SUBJECT:Notice of Modifications to Proposed Additions and Amendments to Title 5 of the California Code of Regulations Pertaining to Mathematics Instructional Added Authorizations and Leadership Specialist Credentials

The Commission on Teacher Credentialing (Commission) conducted a public hearing on June 2, 2011 regarding Mathematics Instructional Added Authorizations and Leadership Specialist Credentials. Notice is Hereby Givenpursuant to the requirements of Government Code §§11346.8(d), 11346.9(a)(1), and 11347.1 that documents and other information which the Commission relied upon in adopting the proposed regulations have been added to the rulemaking file. The Commission is providing the following additional rationale for the proposed regulations, making non-substantive modifications to the text, and summarizing and responding to the one oral comment received during the Public Hearing. Anyperson who wishes to comment on the proposed modifications may do so by submitting written comments postmarked beginning August 18, 2011 to September 2, 2011 to the person indicated on the response form attached to this 15-Day Notice.

Note:Any written comments are to be restricted to the recent modifications to the enclosed language. The Commission is not required to respond to comments received in response to this notice on other aspects of the proposed regulations. All written comments received or postmarked by September 2, 2011, which pertain to the modified languagelisted in this notice will be reviewed and responded to by Commission staff as part of the compilation of the rulemaking file.

Rationale for Proposed Regulations

In addition to the rationale in the Initial Statement of Reasons, the following information clarifies the rationale for the terms associated with the Mathematics Instructional Added Authorization (MIAA), Mathematics Instructional Leadership Specialist (MILS) Credential, and Mathematics Specialist Instruction (MSI) Credential.

§80069.2

The Commission issues many types of authorizations that may be added to a valid general or special education teaching credential. These added authorizations require possession of a prerequisite teaching credential and remain valid as long as the prerequisite teaching credential is valid. Examples of added authorizations currently issued by the Commission are: CLAD Certificate/English learner and bilingual authorizations (5 CCR 80015.2); Added Authorizations in Special Education (5 CCR §80048.7); Adapted Physical Education Added Authorization (5 CCR §80046.1); and the Resource Specialist Added Authorization (5 CCR §§80070.4 and 80070.6).

To provide consistency in the regulations pertaining to added authorizations, the Commission is proposing that the term of the MIAA be the same as the term for the other added authorizations. Possession of a prerequisite teaching credential is required for initial issuance of a MIAA and the MIAA will remain valid as long as the holder maintains the validity of his/her prerequisite teaching credential.

§80070(c)(1)

The term for the MSI Credential was previously provided in 5 CCR §80553, which detailed the issuance and expiration dates for professional clear credentials. Amendments to Education Code (EC) §44277 deleted professional growth requirements; therefore, the cross-reference to 5 CCR §80553 is not appropriate for the MILS or MSI Credential.

EC §44225(l) grants the Commission the authority to determine the term for a credential as long as said term does not exceed five years. The term for ‘clear’ credentials issued by the Commission is normally five years. However, some ‘clear’ credentials are dependent on possession of a prerequisite credential. The ‘dependent clear credential’, in this file the MILS and MSI Credentials, cannot have an expiration date that exceeds the expiration date of the ‘prerequisite’ credential.Since the prerequisite teaching credential may not be valid for five years at the time an individual applies for the MILS or MSI Credential, the proposed language in this subdivision requires the expiration date of the MILS or MSI Credential to be the same as the prerequisite teaching credential.

§80070(c)(2)

The term for the MSI Credential was previously provided in 5 CCR §80553, which detailed the issuance and expiration dates for professional clear credentials. The proposed language in this subdivision allows for the issuance of a ‘dependent’ MILS or MSI Credential for five years if the prerequisite teaching credential is valid for five or more years at the time of application. Clear teaching credentials are issued for five years and life teaching credentials issued under previous statute are valid for the life of the holder.

Non-Substantive Modifications to the Proposed Regulation Text

§80069.2

(c): Added ‘to provide’ between ‘the holder’ and ‘the following’ to clarify the authorization.

(c)(1)(B): Removed the word ‘and’ and replaced the semicolon (;) at the end of this subdivision with a period (.) to clarify that an individual will receive a MIAA with the authorization in subdivisions (c)(1)(A) or (c)(1)(B). The holder of a MIAA will also be authorized to perform the duties described in subdivision (c)(2). The use of the word ‘and’ at the end of subdivision (c)(1)(B) seemed to incorrectly imply that another authorization option should be included below. However, the additional duties described in subdivision (c)(2) will be included in the authorization statement for both levels of the MIAA described in subdivision (c)(1).

Comment Received During the Public Hearing

  1. Alexandra Condon, California Teachers Association (CTA) expressed her concerns and wanted to go on record that CTA hopes proliferation of specialist credentials will not lead to misuse by districts by keeping teachers who do not hold the MILS Credential out of teaching positions.

Response: The Commission does not have authority over employment issues and cannot restrict employer options. The MILS Credential is not mandatory; it is designed for individuals who wish to further their knowledge related to mathematics instruction, curriculum, and staff development. Commission staff further explained that a specialist credential for Mathematics has been available for a number of years and, although “Leadership” is being added to the credential title, the previous specialist credential always included a leadership role in the authorization.

As for individuals who do not hold a specialist credential, there are two related Title 5 sections that provide employers with assignment options for individuals who hold teaching credentials issued on the basis of a baccalaureate degree and a teacher preparation program that included student teaching. The first related section allows an individual to serve as a staff developer at the school site, district or county level (§80020.4). The secondrelated section allows an individual to develop, direct, implement, or coordinate programs at the school site (§80020.4.1). Use of these assignment options is a local level decision based on an individual’s knowledge and experience to serve.
