Regarding regional statistics, the Council of Ministers Decision of 2002/4720 concerning the Definition of Classification of Regional Units for Statistics in Turkey, which will enable the collection of relevant data compatible with the Union’s NUTS criteria, was published in the Official Gazette on 22 September 2002, nNo.: 24884 on 22 September 2002.

lLaw no: 4651 of 25 April 2001 amending the Central Bank of the Republic of Turkey’s (CBRT) Law No 1211, corresponding to the Guideline of the European Central Bank of 11 May 2000 on the statistical reporting requirements of the European Central Bank in the field of balance-of-payments statistics, the international reserves template and international investment position statistics, was published in the Official Gazette on 5 May 2001, No.: 24393 on 5 May 2001, and has entered into force on the same day. This amendment authorizes the Central Bank of the Republic of Turkey to request and collect all statistical information relating to balance of payments statistics directly from banks, other financial institutions and persons.

lLaw nNo.: 4651 amending the lLaw of the Central Bank of the Republic of Turkey (CBRT) has also maintained harmonisation with the Council Regulation No 2533/98/EC of 23 November 1998 concerning the collection of statistical information by the European Central Bank . With this amendment, authority was given to the CBRT to collect statistical information not only from banks but also from other financial institutions in order to monitor the financial markets.

The same amendment in the lLaw has also maintained harmonisation with Regulation No 2819/98/EC of the European Central Bank of 1 December 1998 concerning consolidated balance sheets of the monetary and financial institutions sector.

Law No. 4904 on Turkish Employment Organization, corresponding to Commission Regulation No 1924/1999/EC, Commission Regulation No 1897/2000/EC, Council Regulation No 577/98/EC and Commission Regulation No 1925/1999/EC regarding labour force statistics, was published in the Official Gazette on 22 September 2002, nNo.: 25159 on 5 July 2003.

PRIORITY 12.1 Data Security Aand Statistical Confidentiality

1- Priority Description

In the framework of the Turkish National Programme for the Adoption of the Acquis of 24 March 2001, a new Statistical Law must be prepared with respect to work to be completed in the statistical area and the draft law model proposed by Eurostat. For this purpose, a Legislation Preparation Sub-Committee was formed for the works foreseen in the first national programme. The Draft Statistical Law prepared by this Committee was presented to the Presidency of the Institute. Following high-level meetings in the Presidency, the draft law has been completed. After preparation of justifications and translation into English, it will be presented to other public institutions for their opinions.

1- Priority Description

Turkey has to comply with the EU legislation regarding implementation and usage of classification, standards, and terminology.

The correct and efficient usage of international, European and national classifications in the data collection and compilation process at the State Institute of Statistics (SIS) as well as at the other public administrations and private institutions should be improved.

a) Turkey is largely in conformity (i.e. codes and definitions of goods, duty rates of goods covered by the customs union, measurement units, chapter and section notes and annex notes) with the Combined Nomenclature provided in Annex 1 of Council Regulation 2658/87. The first alignment was implemented with the Decision of the Council of Ministers No 95/7591 amending the Customs Tariff List. In accordance with the revisions in the Combined Nomenclature of the EU, Turkish Customs Tariff Lists are published as a Decision of the Council of Ministers every December (The latest Decision of the Council of Ministers was published in the Official Gazette No 24078 of 29 December 2002). Partial harmonization has been made with the trade measures listed in Annex 2 of the above mentioned Regulation. Due to its structure, full alignment with the Regulation and also with the TARIC will be attained by the time of membership. In addition, transposition of the Classification Decisions and Explanatory Notes of Combined Nomenclature Manual will be accomplished in 2005.Turkey …….

PRIORITY 12.3 Registers

1- Priority Description

Modelling and applying a new Business Registers System

The concepts and definitions of European Union regulations related to setting up a new Business Registers system should be adopted. Based on this study, the new system should be modelled and implemented.

Applying address standards for administrative sources

Administrative sources to be used for establishing and updating procedures of Business Registers are required to use the standard address structure. The purpose of this study is to compare data from the same region originating from different sources.

Data sharing

Related Public institutions (Ministry of Finance, Social Insurance Institution (SSK), Turkish Employment Organization (ISKUR), Labour Institution, The Union of Chambers of Commerce and Commodity Exchanges of Turkey etc.) providing data to SIS within the scope of Business Registers, should introduce some changes in their laws in order to share those data with SIS. Registers to be used in forming and updating the business registers system cannot be shared because of data confidentiality. Therefore, legal and administrative obstacles should be removed.

Adjustment of Ministry of Finance and other related Institutions’s Registers

Studies should be conducted in order to keep the necessary variables in compliance with the EU acquisregulations within the framework of Ministry of Finance and related institutions’ records which are the main administrative source for Business Registers.
