1. Time limits of development of real estate let on perpetual usufruct to built on:
- Time limit of beginning of construction – 1 year since date of letting
- Time limit of completion of construction – 3 years since date of letting
Finish of foundation is considered as a beginning of construction.
Roofed building shell is considered as a completion of construction.
2. Time limits for payments:
- Fee of perpetual usufruct – yearly to 31 March of every year
- Rent – monthly to 10th day of every month
- Lease rent of agricultural lands – yearly to 31 March of every year
3. Rules of updating of rents and fees:
- On the basis of art.77 and 78 of “Act about real estates management” of the 21 August 1997 (Consolidated act: Journal of Laws of the Republic of Poland 2004 r. No 261 pos. 2603), fee of perpetual usufruct can be actualised once a year in condition of change of its marketable value
- Rent can be actualised once a year on the basis of a resolution of City Council of Chojnice
4. On the basis of art. 34 item 1 point 1 and point 2 of “Act about real estates management”, time limit to lodge application for person who have a right of pre-emption to acquisition of real estate, laps in 6 weeks past date of publication on list
* - Price of real estate established on the basis of its marketable value accordingly to the art. 67 item 3a. of “Act about real estates management”. (Auction price can be higher).
