With due call and notice thereof, the January 6, 2009 regular meeting of the Eden Valley City Council was held at 7:00 p.m. in the City Hall meeting room. Present were Mayor Blomker, Councilors Korman,Reetz, Thielenand Bethel. Clerk Haag, Deputy Clerk Anderson, Public Works Director Rademacher,Chief Junker and others.

The agenda was reviewed.A motion to approve the agenda with was made by Korman seconded by Bethel and carried unanimously.

A motion to approve the consent agendawas made byBethelseconded by Kormanand carried unanimously. Items on the consent agenda were as follows: Approve minutes of the December 9, 2009regular meeting and approve minutes from the December 21, 2009 special meeting.

Mayor Blomker noted item #2 was resolved prior to the meeting and moved to item # 3 on the agenda.

A motion to approve the 2010 appointments was made by Reetz seconded by Bethel and carried unanimously.

Resolution 2010-1 “Resolution Amending City Code Chapter 8 and Establishing Water Rates, Sewer Rates and User Charges in the City Fee Schedule was introduced and moved for adoption by Thielen.

RESOLUTION No. 2010-1

RESOLUTION AMENDING CITY CODE CHAPTER 8 AND ESTABLISHING WATER RATES, SEWER RATES, AND USER CHARGES IN THE CITY FEE SCHEDULE

WHEREAS, the Eden Valley City Council (“Council”) has determined that water rates must be increased;

WHEREAS, the Council has determined that water rates, sewer rates, and user charges should be established in the City Fee Schedule rather than individually by ordinance;

NOW, THEREFORE, BE IT RESOLVED, that the Eden Valley City Council adopts the following revisions to Chapter 8 of the Eden Valley City Code (additions are noted by underlining, deletions are noted by strikeout):

801.090. WATER RATES.

Bi-monthly water rates shall be based on the following: established in the City Fee Schedule.

$ 7.00 per month base.

$ 6.85 per one thousand (1,000) gallons.

803.080. SEWER RATES.

Bi-monthly residential sewer rates shall be based on the water usage for the quarter. Base of $6.00 per month, $3.25 per thousand (1000) gallons. Residences without City water will have their sewer rate based upon the number of people living in said residence on January 1 of each year. Sewer rate for residences without City water shall be $6.00 per month base, $3.25 per thousand (1,000) gallons; $23.70 for one person every two months, $35.40 for two people every two months, etc. The estimated water charge is based on sixty (60) gallons per day per capita. Bi-monthly business sewer and residential rental property rates shall be based on the water usage for every two months. Sewer rate shall be base of $6.00 per month, $3.25 per thousand (1,000) gallons. Sewer rates shall be established in the City Fee Schedule.

806.010. USER CHARGE (RESIDENTIAL).

The bi-monthly user charge shall be based upon water usage. The sewer use charge shall be $6.00 per month base, $3.25/1000 gallons of water used in said two month period. Charges for residences not having City water shall be based on $6.00 per month base and water usage of sixty (60) gallons per day per capita. User charges shall be established in the City Fee Schedule.

806.020. USER CHARGE (COMMERCIAL).

The bi-monthly user charge shall be based upon water usage. The sewer use charge shall be $6.00 per month base and $3.25/1,000 gallons of water used. Users not having City water will be furnished with a water meter. User charges shall be established in the City Fee Schedule.

NOW, THEREFORE, BE IT FURTHER RESOLVED, that the Eden Valley City Council makes the following addition to the City Fee Schedule:

Water Rates

$7.00 per month base fee

$7.05 per one thousand gallons

Sewer Rates

$6.00 per month base fee

$3.25 per one thousand gallons

The bi–monthly rate for residences/businesses without City water shall be $12 plus $11.70 for each resident/full-time employee.

User Charge (Residential)

$6.00 per month base fee

$3.25 per one thousand gallons

The bi–monthly charge for residences without City water shall be $12 plus $11.70 for each resident.

User Charge (Commercial)

$6.00 per month base fee

$3.25 per one thousand gallons

Motion seconded by Bethel. Voting in favor were Thielen, Bethel, Blomker, Reetz and Korman. Opposed none, whereby Resolution 2010-1 was duly adopted.

