Having regard to Council Regulation (EC) No 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein (OJ 1997, L 61);

Having regard to Council Regulation (EC) No 939/97 of 26 May 1997 laying down detailed rules concerning the implementation of Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein (OJ L 140);

Having regard to Article 102 of the Flora and Fauna Act;

Having regard to Article 6, paragraph 2 and Article 7 of the Decree on the dispensation of protected animal and plant species;

Having regard to Article 12, paragraph 1, subsections a and b and Article 13, paragraph 1 of the Regulation on the dispensation of protected animal and plant species pursuant to the Flora and Fauna Act;

DECREES:

Section 1 General provisions

Article 1

For the purposes of this Regulation, the following definitions shall apply:

a. basic Regulation: Council Regulation (EC) No 338/97 of 9 December 1996 on the protection of species of wild fauna and flora by regulating trade therein (OJ 1997, L 61);

b. implementing Regulation: Council Regulation (EC) No 939/97 of 26 May 1997 laying down detailed rules concerning the implementation of Council Regulation (EC) No 338/97 on the protection of species of wild fauna and flora by regulating trade therein (OJ L 140);

c. Act: Flora and Fauna Act;

d. the Minister: the Minister for Agriculture, Nature Management and Fisheries;

e. closed leg ring: individually marked, unbroken ring or sleeve, without any seam or weld, which has not been tampered with in any way and whose format is such that, after being fitted in the bird’s first days of life, it cannot be removed once the bird’s leg has attained its final size.

Article 2

This Regulation shall apply to:

a. bred birds belonging to protected native animal species, and

b. bred birds belonging to protected exotic animal species, in so far as these species are listed in Annex A to the basic Regulation.

Section 2 Rings and identifying marks

Article 3

  1. Closed leg rings issued in the Netherlands shall meet the following requirements:
  2. rings with a diameter of 2.5 - 2.9 mm, measured on the inside of the ring, shall be made from metal, to which an anodised colour layer has been applied, and shall be provided with a fracture zone such that the ring snaps if stretched;
  3. rings with a diameter of less than 2.5 mm and more than 2.9 mm, measured on the inside of the ring, shall be made from metal, to which an anodised colour layer has been applied, or shall be made from coloured plastic, and shall be of such quality that the ring snaps if stretched.
  4. Notwithstanding paragraph 1, rings for parrot-like birds and birds of prey shall be made from stainless steel.
  5. A closed leg ring as referred to in paragraph 1 shall be provided with a colour layer that differs for each year in which the ring may be applied.
  6. The organisations referred to in Article 8 shall solely supply closed leg rings for which the supplier has issued a written guarantee that the rings meet the specifications as referred to in paragraph 1, subsection a or b.

Article 4

A closed leg ring issued in the Netherlands shall bear at least the letters NL, a designation of the internal diameter accurate to tenths of a millimetre, the last two figures of the year in which the ring may be fitted and, for each ring size, a unique number.

Article 5

An example of species of birds listed in Annex 1 to this Regulation that has been born and bred in captivity in the Netherlands shall be fitted with a closed leg ring issued in the Netherlands with, where specified, a maximum diameter laid down in that Annex.

Article 6

An identifying mark as referred to in Article 7 of the Decree on the dispensation of protected animal and plant species shall meet the following requirements:

a. the identifying mark shall be demonstrably legitimately issued by a government body of a State other than the Netherlands or by an organisation recognised by a State other than the Netherlands;

b. the identifying mark shall be applied and used in accordance with the statutory requirements of the State in question.

Section 3 Application for closed leg rings

Article 7

1. Closed leg rings for birds born and bred in the Netherlands may be applied for from a recognised organisation as referred to in Article 8, paragraph 1 by completion of an application form set out in Annex 2 to this Regulation.

2. The required ring size and the desired number of examples shall be stated in the application form set out in Annex 2.

3. Incomplete, unclear or unsigned forms shall not processed.

Article 8

1. The following bodies shall be designated as recognised organisations endowed with legal personality as referred to in Article 102, paragraph 1 of the Act and entrusted with the issue of closed leg rings:
- General Dutch Federation of Bird Keepers, with registered office in Zutphen;
- Dutch Federation of Poultry, Dwarf Hen, Tropical Bird and Waterfowl Keepers, with registered office in Utrecht;
- Dutch Federation of Bird Lovers, with registered office in Bergen op Zoom;
- Aviornis International Netherlands Association, with registered office in Wijchen;
- Association for the Promotion of European Cultivated Bird Interests, with registered office in Eindhoven.

2. The recognised organisations referred to in paragraph 1 shall keep records up to date listing the numbers and codes of closed leg rings supplied by them, the date of issue and also the names and addresses of the persons to whom the closed leg rings have been supplied.

3. Records as referred to in paragraph 2 shall be kept for a period of at least 5 years.

4. The recognised organisations referred to in paragraph 1 shall each year submit full records for the previous year to the Minister by 1 February.

5. The recognised organisations as referred to in paragraph 1 shall provide the Minister, if requested, with full information relating to the issue of closed leg rings.

Article 9

1. The cost price charged to recognised organisations for the manufacture of closed leg rings shall be passed on to the applicant.

2. The recognised organisations may increase the cost price referred to in paragraph 1 by an amount to cover the costs of the issue of rings, to a sum not exceeding € 1.00 per ring.

3. Closed leg rings shall only be issued following payment of the sum of the amounts referred to in paragraphs 1 and 2.

Section 4 Transitional and final provisions

Article 10

The amount laid down in Article 9 of this Regulation shall apply with effect from 1 January 2002. For the period up to 1 January 2002, the equivalent amount in guilders at the rate of NLG 2.20 shall apply in accordance with the conversion rate of € 1 = NLG 2.20371.

Article 11

A ring or other identifying mark that has been legitimately applied prior to the entry into force of this Regulation and, where applicable, is in conformity with the basic Regulation and the implementing Regulation shall be deemed to constitute a ring or identifying mark as referred to in this Regulation.

Article 12

This Regulation shall come into force with effect from …..

Article 13

This Regulation shall be quoted as: Regulation on the issue and marking of leg rings and other identifying marks.

This Regulation shall be published with the explanatory memorandum in the Government Gazette.
