Dear NAME:

On DATE, the Division of Child and Family Services received a report alleging PHYSICAL ABUSE/ NEGLECT/SEXUAL ABUSE (choose all that apply) of NAME OF VICTIM(S) by NAME OF PERPEPRATOR(S). The Division investigated the report, and determined that there is credible evidence to SUBSTANTIATE Insert Specific Allegation Type (ABUSE/NEGLECT) as defined in Nevada Revised Statute (NRS) 432B.020 (1).

The Division intends to submit your identifying information to the State Central Registry unless you request an appeal.

A copy of the Division’s Appeal policy and procedures for appeal can be located online at http://dcfs.nv.gov/Policies/CW/1200/or requested from the address above if you do not have internet access. To request an appeal, you must submit your request in writing within fifteen (15) business days from the date on the certified mail receipt attached to this letter, to ______, Social Services Manager at ______.

A record of substantiation in the Central Registry will impact your ability to adopt, obtain a foster care license and employment in various fields, including child care and residential care for adults or children with developmental disabilities.

If you do not request a hearing within the required time frame, the substantiation may be entered in the Central Registry and your rights for any further appeal through the Division are waived.

If you have a pending child abuse and neglect evidentiary hearing before the court concerning the same instances of abuse or neglect, your hearings rights will be addressed through the court system. Your request for an appeal before the Division will be stayed pending the outcome of the evidentiary hearing before the court. If the court makes a final determination finding the child is in need of protection, your name will be entered in the Central Registry. The district court’s findings create a conclusive presumption that the abuse or neglect substantiation is affirmed.
