personnel may start to conduct metrological activities. The validity period of the certificate is five years, commencing from the day of issuance.

A certificate for metrological technical personnel as referred to in the preceding Paragraph shall define the category of measuring instrument in respect of the items of practical training which the applicant passes or is exempted from, and the metrological technical personnel may not conduct metrological activities beyond the aforesaid category.

The metrological technical personnel may, within the validity period of the certificate, attend any other practical training courses beyond the scope prescribed in the certificate; and if passes the training, may prepare an application form, and submit it together with the certificate fee, the original certificate and two two-inch front half-body photos taken within the latest three months to the dedicated weights and measures authority, to apply for addition of category and replacement of certificate. The validity period of the replacement certificate shall be the same as that of the original certificate.

Article 11

Metrological technical personnel shall accept continuous education relating to metrology, and the accumulated scores shall be not less than one hundred points in five years.

The implementation method and scores of the continuous education referred to in the preceding Paragraph are as follows:

  1. Attend the tuitionary courses held by schools, unions, academy, associations, education training or research institutes, or the dedicated weights and measures authority as a student, one point per hour; as the teacher, five points per hour;
  2. Attend related academic seminar, one point per hour; publish a paper or wall newspaper, three points per article for the first author, one point for other authors; act as instructor or lecturer, five points every time;
  3. Take part in teaching activities like visit or theme speech, one point per hour; act as the major reporter or lecturer, three points every time;
  4. Publish articles on domestic and foreign metrological journals, fifteen points per article for the first author, five points for the second author, and two points for other authors; publish case study reports, five points per article

Recognition of the continuous education referred to in the preceding Paragraph shall be conducted by the dedicated weights and measures authority.

Article 12

The metrological technical personnel may, within the three months one month before the validity period of the certificate expires, prepare an application form, submit it together with the certificate fee, two 2-inch front half-body photos taken within the latest three months, and photocopy of the continuous education certificates to the dedicated weights and measures authority to apply for extension; where the application is examined and deemed as qualified, a replacement certificate shall be issued.

The validity period of the replacement certificate referred to in the preceding Paragraph shall be five years commencing from the day following expiration of the original certificate. However, where application is not filed within the three months one month before expiration and the replacement is not completed within the validity period of the original certificate, the validity period of the replacement certificate shall be five years commencing from the day of issuance.

Article 13

When conducting metrological activities, the metrological technical personnel shall prepare a business register book to record in detail the name and address of the consignor, the commissioned matters and the implementation, for the dedicated weights and measures authority to conduct audit.

The business register book referred to in the preceding Paragraph shall be stored for not less than five years.

Article 14

The metrological technical personnel shall observe the principle of honesty and credit in conducting metrological activities, and may not commit any of the following conducts:

  1. Conduct metrological activities with violating law;
  2. Allow anyone else to conduct metrological activities on behalf of him;
  3. Canvass business by undue means; or
  4. Discover any secret known on account of business to anyone else without any due reason.

Article 15

The dedicated weights and measures authority may supervise and audit the metrological activities conducted by the metrological technical personnel; and when necessary, may require them to make a report or provide relevant documents, and the metrological technical personnel may not evade, hinder or refuse to do so without any due reason shown.

Article 16

Under any of the following circumstances, the dedicated weights and measures authority shall cancel the certificate of a metrological technician or specialist:

  1. Where the technician/specialist conforms to any of the circumstances prescribed in Article 5 before having obtained the certificate;
  2. Where the technician/specialist obtains the certificate by providing false data; or
  3. Where the qualification of the technician/specialist as having passed examination or practical training is cancelled in accordance with Article 9

Article 17

Under any of the following circumstances, the dedicated weights and measures authority shall notify the metrological technician/specialist to correct his/her misconduct within a given time limit:

  1. Where the technician/specialist violates the provision of Article 13, or makes any false recording in the business register book; or
  2. Where the technician/specialist evades, hinders or refuses supervision and audit, with violating the provision of Article 15.

Article 18

Under any of the following circumstances, the dedicated weights and measures authority shall abolish the certificate of a metrological technician/specialist:

  1. Where the technician/specialist conforms to any of the circumstances prescribed in Article 5 after having obtained the certificate;
  2. Where the technician/specialist conducts any metrological activities beyond the category recorded in the certificate, with violating the provision of Paragraph Three, Article 10;
  3. Where the technician/specialist conforms to any of the circumstances prescribed in Article 14; or
  4. Where the technician/specialist doesn’t correct his/her misconduct within a time limit specified in accordance with the preceding Article.

Where the certificate of metrological technical personnel is abolished in accordance with the preceding Paragraph under any of the circumstances prescribed in Subparagraphs 2~4 of Article 5, an application may be filed, after the cause for abolishment is eliminated and within the validity period of the original certificate, for issuance of a new certificate; and the validity period of the new certificate shall be the same as that of the original one.

Article 19

A metrological technician/specialist, whose certificate is cancelled or abolished, shall stop metrological activities after having received the advice note of cancellation or abolishment, and hand back the certificate within a specified time limit; in case the certificate is not handed back, the dedicated weights and measures authority shall directly give a public notice to write it off.

A metrological technician/specialist, whose certificate is cancelled or abolished in accordance with Article 16 or Paragraph One of Article 18, may not attend the examination for metrological technical personnel within three years.

Article 20

In case of loss or damage of a certificate, the metrological technician/specialist may prepare an application, and submit it together with the certificate fee and two 2-inch front half-body photos taken within the latest three months to the dedicated weights and measures authority, to apply for re-issuance or replacement.

Article 21

The dedicated weights and measures authority shall charge sign-up fee when holding examination for metrological technical personnel in accordance with these Regulations.

Article 22

The date of enforcement of these Regulations shall be determined by the competent authority.

Annexed Table 1 List of Examination Courses for Metrological Technical Personnel

Class / Examination courses
Metrological specialist / 1. Metrological laws and administration (including the Weights and Measures Act and other relevant regulations, metrological administrative organization, tasks of metrological personnel, current status and trend of the metrological industry, international system of units).
2. Quality management (including laboratory quality management, quality control, measurement traceability, measurement audit, practical application of calibration report, reliability basics).
3. Measurement uncertainty.
Metrological technician / 1. Basics of metrological laws and regulations (including the Weights and Measures Act and other relevant regulations).
2. Basics of measurement administration (including the basic metrological concepts and their evolvement, measuring standards and tracing, legal measuring units, laboratory quality management, statistical method, and practical application of calibration report)
3. Basics of measurement uncertainty.
Remark / 1. For metrological specialists, examination mixed with objective and essay test shall be adopted for the "metrological laws and administration" course, and examination mixed with objective test and essay test and computation adopted for "Quality Management" and "Measurement Uncertainty" courses.
2. For metrological technicians, examination shall be adopted for the "Basics of metrological laws and regulations", "Basics of metrological administration" and "Basics of measurement uncertainty" courses.
