Supervisor Meyers called to order the Regular Town Board and Water Board Meeting and presided over same.

#1 On Agenda – MINUTES

Motion by Councilman Finnegan, seconded by Councilwoman Mullarkey that the Town Board of the Town of New Windsor approve the Minutes of the Public Hearing regarding the Orange County Community Development FY-01 Program, the Public Hearing regarding the Proposed Town Wide Drainage Project Phase III, the Public Hearing regarding the Proposed Zoning Amendments to Chapter 48 Use/Bulk Table – Accessory Parking, and the Regular Town Board and Water Board Meeting all held on June 7, 2000, also approve the Minutes of the Special Town Board Meeting held on June 15, 2000, as per the copies posted on the Town Clerk’s bulletin board in the Town Hall and same distributed to each of the Town Board Members.

Hearing no objections, the Town Board of the Town of new Windsor receive and file with the Town Clerk a Notice of Claim in the matter of Mary Fakler and Helmut Fakler against the Town of New Windsor. Same being referred to the Attorney for the Town.

#3 On Agenda – Motion-Rescind Motion Entitled “Authorization to Advertise for

Sealed Bids – 2000 Curb Replacement Project”, #2 on T/B Agenda

Dated June 15, 2000 (Special T/B Meeting)

Motion by Councilwoman Mullarkey, seconded by Councilman Finnegan that the Town Board of the Town of New Windsor rescind the motion entitled “Authorization to advertise for sealed bids – 2000 Curb Replacement Project,” #2 on the Town Board agenda, Special Town Board Meeting held on June 15, 2000.

#4 On Agenda – Motion-Award Bid-2000 Street Rehabilitation Project

Motion by Councilwoman Townsend, seconded by Councilman Finnegan that the Town Board of the Town of New Windsor award the Bid for the 2000 Street Rehabilitation Project to Hudson Valley Asphalt, PO Box 2068, 2 Argenio Drive, Newburgh, New York representing the lowest qualified bidder, in the amount of $535,097.50.

#5 On Agenda – Motion-Authorization for Supervisor to Execute Agreement

TNW & Moores Hill Estates, Inc., Sewer Allocation Agreement

4,550 MGD – 34-2-17.4

Motion by Councilman Finnegan, seconded by Councilwoman Mullarkey that the Town Board of the Town of New Windsor authorize the Supervisor to execute an agreement between MOORES HILL ESTATES, INC. and TOWN OF NEW WINDSOR regarding 4,550 gpd of Majestic sanitary sewer allocation to service 13 single-family residential units in the Moores Hill Estates Subdivision (34-2-17.4).

#6 On Agenda – Motion-Authorization-TV Camera Evaluation of SD #20 Area

Infiltration & Inflow Studies

Motion by Councilwoman Townsend, seconded by Councilman Finnegan that the Town Board of the Town of New Windsor authorize the allocation of funds from Sewer District #20 for the benefit of NYS DOT property for infiltration and inflow study action.

WHEREAS, the Engineer for the Town has determined that evaluation of sewer lines at Stewart International Airport need to be evaluated by TV camera, specifically certain lands owned by NYS DOT; and

WHEREAS, funds are available in the Sewer District #20 account; and

WHEREAS, the benefit area is limited to the NYS DOT lands at StewartInternationalAirport on the east side of Breunig Road.

NOW, THEREFORE, BE IT RESOLVED that the Town of New Windsor with the assistance of Camo Pollution Control, Inc. undertake the TV evaluation of the sewer collection system at StewartInternationalAirport on or after July 7, 2000.

BE IT FURTHER RESOLVED that the cost of the evaluation be charged to Sewer District #20, and specifically the benefit area which is the lands of the NYS DOT.

BE IT FURTHER RESOLVED that the Engineer for the Town is directed to review the results and make further recommendation to the Town Board as to how to correct the infiltration and inflow problem identified by the TV camera program.

BE IT FINALLY RESOLVED that the cost of this TV camera program shall not exceed $20,000.00.