Resolution #2010-2“Resolution Designating Fund Balances” was introduced and moved for adoption by Reetz seconded by Korman. Voting in favor were Reetz, Korman, Blomker, Bethel and Thielen. Opposed none, whereby Resolution 2010-2 was duly adopted.

Resolution #2010-3“Resolution Reviewing and Adjusting Fee Schedule” was introduced and moved for adoption by Reetz and seconded by Bethel.

RESOLUTION REVIEWING AND ADJUSTING “FEE SCHEDULE”

WHEREAS, the City has established a fee schedule for specific services it provides from time to time; and

WHEREAS, the City Council shall review such fees from time to time and adjust where deemed necessary.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Eden Valley, Minnesota, that the following fees are hereby enacted.

CivicCenter Rental – Private parties, etc.$ 50.00

CivicCenter – Wake lunches & service groups, etc.no charge

The bi-monthly rate for residences/businesses without City water shall be $12 plus $11.70 for each resident/full-time employee (1800 gal/mo/person estimate)

Water Meter – 1 meter (5/8”) will be provided by City per watermain connection, any additional meters will be billed at cost. (including oversized meters)

Fire Department False Alarm Calls(3 or more false alarms/year) $750/call

Police Department False Alarm Calls (3 or more false alarms/year) $50/call

BE IT FURTHER RESOLVED that the fees prescribed above shall be effective immediately, unless otherwise specified herein.

Voting in favor were Reetz, Bethel, Blomker Thielen and Korman. Opposed none whereby Resolution 2010-3 was duly adopted.

Resolution #2010-4 “Resolution Setting Administrative Offenses Penalties” was introduces and moved or adoption Betheland seconded by Thielen. Voting in favor were Reetz, Korman, Blomker, Bethel and Thielen. Opposed none, whereby Resolution 2010-4 was duly adopted.

Planning and Zoning minutes were reviewed by Anderson. It was reported the ZoningCommission is recommendingapproval of an administrative lot subdivision submitted by Douglas Ruhland on behalf of Tom and Mary Ann Ruhland and John and Joan Bradshaw. After review a motion was made by Korman to accept the Planning and Zoning Minutes as presented. Motion seconded byReetz and carried unanimously.

Public Forum was opened. Meeker County Commissioner Wally Strand discussed grant opportunities with the council.With no further comments or concerns Mayor Blomker closed the public forum.

Clerk Haag provided alawn and weed certification list for the council. The Armer radio final agreement between EdenValley and MeekerCounty was given to the council. Information was given on insurance dividend from the LMCIT. Haag noted the Stearns County Municipal league meeting will be in held in St. Martin on January 19, 2010 and the council needs to rsvp if attending. Haag notedunofficial notice had been given that the City of Eden Valleywas awarded the Healthy Communities grant. It was the council’s consensus that EdenValley will keep their Local Board of Review powers. Haag reported Holly from the SRWD contactedher and would like to set up a meeting to discuss the Council’s petition in mid to late February. Mayor Blomker, Councilor Korman and Clerk Haag had been involved in previous discussions and will try to schedule a date with Holly. Newly elected and elected officials conference information was providedand anyone interested should let Haag know to be registered. Korman noted he will be attending. Clerk Haag also reported she would be reviewing pledged collateral at bank and CD investing.

Public Works Director Rademacher reviewed year end water pumped and treated numbers with the Council. Rademacher also reported on general maintenance issues throughout the city. Rademacher noted they will be replacing a variable speed drive at the wells. CPRail is planning to redo the railroad crossing in EdenValley this upcoming year.

Chief Junker handed out his year end report for 2009. Junker also reported he is still working on hiring the second part-time police officer.

The Clerk presented the bills. Total Expense: $523,895.52

The bills were reviewed and it was noted Councilor Thielen, Councilor Bethel and Mayor Blomker didn’t feel they needed to receive the LMC 2010 handbook. A motion to approve the bills with the deduction stated above was made by Korman seconded by Bethel and carried unanimously.

Next Council meeting date will beFebruary 10, 2010.

With no further business a motion to adjourn the meeting was made byBethel seconded byReetzand carried unanimously.
