Re: Your Request for Information from Adur District Council

I refer to your e-mail of 13th January 2012 asking for the following information:

1. “Evidence of the LAW (not statute) which states that all humans (NOT PERTSON) are obliged to pay Council Tax (including humans who are not willing consenting members of society”.

2. “Please provide a written copy of the procedure used by the Council to validate the information used to establish the arrears”.

3. Whether the Council can provide written evidence for that loss with full financial records and account to back up that debt when requested?

4. What processes Councils used to distinguish between a human being of flesh and blood and a person for such purposes of threatening prosecution?

The Freedom of Information Act provides a general right to be told whether or not a public authority holds recorded information and subject to certain exemptions, be given the information. This council hold no recorded information in response to your requests in 1, 2, 3 and 4. The Local Government Finance Act 1992 is the legal basis alone that requires local authorities to collect Council Tax.

We are thus unable to comply with your request as the information is not held.

If you are unhappy with the way that this request has been resolved, then you may ask for an internal review of this decision by writing to The Executive Head of Legal & Democratic Services (Jeremy Cook) at the Town Hall, Chapel Road, Worthing, BN11 1HA.

You may also make a complaint under Section 50 of the Freedom of Information Act to the Information Commissioner, who can be contacted at Whycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF. However please note that he would normally expect that any internal review procedures have been exhausted prior to contacting him.
