MINUTES OF THE REGULAR MEETING OF COUNCIL OF THE RURAL MUNICIPALITY OF ARMSTRONG HELD IN THE COUNCIL CHAMBERS IN THE TOWN OF INWOOD, MANITOBA ON TUESDAY, NOVEMBER 13, 2012.

WHEREAS THE Financial Statements for the period ending October 31, 2012 have been examined and found to be in order;

THEREFORE BE IT RESOLVED that the said Financial Statements be approved.

WHEREAS the accounts of the Rural Municipality of Armstrong for the period ending November 13, 2012 have been examined and found to be in order,

THEREFORE BE IT RESOLVED that cheque numbers 10382 to 10452 in the amount of 594,195.65 excluding cheque number 10437 in the amount of $11,361.00

and cheque numbers 10453 to 10458 in the amount of $12,933.30 be approved for payment.

HEARING DELEGATIONS:

·  1:00 PM : Joseph Stogrin re: mill rate comparisons / taxes comparisons

o  Did not attend, mill rates and assessments will be forwarded to him

·  1:15 PM : Interlake Excavating / Bochurka Bros. / other contractors re: grading / snowplowing / gravelling

o  Attending were Mr. Strick, Mr. Bochurka, Mr. Dziadek

o  Mr. Dziadek speaking for the contractors asked why the gravelling contract was not tendered

o  Contractors were told by the Reeve that the gravelling contact was extended for four years and this was an extension and nothing else was changed

o  Contractors asked questions regarding why there was an extension of the road grading and gravelling contract opposed to the contractors being given the opportunity to bid

o  Councillor Marchak stated that it was his position that the Municipality could not get better prices and that was the way Council voted

o  Contractors requested a copy of the Municipality’s purchasing policy

·  Eugene Klochko – Not on the agenda – allowed to speak

o  Commented that there should be tendering every year

o  Requested a street light on the property in Malonton

o  Snow mobiles are speeding by and there are children in the area

o  There is a hydro pole nearby for the light by the property

o  Councillor Evanchyshin said he knew where the pole is

·  1:30 PM Wayne Spakowski –North bass drain / Willow creek drain

o  Drainage is affecting the property

o  Requesting some drainage work from the east moving to the west from the Province

o  Province of Manitoba , Mr. Shipley will not return my calls

o  Mr. Spakowski would like the Municipality to write a letter to the Province, Mr. Shipley, regarding drainage work to be done on the North Bass Drain and Mr. Spakowski would like the Province’s response to be copied to him

o  Mr. Spakowski commented that windrows of gravel and crushed rock are being spread onto his property by the grader wasting money. Councillor Marchak commented that the fall wet weather would not allow the graders to get out and maybe the roads should have been graded in August

o  Reeve Wasylowski commented that the Bass Drain has been draining in the off season

o  Wanted to know when the road will be done

o  Councillor Marchak commented that his process of issuing quotes was not done properly and that the purchasing policy was not followed. Councillor Marchak commented that the road would be added to the 2013 budget discussions

o  Reeve Wasylowski commented that there was no road plan or design prepared

RESOLVED THAT the Council of the Rural Municipality of Armstrong direct administration to enter into 5 year Road Grading and Snowplowing Agreement with Armstrong Construction Limited and Brocker Trucking.

And Further that the signing officers of the Municipality be directed to sign and execute the agreement.

RESOLVED THAT the Council of the Rural Municipality of Armstrong designate Reeve Wasylowski and Councillor Pfrimmer to attend the Shoal Lakes Flooded Landowners Association Meeting on November 22, 2012 at 7:00 PM at the Woodlands Legion Hall to discuss the Grassmere Drain.

RESOLVED THAT the Council of the Rural Municipality of Armstrong designate a minimum bid for the 2012 Tax sale to be held in the Council Chambers in the Town of Inwood on December 6, 2012

And further that the minimum bid be equal to the tax sale costs plus applicable taxes on the following properties as described in the public Tax Sale Notice as follows:

Pioneer Trail:

o  October 18, 2012 attended Interlake Pioneer Trail committee meeting. Reps from Snoman and Interlake ATV club were present. Trail signage was discussed. Request for Municipalities to help install road markers along trail. A pioneer Trail logo was discussed. Decided to hold a contest from schools within the trail municipalities. One finalist from each school

South Interlake Emergency Measure Board:

o  October 20, 2012 Coordinators report on file

Interlake Tourism Association:

o  September 27/12 Minutes of May meeting, financial report and updates on files. Requested Council to list community events for 2013 as they must be submitted to ITA by January 5th to be included in the Interlake Travel Guide.

West Interlake Watershed Conservation District, Lower West Interlake Sub-District:

o  Minutes of September 20th Executive Board meeting on file.

November 7, 8 and 9, 2012 attended Disaster Management Conference.

BE IT RESOLVED that Council dissolve into a committee as a whole in camera to discuss Lease Policy and Legal Issues in a closed session in-camera at 3:55 P.M. and as per Section 83(1) (d) of The Municipal Act each member of Council is to keep in confidence the matters discussed at this session which is closed to the public under subsection 152(3) and that the committee decides to keep confidential until the matter is discussed at a meeting of the Council or of a committee conducted in public.

RESOLVED THAT the Council of the Rural Municipality of Armstrong approve a payment of $23,615.83 plus additional costs to Westshore Marine & Leisure on the condition that an invoice is provided to the Municipality in the amount of $23,615.83 plus additional costs.
