Realty Server Rules

  1. The Associate is a licensed broker, associate broker or agent who is licensed with the Brokerage. A licensed broker, associate broker or agent is deemed to be an Associate for the purposes of the agreement effective the date of licensing with the Brokerage.
  1. For the purposes of this agreement with the Brokerage is defined as an Associate who has met one or more of the following criteria:
  2. Completed one full side of a trade in real estate in the previous 12 calendar months.
  3. Advertised or promoted his or her individual real estate services in the previous 6 calendar months.
  4. Listed or co-listed in their own name any real estate offering in the previous 6 calendar months
  5. Become licensed for the first time in Alberta in the previous 12 Calendar months with the exception of a licensed assistant
  1. Non-active brokers, associates and agents who are licensed with the Brokerage may choose to decline access privileges provided that he/she will remain inactive as defined in clause 2. The choice to opt-out shall become invalid effective the date that he/she becomes active again as defined in clause 2.
  1. Except where the Associate is an inactive Associate he or she shall pay a flat rate monthly RealtyServer Access fee to the Brokerage. This fee shall be $50.00 (+GST) per calendar month. The full monthly access fee is due and payable regardless of the Associatesusage of the RealtyServer system.
  1. The monthly fee referred to in clause 4 may be changed by the Brokerage upon the expiry of 30 days written notice from the Brokerage to the Associate.
  1. The Brokerage may suspend or terminate the Associate’s RealtyServer access privileges without notice.
  1. The Associate password shall remain the property of the participant Brokerage to whom they are issued. Passwords must be kept confidential except in the case of the real estate assistants who may want use the password of the Associate
  1. “Information” is defined as the alphanumeric entries that populate the database software of RealtyServer.
  1. The Brokerage has agreed to share the information and has authorized other Brokerages to utilize, publish and present the information in accordance with the provisions of a written agreement.
  1. The Associate shall enter new information into the system including new listings, changes, conditional sales, firm sales and off markets no later than 48 hours after such information is generated
  1. No listing information shall be entered into the database unless a copy of a duty executed listing agreement has been with the Brokerage
  1. When the Associate is involved in a trade in real estate in which the subject property was not previously entered into the database prior to the trade (eg. FSBO) then the Associate shall enter the relevant information into the database within 48 hours if the acceptance of an offer (ie. “Conditionally Sold). If the Associate has good reason (eg. Request of the client or vendor) not to enter the information at this time then the Associate shall enter the relevant information within the 48 hours of the Firm Sale of the property.
  1. A listing entered into the database must contain the minimum details required by the system. Failure to input the minimum required details will result in the listing being rejected
  1. The information contained in the database shall not be sold, exchanged or distributed.
  1. Information extracted from the database may be provided to an Associate’s legitimate clients, customers and the prospects for the purposes of meeting the Associates fiduciary duties to a client or for the purposes of providing information to customers and prospects in accordance with the normally accepted practices of the industry
  1. The Associate shall make his or her best effort to input correct information into the database. The database shall not be utilized to perpetrate a deliberate misrepresentation or fraud. The database shall not be used for any kind of criminal activity
  1. All disputes relating to the use of the RealtyServer system by other users shall be referred to and resolved by the Associate’s broker.

Date Entry Rules:

  1. Associates names and phone numbers are not to be included in the comment field
  1. All residential properties that do not allow occupants to reside on full-time basis, must be entered as a Recreational property.
  1. Manufactured homes must be entered as manufactured homes.
