REGULAR COUNCIL MEETING

9-28-11

Council Present: Lee, Pavelka, Broadwater, Schmoker

Council Absent: Sattre

Others Present: Gary Gile, Justin Leonhardt, Lee and Donna Campbell, Bruce and Rose Holtzman, Randy Wagoner, Wabasha PD, Susan Harris

The meeting was started with the Pledge of Allegiance at 6:30 PM

FIRE REPORT:

No Report from Fire Department. Harris commented that at the last meeting a question was asked of Bruce concerning if Harris had spoken to the City Attorney in regards to the proposed fire department personnel policy and Harris stated that she has not met with Jarstad yet but hopes to by next meeting.

KLS REPORT:

POLICE REPORT:

Officer Wagoner was present and discussed minor issues in Kellogg, stating fest went well, Wagoner also advised council on the retirement of Chief David Kruger to become effective December 31, 2011, Wagoner went on to state that the city of Wabasha is considering abolishing the Wabasha Police Department as a cost saving measure and contracting with the Sheriff department for police protection. Lee commented that this is the first he has heard about this, commenting that he did not think a good idea and it would end up costing Kellogg more in police protection. Wagoner commented that, that is what is in the works as of now and advised council to become involved.

Some discussion occurred as to the state of the police contract and terms.

WATER / SEWER REPORT:

Gile was present and reported that all but two meters are put in and those two are residents that aren’t around right now, but Gile and Harris will work with HD and come to a resolve, Gile then reported that very soon they will be working with Harris and HD supply for all the formal training. Schmoker asked how the process went and Harris commented that both companies have been great to work with for the most part after getting through the address fiasco in the beginning. Harris then commented that after this process she hopes that she will be able to incorporate the correct addresses to the residence for the first time since she started for the last clerk either never finished it or never followed through to ensure everything was right, that included the software billing addresses. Harris also commented that the residents seemed happy as well. More discussion occurred. Schmoker stated that, that is really good that only two houses are left and that he did see them working late. Harris stated that the software updates and data dump is the next important step in this process. Moving on Gile commented that the hydrant is in, and that sewer is now hooked up at the city shop. Lee asked if they were going to install a stool or sink and Gile stated that, that was the plan eventually. Gile then referenced the bleach in the system and commented that all samples came back clean.

PARK / GYM /STREETS REPORT:

Leonhardt was present and stated that he did finally receive one more bid on the exterior of the post office upgrades and asked if the council was interested in looking at that now or not and Lee commented that he would like to wait until next year to see if there will even be a post office in Kellogg, all agreed. Schmoker asked if there is a yearly lease with them or how that works and Harris commented that there really are no negotiations with the USPO, and that ever few years they mail her an updated form is all. Leonhardt then asked council about the drain down on Austin to see if they wanted him to fix the casting this year yet and Pavelka commented that it has been on agenda for work to be done and would like to see it finished. Leonhardt then asked council if they wanted him to order a new casting for the drain or Wingert gave him the outside part of a casting that Leonhardt could make grates for, he wanted to know what they wanted done. Leonhardt commented that a new one would cost somewhere around $400.00 plus freight. Some discussion occurred. It was decided after discussion to have Leonhardt purchase a new casting and install it. Broadwater commented that if you look at the castings by his place or the welding shop, he figures that Leonhardt can make a round man hole, and just get a round casting and leave it down low enough that all the water can run into it. Leonhardt asked if they wanted it graveled this year and next asphalted? Broadwater commented that it looks like part of the street not a ditch and we should leave it like a ditch and to order dirt and grass seed and narrow the road up like its supposed to be so they don’t drive over it anymore. Broadwater did not think it needs to be a deep ditch just formed. Leonhardt will order the casting and complete the job.

CONSENT AGENDA

MOTION BY PAVELKA SECOND BY SCHMOKER TO APPROVE THE MINUTES FROM THE REGULAR COUNCIL MEETING ON 9-14-11 AYES:

MOTION BY BROADWATER SECOND BY PAVELKA TO APPROVE THE ACCOUNTS PAYABLE WITH CHECK NUMBERS: 93283-93302 AYES: ALL, SATTRE ABSENT. MOTION CARRIED.

COUNCIL ADDRESSEES:

Lee and Donna Campbell 605 Sheppard Street

Bruce and Rose Holzman 535 N. Sheppard Street

Mr. Campbell addressed the council as estate holder of the Roger Bolstad property which is located at the edge of the city in Greenfield Township, stating that they recently had the property surveyed and asked council about an unnamed street that ran south of the property. Campbell claimed that their surveyor could not find record that it had ever been vacated or abandoned by the city and if not was interested in asking the city to consider it. Harris commented that they had called the office in regards to this and Harris began working on it immediately, she believed that after speaking to the surveyor, and the Holzman’s to the south that it had been done and is in possession of the Holzman family, and reflects that on their property deed, but will call the county and research if it had indeed been done and filed. The Campbell’s then asked about the city ordinances pertaining to housing chickens in the city limits and what the fencing ordinances were, for he claimed that in the county regulations it stated 50 feet off property lines and Harris could not remember at that time if it was permitable for chickens or not in the old ordinances but will look and also make copy of the zoning ordinances and supply both parties with that information. Harris believed that the zoning ordinances referenced 1 (one) or 2 (two) feet off property line for fencing but again was not for sure but would verify that for them. Lee then asked if there were any questions and Rose Holzman introduced herself and gave a copy of their deed and abstract showing that indeed they own that portion of the unnamed street. Harris received a copy of it for record and will use that it researching the whole situation of the question of the property lines. Mrs. Holzman went on to state that she feels this is not about the chickens for they, the people living in the Bolstad home also have chickens, she feels that this is more of a personal thing for the police have been called several times to both locations. Lee stopped the conversation of the civil issues and stated that the city can not get involved in personal issues, that they can only be involved in the land issue of it involves city property. Mrs. Holzman then handed Harris pictures to be kept on file of some of those issues. Both parties thanked the council for there time and left the meeting.

OTHER BUSINESS:

Schmoker commented that Nov. 9th he would be gone.

Lee referenced the preliminary budget meeting where they set the preliminary levy amount Lee commented to council members to pay attention to their property tax statements claiming that his property tax will already gone up some $283.00, and that is with a zero levy increase on the county level, and we don’t know what else the county, school, or the state will be doing we should be very careful in the upcoming budget meetings. Some discussion occurred.
