SUBJECT:

CONSIDERATION OF A RESOLUTION AUTHORIZING THE EXECUTIVE DIRECTOR OR DESIGNEE TO NEGOTIATE, EXECUTE, AND AMEND IF NECESSARY AN INTERAGENCY AGREEMENT WITH THE RESOURCES AGENCY FOR UP TO $530,000 TO CONDUCT RAINBOW TROUT TOXICITY MONITORING IN THE SACRAMENTO RIVER WATERSHED

DISCUSSION:

California voters approved the “Safe, Clean, Reliable Water Supply Act”, Proposition 204, at the November 1996 General Election and the “Safe Drinking Water, Clean Water, Watershed Protection, and Flood Protection Act”, Proposition 13, at the November 2000 General Election. Both Proposition 204 and 13 include provisions for the Resources Agency to fund the implementation of ecosystem restoration projects. The Resources Agency has designated CALFED Bay-Delta Program and/or its successor entities (CALFED) as the administrator of any contracts that are issued to State agencies using funding provided by Propositions 204 and 13.

CALFED is a consortium of state and federal agencies as described in Water Code Section 78501, including those additional federal agencies participating in the Programmatic EIS/IER for the CALFED Program, or its successor entity.

As a result of the solicitation entitled, “Year 2000 CALFED Ecosystem Restoration Program Proposal,” the Central Valley Regional Water Quality Control Board (CVRWQCB) was awarded funding to conduct a study to determine the direct impacts of contaminants on salmonid species, specifically rainbow trout, in the Sacramento River Watershed. This study will complement the CVRWQCB’s ongoing activities. The total amount of funding awarded is $530,000.

POLICY ISSUE:

Should SWRCB authorize the Executive Director or designee execute a contract with the Resources Agency to conduct rainbow trout toxicity work in the Sacramento River Watershed and to negotiate, approve, and/or amend the contract?

FISCAL IMPACT:

CVRWQCB and the Budget Office will work to ensure that there is adequate reimbursement authority to cover said funding. The total amount of the study will be $530,000 to be spent over three fiscal years. The allocation will be $260,000 for the first year and $135,050 for the second and third years.

REGIONAL BOARD IMPACT:

CVRWQCB will be required to manage the Interagency Agreement between the SWRCB and the Resources Agency and the subcontract for toxicity work.

STAFF RECOMMENDATION

SWRCB adopt the resolution to authorize the Executive Director, or designee, to execute a contract with the Resources Agency to conduct rainbow trout toxicity studies in the Sacramento River Watershed and to negotiate, approve, and/or amend the associated grant and workplan.

AUTHORIZING THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO NEGOTIATE, EXECUTE, AND AMEND IF NECESSARY AN INTERAGENCY AGREEMENT WITH THE RESOURCES AGENCY FOR UP TO $530,000 TO CONDUCT RAINBOW TROUT TOXICITY MONITORING IN THE SACRAMENTO RIVER WATERSHED

WHEREAS:

  1. The “Safe, Clean, Reliable Water Supply Act”, Proposition 204, and the “Safe Drinking Water, Clean Water, Watershed Protection, and Flood Protection Act”, Proposition 13, include provisions for the Resources Agency to fund implementation of ecosystem restoration projects.
  2. The Resources Agency has designated the CALFED Bay-Delta Program or its successor entities (CALFED) as its administrator of the contracts issued to the state agencies using Proposition 204 and Proposition 13 funds.
  3. The Central Valley Regional Board contract is part of the CALFED Ecosystem Restoration Program year 2000 round of funding.
  4. The three-year contract will fund $530,000 from the Resources Agency to study the direct impacts of contaminants on salmonid species, specifically rainbow trout, in the Sacramento River watershed.

THEREFORE BE IT RESOLVED THAT:

The SWRCB authorizes the Executive Director or his designee to negotiate, approve, and/or amend an Interagency Agreement with the Resources Agency.
