OVERVIEW:
The Spring Valley Outfall Sewer, Manholes 31-35 Project, located in Bonita from north of the Sweetwater River to Willow Street (Thomas Guide page 1310, D-4), is planned for construction in Fall 2009. The Spring Valley Outfall was constructed in 1963 to transport sewage from the Spring Valley Sanitation District to the City of San Diego’s Metropolitan Sewage System. This project will rehabilitate approximately 4,200 feet of deteriorated sewer pipe between Manholes 31 and 35.
On March 13, 2009, a Mitigated Negative Declaration for the Sewer Rehabilitation Project was circulated for 30-day public review. The review period ended April 11, 2009. Comments were received and staff has responded.
This is a request for your Board to adopt the Mitigated Negative Declaration, and to authorize negotiation and acquisition of right of way in preparation for construction of this sewer rehabilitation project.
This is the fifth Spring Valley Outfall sewer project during the last five years that has come to your Board of Directors. Portions of existing sewer and easements were realigned during the Spring Valley Outfall Sewer, Manholes 35-37 project that was constructed last year. Upon completion of construction of the current rehabilitation project, the sewer easements along the abandoned sewer from last year’s project can be vacated.
FISCAL IMPACT:
Funding of $20,000 for right of way acquisition is budgeted in the Department of Public Works Fiscal Year 2008-09 Detailed Work Program. The funding source is Spring Valley Sanitation District. A full fiscal statement will be included when this item is brought to the Board of Supervisors at a later date for approval to advertise and award a construction contract. Cost of construction is estimated to be approximately $4,000,000. There will be no net General cost, no subsequent year costs and no need for additional staff as a result of this request.

RECOMMENDATION:
CHIEF ADMINISTRATIVE OFFICER
1.  Find, on the basis of the whole record, there is no substantial evidence the project will have a significant effect on the environment. Consider the Mitigated Negative Declaration dated March 13, 2009, for the Spring Valley Outfall Sewer Project (Manholes 31-35), on file with the Department of Public Works (Attachment B), together with any comments received during public review, and adopt it, finding it reflects the independent judgment and analysis of the Board of Supervisors.
2.  Adopt the Mitigation Monitoring and Reporting Program prepared in accordance with Public Resources Code, Section 21081.6, and direct the Director, Department of Public Works, to ensure compliance with the Mitigation Monitoring and Reporting Program.
3.  Adopt the Findings of Conformance with the Multiple Species Conservation Program.
4.  Authorize the Director, Department of General Services to commence negotiations and acquire right of way needed to construct the Spring Valley Outfall Sewer, Manholes 31-35 Project.
5.  Adopt the resolution entitled Resolution to Summarily Vacate Portions of Spring Valley Outfall Easements Superseded by Relocation in the Bonita Area.
6.  Direct the Clerk of the Board to record the Resolution to Summarily Vacate Portions of Spring Valley Outfall Easements Superseded by Relocation in the Bonita Area upon the certification of the Director of Public Works that the new sewer system improvements have been completed.

Noting for the record that an Errata sheet for Attachment B has been submitted, ON MOTION of Director Roberts, seconded by Director Horn, the Directors of the San Diego County Sanitation Districts took action as recommended, on Consent, adopting Resolution No. 09-078, entitled: RESOLUTION OF THE BOARD OF THE SPRING VALLEY SANITATION DISTRICT TO SUMMARILY VACATE PORTIONS OF SPRING VALLEY OUTFALL SEWER EASEMENT SUPERSEDED BY RELOCATION, IN THE BONITA AREA.

RATIFICATION OF EMERGENCY REPAIR OF WOODSIDE AVENUE INTERCEPTOR SEWER IN LAKESIDE (DISTRICT: 2)
OVERVIEW:
The existing Woodside Avenue Interceptor Sewer was constructed in 1974 in Lakeside (Thomas Guide page 1231, J4). The 21-inch diameter sewer pipe transports sewage from the communities of Alpine and Lakeside to the City of San Diego’s Metropolitan Sewage System. The County’s Wastewater Management staff uses video inspections to detect problems in the system. A video taken inside the sewer pipe revealed a two-to-three-foot section of the side of the sewer pipe had broken off.
Immediate repair of the sewer on an emergency basis was necessary to address the risk of a sewage spill or sink hole in the ground that could cause a significant threat to health and property. This imminent threat did not allow time to undertake the usual and preferred competitive bidding and award process. Public Works took the necessary steps to secure an emergency contractor to immediately repair the sewer to prevent a catastrophic failure.
At first, staff thought that the repair would be a simple segment repair. However, due to the close proximity of the sewer pipe to two privately-owned major fiber optic lines that could not be disturbed, construction became much more complex. A trenchless rehabilitation method was chosen to repair the sewer. The contractor constructed two new manholes and a pipe liner was inserted through the manholes into the existing pipeline. When the work was undertaken under the authority of the Director, Purchasing and Contracting the total cost was thought to be less than $50,000. Because the work became much more complex, by April the cost estimate for completed work was $130,000. Any amount over $50,000 requires Board ratification pursuant to Public Contract Code Section 20123.
This is a request to ratify the emergency repair project and find there was a need to repair the Woodside Avenue interception sewer.
FISCAL IMPACT:
Funds for this request are included in the Fiscal Year 2008-09 Operational Plan in the operation and maintenance account, which includes a contingency fund for emergency repairs, as they must be done quickly. The funding source is Lakeside Sanitation District Fund fund balance. The emergency sewer repair project has resulted in $130,000 current year cost, no annual cost, and will require no additional staff years. There will be no fiscal impact to the County General Fund.

RECOMMENDATION:
CHIEF ADMINISTRATIVE OFFICER
1.  Ratify the emergency repair project as approved by the Director of Public Works and as authorized by the Department of Purchasing and Contracting consistent with Administration Code 402 and per Requisition No. 61317 issued on March 5, 2009.
2.  Pursuant to Public Contract Code Section 22050(c)(2), find that there was a need to repair the Woodside Avenue Interceptor Sewer on an emergency basis without giving notice for bids to let a contract.
ACTION:
ON MOTION of Director Roberts, seconded by Director Horn, the Directors of the San Diego County Sanitation Districts took action as recommended, on Consent.