Newburgh-Stewart Economic Development Zone

Motion by Councilwoman Mullarkey, seconded by Councilman Finnegan that the Town Board of the Town of New Windsor authorize the Town Supervisor to forward a letter tothe Director of the Newburgh-Stewart Economic Development Zone stating that the Town of New Windsor has no objection to the relocation of four (4) businesses owned by Drew Kartiganer from the Town of New Windsor to the City of Newburgh Economic Development Zone, specifically:

  1. Dwelling Group, Inc.;
  2. Drew Kartiganer, Architect;
  3. Real Structures Inc.; and
  4. Rhino Construction Corp.

#8 On Agenda – Motion-Authorization for Supervisor to Execute Easement

Agreement Between TNW & Dicor Builders, Inc. Lafayette

Motion by Councilwoman Townsend, seconded by Councilwoman Mullarkey that the Town Board of the Town of New Windsor authorize the Supervisor to execute an Easement Agreement between the Town of New Windsor and Dicor Builders, Inc. concerning access over an unimproved portion of Lafayette Drive known as Section 48, Block 2, Lot 9.

#9 On Agenda – Receive and File-Public Improvement Lien Between TNW &

Newburgh Winwater Works Co. Drainage Improvements Phase 2E

Hearing no objections, the Town Board of the Town of New Windsor receive and file a Public Improvement Lien between the Town of New Windsor and Newburgh Winwater Works Co., 653 Route 52, Walden, New York 12586, dated June 22, 2000 in the amount of $90,349.21.

#10 On Agenda – Motion-Adopt Order Calling Public Hearing and Publication-

Proposed Drainage District #2 – Windsor Woods Subdivision

Motion by Councilwoman Townsend, seconded by Councilman Finnegan that the Town Board of the Town of New Windsor authorize adoption of an Order Calling a Public Hearing entitled, “In the Matter of the Establishment of Drainage District No. 2, in the Town of New Windsor, County of Orange, New York, pursuant to Article 12 of the Town Law,” the public hearing to be held on the 2nd day of August, 2000 at 7:00 p.m. in the Town Hall, 555 Union Avenue, New Windsor, New York and direct the Town Clerk to publish the Order according to law.

#11 On Agenda – Motion-Authorize Supervisor to Execute License No. DACA51-3-

100 Between TNW & the Secretary of the Army for the use of

Four Ball Fields on Ten Acres at the Former STAS Property

Motion by Councilwoman Mullarkey, seconded by Councilman Finnegan that the Town Board of the Town of New Windsor authorize the Supervisor to execute a License Agreement for the use of (4) ballfields on (10) acres at the former STAS property between the Town of New Windsor and the Secretary of the Army for five years at a total of $2000.00 for the lease term.

#12 On Agenda – Motion-Amend Resolution-Employment Policy (Civil Service)

T/B Agenda 11-19-80 - #2/2

Motion by Councilwoman Townsend, seconded by Councilman Finnegan that the Town Board of the Town of New Windsor amend the Resolution marked #2/2 of the November 19, 1980 Town Board Minutes entitled “Employment Policy (Civil Service)” as follows:

WHEREAS, the Town Board of the Town of New Windsor desires to establish a policy to be effective immediately providing that only residents of the County of Orange be eligible for initial and continued employment by the Town of New Windsor.

NOW THEREFORE BE IT RESOLVED:

  1. That only County residents shall be selected from the Civil Service lists

Provided by the Orange County Department of Personnel.

  1. In the event that no County resident is on such Civil Service list, a candidate

for appointment to the Town must state in writing his or her intention to move

into the County within six (6) months after appointment.

3. County residency shall be an absolute condition of continued employment for employees hired after this date;

4. This policy shall not apply to employees presently employed with the Town of

New Windsor.

5. The Town Clerk is directed to forward a certified copy of this motion to the

Orange County Department of Personnel.

Hearing no objections, the Town Board of the Town of New Windsor receive and file with the Town Clerk a fully executed copy of the FY-2000 Community Development Municipal Agreement, between the Town of New Windsor and the County of Orange.

#14 On Agenda – Receive and File-SFY 2000/2001 NY Statewide Mass

Transportation Operating Assistance Program Contract

Hearing no objections, the Town Board of the Town of New Windsor receive and file with the Town Clerk a fully executed copy of the SFY-2000/2001 Statewide Mass Transportation Operating Assistance Program Contract, between the Town of New Windsor, Town of Cornwall and the County of Orange regarding the Dial-A-Bus Program.

Hearing no one wishing to speak, Supervisor Meyers entertained a motion to close the Public Forum portion of the Agenda.
