REGISTER IN PROBATE

Probate Division

Basic Function

  1. Perform the duties of the Register in Probate, Registrar in Probate and Probate

Commissioner as defined by Wisconsin Statutes.

2. Manage the operations of the Racine County Circuit CourtProbate Division in cooperation with the Clerk of Courts.

Essential Duties

  1. Responsible for planning and supervising , in cooperation with the Clerk of Courts, the work of clerical employees who are engaged in varied clerical duties requiring considerable knowledge of the procedures as outlined by laws governing probate, guardianships, protective placements and mental proceedings.
  2. Oversee the documents filed with this Court in wills and intestacy proceedings, minor or incompetent guardianship proceedings and protective placements.
  3. Assist and/or respond to inquiries regarding probate matters from the general public and attorneys.
  4. Administer any oath required by law. Establish and maintain a proper suspense system to assure that the required documents are filed within the time limits mandated by law. Prepare copies or certified copies of documents when the general public, attorneys or agencies request them. Collect appropriate fees for filing.
  5. Act as Probate Registrar and interview, advise and assist persons who desire to use the Informal Administration.

Supervision Exercised

Has functional and administrative supervisory responsibility for one deputy register in Probate, one guardianship administrator and one clerical person in cooperation with the Clerk of Courts.

Supervision Received

Receives supervision from the Probate Judge. May receive instructions from the Clerk of Circuit Court.

Qualifications

Education and Experience:

Law Degree preferred

  • Knowledge and experience in filing and processing probate court case types.
  • Knowledge of legal terminology and Wisconsin Statutes affecting probate matters.
  • Ability to communicate effectively both verbally and in writing
  • Ability to work cooperatively with others, including co-worker, lawyers and the public

Special Considerations

The appointment of an employee to this position is made in accordance to Wisconsin Statute 851.71(1). The judges of the county shall appoint and may remove a register in probate. Appointments and removals may be made only with the approval of the chief judge.
