By signing this Agreement, I hereby give permission for the Council for Exceptional Children (“CEC”) to post my writing to “Reality 101,” an Internet blog hosted by CEC. I understand that the purpose of this blog is for special educators who are new to the field to share their classroom experiences and receive feedback from peers and veteran educators.

1. Grant of Rights/Consideration. Blog posts will become property of CEC and permission to reuse will need to be granted from CEC. In consideration for CEC publishing my writing, I hereby grant CEC a royalty-free, sublicenseable right in each and to each of my writing to reproduce, publish, distribute, and display my writing.

2. Limited Exclusivity Period/Attribution. I will not, or permit any third party to, publish any writing in any media format for a period of not less than thirty (30) days from the date on which such writing is first published on Reality 101. After such period, if I publish, or any third party authorized by me publishes my writing, I will credit, and ensure that the third party credits, Reality 101 as first publishing the writing.

3. Term and Termination. Blogging will begin in Fall 2016 and continue approximately every two weeks through July 2017. If for any reason, CEC finds the blogger cannot perform his/her duties, the agreement can be terminated early. The Agreement can be terminated for any reason, or for no reason at all.

4. Writing Style. I agree to use people-first language in my writing, and will follow CEC style. I will receive a copy of the CEC Style Guide and editors will help with compliance.

5. Professional Conduct. I agree to present my writing in a professional manner, and not to use any obscene, indecent, or offensive language or to use any material that is defamatory, abusive, harassing, or hateful.

6. Editing Blog Posts. If CEC finds that the blog post content is not appropriate to post to Reality 101, CEC reserves the right to edit the blog post at any point. CEC also reserves the right to edit the blogger’s writing for grammar and content at any point. Substantial content changes will not be made without the consent of the blogger.

7. Denial of Blog Post. I understand that CEC has the right to deny publishing a blog post if it is not in the best interest of the blogger, the blogger’s school, or CEC.

8. Warranties. In each blog post, I warrant that (a) I am the sole author of each writing, (b) the writing is my original work, (c) the writing does not and will not plagiarize another’s work, (d) the writing has not, prior to publication on Reality 101, previously been published by myself or any person in any form; and (e) the writing contains no intellectual property owned by any third party or, if it does, I have consent to use it.

9. Indemnification. I agree to defend, indemnify, and hold harmless CEC, and its directors, officers, employees, licensees and agents, against any third-party claim, liability, damages, cost or expense, including reasonable attorney’s fees, arising out of any breach or alleged breach by myself of any provision of the Agreement.

10. Relationship of the Parties. Nothing in this Agreement shall be construed to create an employer-employee partnership or agency relationship between myself and CEC. I understand that I am an independent contractor and not an employee, partner, or agent of CEC.

11. CEC Membership. I understand that I will receive a one-year Basic membership in CEC for my commitment to the Reality 101 blog.
